AIBE (All India Bar Examination)

The full form of the AIBE Exam is the All India Bar Examination (AIBE), also known as the All India Bar Council Exam. AIBE is a National level entrance examination conducted to assess the capability of an advocate who wants to practice law in India. The Bar Council of India (BCI) has the authority to conduct the All India Bar Examination (AIBE). The exam will be conducted in 11 languages and candidates will have to select any one language according to their preference. Candidates clearing AIBE 2022 will be awarded the "Certificate of Practice". The All India Bar Exam will be held in Pen & Paper mode as well as Computer Based Test (CBT) online mode and will be held on a Pan-India basis in almost all Indian states and cities across the country. It is an open-book exam. Each correct answer will increase the candidate's total score by one. Marks will not be deducted for wrong or unanswered questions. The inability to meet the eligibility criteria leads to the cancellation of the candidature. The various eligibility conditions are listed below: Educational Qualifications: To apply for the AIBE 2022 exam, candidates need to pass the LLB degree of 3 years or 5 years from an institute that is recognized by the BCI. There is no specified academic cutoff required to be able to appear for the exam. State Bar Council: The candidate must be enrolled in his/her respective State Bar Council. He/she should also possess the advocate enrollment card as issued by the council of the corresponding state. The candidates must submit suitable proof to enrol for the AIBE 2022 examination. Candidates are eligible to apply if they are enrolled as "an advocate under section 24 of the Advocates Act 1961". Age and Attempts Limit: There is no age limit to apply for the AIBE 2022 exam. There is also no cap on the number of attempts for this exam except that it should be attempted within 2 years after obtaining the law degree. Nationality: Only Citizens of India can apply for the AIBE 2022 exam. They must have also obtained their law degree in India. AIBE Exam Pattern According to AIBE guidelines, the AIBE exam pattern is such that the candidates will have 100 multiple-choice questions to answer. They will be given 1 mark for every correct answer, whereas no marks will be deducted for incorrect answers. AIBE 2022 exam will be conducted via offline mode i.e. pen and paper mode. The total time given to each candidate to attempt the exam is 3 hours and 30 minutes. The exam can be attempted in 11 languages, that include Assamese, Bengali, English, Gujarati, Hindi Kannada, Marathi, Oriya, Punjabi, Tamil, and Telugu. The exam will include 19 subjects of law. Depending upon the weightage, each subject is allotted a definite number of questions. Given below are the topics that are the basis for the question in the exam. Constitutional Law - The questions will be based on topics like human rights, judiciary, parliament, customary law, and international rules & law. Indian Penal Code - It is a comprehensive code intended to cover all substantive aspects of criminal law. Criminal Procedure Code - The paper will be based on questions related to Indian Criminal law and the Procedure of Law. Code of Civil Procedure - In this, questions will be asked on topics related to the Process of Judgement, Conduct of Trials, and how the clerks and court must function. Family Law - Questions will be related to domestic partnership, marriage, child custody, paternity, adoption, surrogacy, and juvenile law. Administrative Law - The body of the law that governs the activities of administrative agencies of the Government. Evidence Act - It contains a set of rules and allied issues governing the admissibility of evidence in the Indian court of law. Labour and Industrial Laws - Laws related to worker and employee, child labour and discrimination, and employment terms will be asked in this section. Cyber Law - Questions will be related to the internet, cybersecurity, software, computing, and electronic commerce. Corporate Law - It is the body of the law that governs the rights, relations, and conduct of persons, companies, organizations, and businesses. Indian Penal Code (IPC) - IPC is the main Indian Criminal Code and will be asked questions related to Public Tranquility, and also Criminal Conspiracy. Public Interest Litigation - It is a case that is directly filed by an individual or a group of people in the Supreme Court of India. Professional Ethics and Cases of Professional Misconduct under BCI Rules - The set of rules that govern the professional conduct of Advocates, arises out of the duty that they owe the court, the client, opponents and other advocates. Evidence Act - It is advised that test-takers go through the Evidence Act. Questions will be asked related to the Act of 1872. Environmental Law - It is the collection of laws and regulations, agreements and common law that governs how humans interact with their environment. Land Acquisition Act - An Act to amend the law for the acquisition of land for public purposes and companies. Intellectual Property Law - It deals with the rules for securing and enforcing legal rights to inventions, designs, and artistic works. Note - Candidates are advised to be thorough with the broader topics of the subjects mentioned above since it is an open-book test. AIBE Cut-Off Each year Bar Council of India (BCI) decides the cut-off marks for the AIBE exam. The candidates who score above the cutoff score will get the "Certificate Of Practice". The cutoff marks vary each year and are different for each category. It normally revolves around 40. How to qualify as a Solicitor in the UK: SQE for Indian lawyers

