About School of Law and Constitutional Studies
School of Law and Constitutional Studies (SLCS) is a constituent department of Shobhit University and is approved by the Bar Council of India. SLCS intends to introduce students to study law with an emphasis on the Constitution of India. The school focuses on legal studies with an understanding of how constitutional rules affect political and economic processes.
The school was formally inaugurated by Shri Keshri Nath Tripathi Ji, H.E. the Governor of West Bengal, and an eminent Advocate.
SCLS is approved by the Bar Council of India and is imparting top-class legal education since 2013. It offers various courses, such as BA.LL.B., B.Com. LL.B.(Hons.), BBA.LL.B.(Hons.) To confirm participation, teams of every Institution should register themselves.

Each Team is required to send a duly filled-in Registration form to mootcourt2021@shobhituniversity.ac.in by 30th September 2021. The subject of the mail should bear "Registration for 2nd National Moot Court Competition - 2021”.

Forms received after the last date of registration will not be considered. In case of any changes in the team composition, in terms of the members, the same must be officially conveyed to the Organizers before 8th November 2021.

2nd National Moot Court Competition shall be held on Thursday, 11th November and Friday, 12th November 2021 at School of Law & Constitutional Studies, Shobhit Institute of Engineering and Technology, deemed to be University, Meerut.
Eligibility
The competition is open for students pursuing 5 years integrated law course and 3 years LL.B.Course.
Language
The competition shall be conducted in English language only.
Team Composition
Each team shall consist of three members (two speakers and one researcher). In the case of medical emergency, the researcher will be allowed to argue instead of a speaker 1 or Speaker 2 with prior permission of the Dean (SLCS).
Criteria for Memorial Evaluation
In addition, a total of 12 hard copies (6 copies from each side) of the memorials should reach the Institute address on or before 30th October 2021.
Note: Memorial submitted after 30th October 2021 shall not be considered for evaluation.

Note: The identity of the Institution should not be revealed anywhere in the memorial as well as in any Annexure. Violation of this provision will result in a penalty including disqualification. The Organizer’s decision shall be final in this regard.

The font of the body of the memorial should be in Times New Roman, size 12, line spacing 1.5 & heading should be 14. The font of the footnotes should be in Times New Roman, size 10.

Memorials should be spiral bound.

Memorials should have one inch margin on all sides of each page.

Pages should be numbered at the bottom middle.

The memorial should not contain any photographs/ sketches/ exhibits/ affidavits etc.

All memorials received within the time schedule will be evaluated by the Memorial Evaluation Committee (MEC) to be constituted by the Dean in consultation with the Convener of the Moot Court Competition.

Researchers Test
The Researcher’s Test shall be conducted on November 11th 2021.
-
In a team consisting of three members, the member designated as Researcher shall take part in the test.
-
Participants are requested to write only the Team Code on the question paper.
-
The researcher’s Test shall be objective as well as subjective with the questions based on the applicable law, precedents, and facts pertaining to the Moot Problem.
-
The duration of the Researcher’s Test shall be 30 minutes.
-
The use of mobile phones, laptops, or any other electronic gadgets/ written material is strictly prohibited during the Researcher Test.
-
The Winner of the Test shall be determined based on the highest score attained
Note: The Speakers of any team will not be allowed to sit in the Researcher test in any case.
General Rules for Oral Round
-
The Researcher needs to be present with the speakers during all rounds.
-
The Researcher shall not be permitted to address the Court during the Oral Rounds.
-
The Researcher may, however, be permitted to pass notes to the Speakers at the discretion of the Judges. Such notes shall be passed through the court clerks present in the court room.
-
The use of mobile phones, laptops, or any other electronic gadgets is strictly prohibited during the Oral Rounds, subject to the discretion of the judges.
-
Participants may use their own bare acts, print outs and commentaries provided anonymity is not violated during the Rounds.
-
The decision of Judges as to the marks allotted to each team shall be final and binding.

General Procedure
Preliminary Round
-
Registration, Orientation, and Draw of Lots will be held on Thursday 11 th November 2021 and the teams are requested that in all probability to kindly report latest by 9:00 AM at the Venue.
-
Preliminary Rounds will be held on Thursday 11th November 2021.
-
No two teams shall face each other more than once in the Preliminary Rounds. However, such teams may face each other in the Quarter Finals/ Semi-Finals/ Finals Rounds, subject to their qualification.
-
Speaker 1 and Speaker 2 to remain the same throughout the competition.
-
The top eight teams shall qualify for the Quarter Finals. The qualification to the Quarter finals

will be based on:

Based on the Total Aggregate Score in the preliminary rounds (Both Round).
-
The top eight teams with the higher aggregate scores in both preliminary rounds will qualify for the quarterfinal’s rounds.
-
The aggregate score of a team shall be computed as the total of Oral Scores of Speakers 1 and 2 of the Preliminary Rounds.
-
In case of a tie in scores, the team with a greater number of wins in preliminary rounds will qualify for the quarterfinal.
-
Further, in case of a tie in the scores as well as in the number of wins, memorial marks of two teams will be considered.
-
In the exceptional case of a tie in all the above qualifications of the teams will be based on the draw of lots/ by the toss of a coin.
-
The Best Speaker (male) and the Best Speaker (female) Award will be awarded based on the scores awarded to the individual speakers in the Preliminary Rounds.

