Responsibilities

• Representing Cars24 to the Law and Enforcement bodies on the matters filed by and against Cars24 pertaining to his area of operation
• Identification of movable and immovable property on cases where the awards have been passed and require to file EP's
• Close monitoring in filing of Civil and Criminal matters before the various court in delinquent account post getting the approvals
• Co-ordinating with the law firms/lawyers towards progress of the litigated cases.
• Identification of best law firms & processing it for their empanelment to HO
• Coordination with govt authorities for service of Summons/BW/NBW/Attachment warrants.
• Close monitoring on execution of Court Receiver orders and other orders
• Close coordination with HO team in defense litigation to defend the case in various courts, forums & commissions by way of preparing the WS, Petitions, rejoinders and Writs.
• Conducting reviews of lawyers and team members periodically and sharing the review reports with the seniors as and when required.
• Provide assistance, advice and guidance to the State Heads, Area Managers and the Field collections team
• Effective Management of Cases against Company, Directors & Employees to mitigate risks and cost by preventing any adverse order imposing compensation & damages.
• Initiating proactive cases against defaulting customers for recovery of dues by attachment & sale of property and also by enforcing imprisonment.
• Speedy disposal of assets held in legal complications thereby enhancing the revenue and profitability of the company.
• Handling the database of live legal cases & preparation of various reports for the higher management like contingent liability statement, legal recovery statement, monthly projections for legal recovery, cost benefit analysis etc.
• Engagement of lawyers and solicitor firms, giving proper instructions to lawyers, holding conferences with senior counsels & attending Courts.
• Drafting & vetting of pleadings and applications to be filed in Courts & Tribunals.
• Keeping updates about latest amendments and judgments of Supreme Court and High and apprising the legal team accordingly.
• Working along with external recovery teams on recovering of dues from Loss on sale, Write off, and Early skipped chronic cases through legal intervention
• Keeping a track on the progress of all the cases filed by the company in the region
• Ensuring timely circulation of legal MIS on all “FOR and AGAINST cases
• Planning and Conducting Lok Adalats and Conciliation camp in the region
• Executions of the retrieved summons/BW/NBW/Notices/Attachment Warrants through administrative/court authorities.
• Visit to the delinquent customer to serve the legal tools as well as with the collection team as & when required, involved in negotiations for settlement with borrowers.
• To defend Criminal Proceedings (Police Complaints, Criminal Complaints & FIR) initiated against TMFL employees by the customers and take it to the logical conclusions.
• Appearance before the various forums/courts where cases has been initiated against the Company e.g. Consumer, Civil, Criminal, Arbitrations and writ jurisdiction cases.
• Representing Company in various courts and government Authorities being attorney holder.
• Coordinating with external lawyers/law firms and internal business functions.
• Close coordination with lawyers for daily cases as well as ensure to proceed the cases at next level
• To achieve recovery targets in LOS/Write off/Early Skipped cases