The Solicitors Qualifying Examination (SQE) has replaced the Qualified Lawyers Transfer Scheme (QLTS). Unlike the QLTS, the SQE is open to candidates from all jurisdictions – not just those recognised by the Solicitors Regulation Authority (SRA). Introducing a single, final, centralised qualification exam has also brought England and Wales in line with most other jurisdictions. If someone is looking to sit the SQE1 later in 2023 the next sitting after this will be on 20 and 24 July. What are the requirements for foreign lawyers to requalify in England and Wales? To requalify as solicitors in England and Wales, foreign lawyers need to: hold a legal professional qualification hold a degree in any subject or an equivalent qualification (such as an apprenticeship) or work experience complete two stages of assessment, SQE1 and SQE2, unless exempt satisfy the SRA’s character and suitability requirements Fully qualified foreign lawyers are exempt for any qualifying work experience (QWE) requirements. What is the structure of the new exam? The SQE is divided into two parts: SQE1 consists of two exams in multiple-choice question format SQE2 consists of a series of practical assessments of skills through written and oral examinations Find out more about the SQE structure How should I prepare? Candidates are not required to complete any preparatory courses before sitting the SQE, nor to have any specific university degree. Can I sit SQE1 outside England or Wales? Yes. You can sit SQE1 at a range of test centres internationally. Can I sit SQE2 outside England or Wales? SQE2 written assessments will be available at a range of test centres internationally. You'll need to sit SQE2 oral assessments in England and Wales over two and a half days. Am I eligible for exemptions? Lawyers qualified overseas can apply for exemption from the SQE on the basis of prior qualifications or experience. You may seek an exemption for one or more of the following parts of the SQE assessments: SQE1 Functioning Legal Knowledge 1 SQE1 Functioning Legal Knowledge 2 SQE2 You'll need to show that your professional qualification is equivalent to the whole part of that assessment. If exempt, you will not need to sit the corresponding SQE assessment(s) (see regulation 3.2 of the Authorisation of Individuals Regulations). If you're granted an exemption from SQE2, you may need to prove your English or Welsh language competence. Once an exemption is granted to a jurisdiction, lawyers qualified in that jurisdiction can apply to benefit from that agreed exemption. They do not have to sit any examination in order to requalify in England and Wales, and can apply for admission with the SRA directly, after completing a pre-screening process. From 1 September 2022, the SQE replaced the QLTS and is open to qualified lawyers from all jurisdictions. If you've already started the QLTS and passed the multiple-choice test, you have two options to complete the qualification. You can sit the: the second part of the QLTS – the Objective Structured Clinical Examination (OSCE), or SQE2 Sitting the OSCE The remaining sittings to complete the OSCE take place in: Candidates who have passed an OSCE (except the April 2022 sitting) You must apply for screening so we can assess your character and suitability to be a solicitor. You then have until 31 August 2022 (inclusive) to apply for admission. Candidates who passed the April 2022 OSCE You must apply for screening so we can assess your character and suitability. You will be able to apply for admission once you have completed your criminal record check. You will have until 31 January 2023 to do this provided you meet the conditions of our waiver. Eligible persons having a recognised law degree are admitted as advocates on the rolls of the state bar councils. The Advocates Act, 1961 empowers state bar councils to frame their own rules regarding enrollment of advocates. The Council’s enrollment committee may scrutinise a candidate’s application. Those admitted as advocates by any state bar council are eligible to take the All India Bar Examination which is conducted by the Bar Council of India. Passing the All India Bar Examination awards the state-enrolled advocate with a 'Certificate of Enrolment' which enables the state-enrolled advocate to practice law as an advocate in any High Court and lower court within the territory of India. Canada bar exam (NCA)

The NCA uses one standard of evaluation across the country. This means you can qualify to enter law society bar admissions programs in any Canadian common law jurisdiction by going through just one process. Who can apply All internationally trained legal graduates can apply, whether you are: a newcomer to Canada with a law degree a Canadian citizen who got a legal education in another country a legal graduate thinking of immigrating to Canada a Canadian civil law graduate You can apply from anywhere in the world – citizenship, nationality and where you live do not matter in the assessment process. The NCA does not assess the legal education and experience of people who want to practice civil law in Canada, or who want to become members of the Barreau du Québec or the Chambre des notaires du Québec. California Bar Exam

