The Last Date to Apply is March 20, 2022.   About the Program Disputes are inevitable in society, which requires a robust dispute resolution mechanism to deliver justice. The Indian dispute resolution mechanism consists of Courts, Tribunals, and Alternative Dispute Resolution tools (including Arbitration, Mediation, Conciliation, Lok Adalats, etc.). Alternative Dispute Resolution (ADR) mechanisms have been demonstrated to be effective compared to litigation because the former provide the advantage of speedy disposal of the disputes and assists in restoring relations between the disputants. Over the last two decades, there has been momentum to encourage their usage among the legal fraternity and businesses - domestic or international. The notification of the Bar Council of India to introduce Mediation a compulsory subject in LL. B Courses, singing of the United Nations Convention on International Settlement Agreements Resulting from Mediation (Singapore Convention) by India, reforms in the Indian Arbitration Law to make India and Arbitral Friendly State’ are some of the few instances where we see the advancement of ADR practices in India. The programme will cover topics that are important for professionals in any field who deal with conflicts on a regular basis, as well as to academicians who aspire to deepen their knowledge. The Program faculty will include experienced practitioners and academicians who will supplement classroom learning with their own experiences and provide a comprehensive understanding of how arbitration and mediation work as dispute resolution mechanisms in domestic and international trade disputes.   Course Objectives To familiarise participants with the fundamentals of arbitration and mediation as a dispute resolution mechanism. Protection of animals is enshrined as a fundamental duty in the Indian Constitution and there exist several animal welfare legislations in India such as the Prevention of Cruelty to Animals Act, 1960 and the Wildlife Protection Act, 1972 at the Central level and cattle protection and cow slaughter prohibition legislation at the State levels. The Indian Penal Code (IPC) 1860 is the criminal code of India which covers all substantive aspects of criminal law. Section 428 and 429 of the IPC provide for the punishment of all acts of cruelty such as killing, poisoning, maiming, or rendering useless of animals. The aforementioned legislation has been enacted to obviate unnecessary pain and suffering of animals and similar legislations continue to be enacted according to changing circumstances. Unfortunately, recent events have shown that this phenomenon is becoming increasingly complex, especially with respect to some legal issues, such as: - The definition of combatants when terrorists are involved in the hostilities. - The detention by rebels of State armed forces. - The involvement and status of UN peacekeepers in armed conflicts. This course will help you understand these complex legal issues by teaching you the norms governing armed conflicts, also known as ‘International Humanitarian Law’ (‘IHL’).We will address these issues in light of recent practice, including the fight against ISIS and Al-Qaeda in different regions of the world, as well as other recent and older conflicts, such as those in Armenia, Afghanistan, Libya, Mali, and the Israeli-Palestinian one. The course will provide essential theoretical and practical knowledge for students, researchers and academics who wish to specialize in International Humanitarian Law as well as professionals, including members of NGOs, involved in armed conflict situations, or even members of armed forces. Historical Background and International Conventions Module 2: The Berne Convention: Principles, authorship and the notion of ‘works’ Module 3: The Berne Convention: Content of Protection:  Rights, Exceptions and Limitations Module 4: The Berne Convention: special types of works and situations Module 5: The TRIPS Agreement and the WIPO Copyright Treaty Module 6: Related rights Module 7: Sui generis regimes of protection, sui generis rights and unfair competition Module 8: The TRIPS Agreement and enforcement issues Module 9: Collective management of rights Module 10: Copyright on the Internet and other technological developments Module 11: The Marrakesh Treaty Module 12: Expressions of Folklore and Copyright Module 13: IP and Development: Flexibilities in Copyright Law   Final Exam Academic support is provided throughout each module by experienced tutors who are expert practitioners in the field of intellectual property.   Final Exam and Certificate There is a written final exam at the end of this course for which participants are required to compose written responses to a series of questions within a specified timeframe and submit their responses, via the eLearning platform, to their tutors for marking. Participants are individually contacted regarding modalities for accessing the final exam approximately one week prior to the deadline for completion of the DL-201 course.