Individual Aggregate Score shall be determined as the sum of the following: The Score of Speaker in Preliminary Round I, The Score of Speaker in Preliminary Round II

Teams will be provided with their opponent team’s memorials after the conclusion of the draw of lots.

Return of the other side’s memorial immediately after the preliminary round to the Court - clerks are compulsory
Quarter Final Rounds
The Quarter Final Rounds would also take place on Thursday 11th November 2021.

The teams will be provided their opponent’s memorial after the declaration of preliminary results and the draw of lots for the Quarter Final Rounds

Quarter Final Rounds will be knockout rounds.

Final Round
Time Scheme for Oral Rounds
At the commencement of each session the team shall notify the Court Clerk as to the division of time between the 2 speakers (including rebuttal/ sub-rebuttal) 10 minutes prior to the commencement of the Rounds.
Preliminary Rounds and Quarter Final Rounds
-
Each side shall get a maximum time of 30 minutes to present their arguments of which no Speaker shall be permitted to address the Court for more than 18 minutes.
-
The time limit is inclusive of the time for Rebuttal or Sur-rebuttal, respectively.
-
The maximum time for Rebuttal is 2 minutes and the maximum time for Sur-rebuttal is 1 minute.
-
Each speaker is required to speak for a minimum 12 minutes exclusive of time taken for Rebuttals and Sur-rebuttals.
Semi Final Rounds
-
Each side shall get a maximum time of 45 minutes to present their arguments of which no Speaker shall be permitted to address the Court for more than 25 minutes.
-
The time limit is inclusive of the time for Rebuttal or Sur-rebuttal, respectively.
-
The maximum time for Rebuttal is 5 minutes and the maximum time for Sub-rebuttal is 2 minutes.
-
Each speaker is required to speak for a minimum of 22 minutes exclusive of time taken for Rebuttals and Sur-rebuttals.
Final Round
Procedure and Marking of Court Rounds
-
Each team will get a total of 30 minutes to present its case. This includes the time for rebuttal and sur-rebuttal.
-
The division of time per speaker is left to the discretion of the team.
-
The arguments should be confined to the issues presented in the memorial.
-
The researcher needs to be present with the speakers during all the rounds.
-
The researcher is allowed to pass chits to the speaker during the rounds.
-
Decision of organising committee on every dispute raised shall be final.
-
Maximum scores for the court rounds will be 100 marks per speaker. The court rounds

The participants shall be in Formals inside the Court Room.

Anonymity
No coach or participant of any team at any time after the commencement of the competition, including during registration, during the continuation of the competition, and before its completion discloses the identity of his/her college or institution under any circumstance in any manner including, but not limited to, bearing any identifying items like clothing, ties, patches, pins, etc. containing the name or logo of the college or institution that the team is representing or disclosing the name of the team members to the Judges during the competition. In the event, any such disclosure is made, and this rule is violated, the team shall be severely penalized and this may involve disqualification. The penalty to be imposed shall be at the discretion of the organizing committee.
Scouting
No member of any participating team shall witness the arguments in any other court room in which the team is not participating. In the event this rule is violated, the team shall be severely penalized, and this may involve disqualification. The penalty to be imposed shall be at the discretion of the organizing committee

Accommodation, Food and Travel
Accommodation shall be provided by the Organizers from the afternoon of 10th November 2021 at University Hostels (Separate for Boys and Girls) free of cost and the team members shall have to pay the mess charges for November 10th, 2021. On the night of November 11th, 2021, free accommodation shall be provided by the organizers including all meals. The Accommodation for November 12th, 2021 shall not be provided by the organizers, however the Accommodation may be provided on the request of the teams based on nominal charges excluding meals at University Hostels (Separate for Boys and Girls). The Teams are advised to share their travel plans to the convenor in advance. No Transportation facility will be provided to the teams for their arrival and departure.
NOTE- If the Government does not permit, the University reserves all the rights to change the Event into Online mode from Offline mode. In addition, The University reserves all the rights to change the rules of the 2nd National Moot Court Competition 2021, if necessary.