California Bar Examination The next California Bar Exam is scheduled for July 26–27, 2022. The exam will be administered primarily remotely online. Those approved for testing accommodations that cannot effectively be provided remotely and those with extenuating circumstances that prevent them from taking the exam online will be accommodated at limited in-person testing locations. Applications are now available in the Applicant Portal. The California Bar Examination is given twice each year. Failure to follow oral and written instructions while the exam is in session will result in notice to the State Bar's Committee of Bar Examiners of a violation of exam rules in accordance with the provisions of Title 4, Division 1, Chapter 6 of the Rules of the State Bar of California (Admissions Rules). Conduct that results in a violation of security or disrupts the administration of the exam, which includes, but is not limited to, bringing unauthorized items into the exam room (such as cell phones, notes, etc.), writing or typing after time has been called, looking at another applicant’s papers, talking while the exam is in session, being abusive to other applicants, staff, proctors and/or other exam personnel, will result in notice to the Committee of a violation of exam rules or, in some cases, dismissal from the exam test center. Applicants are expected at all times to maintain a professional attitude toward other applicants, staff, proctors and other exam personnel. Behavior that is disruptive will be reported to the Committee for whatever action it deems appropriate. Applicants cannot wear hats, caps, hoods or any other type of headwear during the exam. The Committee, however, will consider petitions filed by applicants seeking exemptions from the policy that would permit them to wear headwear due to their religious beliefs while in a secure exam test center. Such requests must be submitted on the Committee’s form, which is available in the "Forms" section of the State Bar website, and filed no later than the final deadline for filing testing accommodations petitions. Upon arrival at the test center, applicants must be prepared to show a letter from the Committee that permits them to bring the headwear into the exam room and the headwear may be subject to inspection. Applicants attempting to enter the test center wearing headwear who do not have a letter from the Committee authorizing them to do so will be issued a Chapter 6 Notice and will be asked to remove the headwear. Allowed items During the essay and Performance Test sessions of the California Bar Exam and the essay and multiple-choice sessions of the First-Year Law Students’ Exam, only the following items are allowed in the exam room without prior approval. All items are subject to inspection: The admittance ticket with no writing on it Nondigital pens (if you are handwriting the exam, you must bring your own pens with blue or black ink) Pencils (mechanical pencils are not allowed) Silent analog watches, non-digital timers and clocks measuring 4 inches by 4 inches or smaller Rulers Paper clips Pen-style highlighters (must not be used on answers) Inhalers Disability-related items that have been approved through the testing accommodations petition process Cash (must not have writing on it), credit/debit cards that might be needed for the lunch break (wallets may not be brought into the test center) Eyeglasses (no cases or sunglasses) Foam ear plugs (must not be connected) Feminine hygiene items Prescription medication Diabetes-related equipment (does not include food or drinks) Eye drops in single-use vials Government-issued photo ID Keys Back Support An Orthopedic cushion A standard-size pillow without a case One bookstand One foot rest Splints and braces Crutches Wheelchairs Casts Hearing aids TENS units Laptop accessories: separate keyboard, mouse (wired or wireless), laptop riser/stand no higher than 4 inches and solid color mouse pad with no writing on it (written sessions only) Start times Applicants using laptop computers must be seated no later than 8:20 a.m. All applicants must be seated no later than 8:30 a.m. The exam will begin immediately following the instructions. Applicants with disabilities granted accommodations to take the exam that include extended time may have different start times, which will be communicated in the Testing Accommodations Notice provided to such applicants in advance of administration of an exam. Late arrivals Applicants who arrive at the test center after one hour of testing has elapsed will not be permitted to enter the test center. Exam attendance policy If an applicant is absent for any portion of the exam, the applicant is considered as having not taken the exam; the applicant’s written answers will not be graded; if the applicant intends to take a future administration of the exam, they will be subject to