Job Description:
Responsibilities
- Scrutiny/ Review all legal transactions regarding the property proposed/intended to be purchased/developed by the company either owned or offered for development by third party and attending all discussions and ensuring the receipt of all documents and clarifications for the purposes.
- Preparing note on title of the property proposed to be acquired in any manner.
- Drafting of all kinds of deeds & documents such as Letter of Intents, Memorandum of Understanding/Agreements, Sale Agreements, Sale Deeds, Joint Development/Joint Venture Agreements, Lease Agreement/Deeds, Power of Attorney for the acquisition/development of finalized property.
- Arranging the documents for briefing the external counsels, as instructed by the management either for title scrutiny / for documentations as well as perusing/reviewing all the drafts and carrying out such corrections, as may be required for the closure of the same to the true intents.
- Preparing all paper works as may be required for submission into the various departments as may be required for the plan sanction and other approvals/permissions and coordinating with the external agencies/in house team, as the case may be.
- Appearing and providing clarifications to the various departments on the title and other issues relating to the property for the purpose of getting various sanctions and approvals.
- Arranging all the documents, coordinating and submission of applications and documents for the project approved by the RERA and Banks/Financial institutions under the housing loan schemes and providing all documents/clarifications as may be requisitioned.
- Drafting of all forms, sale agreements, sale deeds, maintenance agreements or such other documents intended to be executed with prospective purchasers/investors as may be required in respect of the projects under development/to be developed and for the sale of units in co-ordination with the legal and sales team.
- Attend to the queries of customers/their counsels and providing clarifications / documents and coordinating the same and ensuring smooth functioning of customer relations.
- Arranging/obtaining all documents from various authorities/departments as may be required from time to time including updating the project documents.
- Drafting/reviewing of contracts and work orders relating to the civil execution of projects and operational documents of hospitality business.
- Updating the court diary on regular basis and follow up on the litigations filed by or against the company and follow up with respective advocates as may be instructed on one-to-one basis. Providing required papers and briefs to the external counsels engaged by the Company in all the ongoing/proposed litigations and scheduling the meetings, discussions with counsels on the subject, perusing the drafts of various petitions/applications/objections/affidavit/ Statements etc. and providing suggestions/amendments thereon to the respective advocates.
- Appearing before the Quasi Judiciary Authorities such as Tahasildar, Assistant Commissioner, Deputy Commissioner, District Registrar and representing the Company in all the matters relating the company/its properties on need basis.
- Drafting of appropriate Affidavits, Applications, objections or any other letters, declarations, as may be required and filing with such authorities after the same being approved by the management.
- Co-ordinating with other departments such as finance and accounts, projects, marketing and providing requisite property related documents and ensuring full support to the other functionaries in all legal matters relating to the business of the group.
- Updating the management on the various policies, procedures and on any significant changes to applicable laws, regulations and codes as well as stamping and registration of the document and ensure that the company complies with all relevant laws, regulations and codes in accordance with the company policies.
- Ensuring the translation of the documents/Government Orders/Circulars etc., from Kannada to English language and making synopsis thereof relating to the legal and real estate matters including company’s business activities and filing the copies for reference.
Qualification & Experience
- Minimum of 5-7 years of experience in property title scrutiny and real estate documentation;
- At least 2 -3 years of litigation experience;
- Candidate must have knowledge of Kannada with read/write/translation.
- Exposure/experience to the registration and liasoning at RERA, SRO, BBMP/BDA/DC/Tahsildar etc – advantageous;
- Candidate without any restrictions on outstation travel is preferred.