the same application filing deadlines applicable to first-time applicants rather than the deadlines applicable to immediate repeaters. Applicants must make a good faith attempt to complete each portion of the exam for which they are present. An applicant’s attempt to circumvent security procedures may lead to voiding the applicant’s attendance at a session and the prohibition to attend any remaining exam session(s). Applicants taking the Attorneys’ Exam are excused from the Wednesday sessions and will not be allowed into the exam test center on Wednesday. Exam test centers Smoking is prohibited at test centers located in buildings that do not allow smoking in accordance with city ordinance. Applicants must select the test center in which they wish to take the exam. Only a limited number of applicants can be accommodated at each test center. Priority of assignment to the test centers will be based upon the date of receipt of complete applications. When the test center given first preference is full, the second choice or third choice will be assigned. If all three choices are full, applicants will be assigned to the closest available test center. Only those applicants with permanent disabilities who have previously been granted testing accommodations and who wish to request the exact same accommodations should select a testing accommodations test center (those with a code number starting with an “S”). Applicants must not select a testing accommodations test center unless they have been granted testing accommodations in the past for a permanent disability. If after filing the application form, applicants are granted testing accommodations, in most cases but not all, they will be assigned to a testing accommodations test center in the general area of their first choice. Notice of the test center to which they have been assigned will be forwarded with the letter advising them of the testing accommodations that have been granted. New York State Bar Exam

Bar Examination Effective with July 2016 bar examination, the New York bar examination consists of the Uniform Bar Examination (UBE). The UBE is a high quality, uniform battery of tests that are administered contemporaneously in every other jurisdiction that has adopted the UBE. The UBE is uniformly administered, graded and scored, and it results in a score that can then be transferred to other UBE jurisdictions. The UBE consists of the Multistate Bar Examination (MBE), the Multistate Performance Test (MPT), and the Multistate Essay Examination (MEE). An applicant must take all sections of the UBE concurrently in the same jurisdiction in order to earn a UBE score that may then be transferred to other UBE jurisdictions. The Uniform Bar Examination (UBE) is held each year on the last Tuesday and Wednesday of February and July. Application Deadlines A. General Rules The bar examination is administered on the last Tuesday and Wednesday of February and July. Applications must be filed during the month of November for a February examination and during the month of April for a July examination. An application is considered filed when it is filed electronically online and the application fee is paid. The application must be completed and the fee must be received during the application period for the application to be considered filed. There is no late application period. B. Special Rule for Re-Applicants For applicants who failed the immediately preceding administration of the New York State Bar Examination, the deadline for filing a re-application for the next offered bar examination is the later of (i) the application filing deadline set forth in Board Rule 6000.4(b) [which is April 30th for a July exam or November 30th for a February exam] or (ii) the 14th day following the date of the Board's release of the examination results. Re-applicants who did not complete both days of the immediately preceding examination must file their application by April 30 for a July exam or November 30 for a February exam. Prior to applying for the exam, you should carefully review the Rules pertaining tohow you will qualify to sit for the exam (Rule 520.3, 520.4, 520.5, 520.6 or 520.17), which can be found on the Board’s website, to confirm that you meet the eligibility requirements to sit for the examination. If you are not in compliance with any of these rules, and you commenced the study of law in the United States prior to April 1, 2012, the Saving Clause of Rule 520.1(b) provides that the rules which were in place when you began your law school study apply. Please contact the Board if you have any questions concerning your eligibility for the examination. The Board has no authority to waive any of the requirements of Rule 520. Payment of Fees A. Online Application The only acceptable form of payment is a Visa or MasterCard credit card. Debit cards are not accepted. The Board cannot accept credit card payment by mail or by phone. B. All Other Fees (see Board Rule Section 6000.14) If you are making any payment to the Board other than the online application fee, the only acceptable forms of payment are: certified check or cashier's check drawn on a U.S. bank in U.S. funds; U.S. Post Office money order; or a money order drawn on a U.S. bank or financial institution.
