The course will engage with key themes in technology law and policy including data protection and privacy, platform governance, cybersecurity and information security, regulation of emerging technology, intellectual property, and competition law. Students will be exposed to current and proposed legislation on cyber laws in India and globally, global policy developments, comparative jurisprudence tracking the evolution of rights and emerging challenges and risks. This course will equip students with the necessary understanding and knowledge required to effectively navigate the rapidly evolving space of technology law and policy, and assess the contemporary developments.   Course Objectives and Learning Outcomes The course aims to ensure that students are: Equipped with a sound understanding of the theoretical concepts relevant to privacy and data protection, emerging technology, platform governance, cybersecurity and information security, intellectual property, and competition law Familiar with various domestic cyber laws, including laws associated with technology and information law and policy, intellectual property and competition law Conversant with global practices, and legal and regulatory frameworks governing data protection and privacy, emerging technology, platform governance, cybersecurity and information security, intellectual property, and competition law Conversant with the interaction between privacy and competition laws and the various regulatory approaches adopted by different countries Equipped to navigate the interaction between technology law and intellectual property law Familiar with the policy domain of cybersecurity and information security and understand their interaction with privacy Familiar with the challenges in data governance as well as platform regulation and their interaction with emerging technologies and the policy and legal approaches being developed to tackle these issues.   Course Duration and Structure The course will be conducted over a period of six months. The online contact classes for each of the six modules will be conducted regularly over the weekends every month. Students will be expected to undertake the readings, assignments and assessments through the course in accordance with the academic timeline.   Pedagogy The course has six modules. The entire course comprises of 120 hours of study including live online sessions, recorded lectures, asynchronous mentoring, self-study involving e-learning materials and readings, and assignments. Lectures will be conducted by leading academics, policy experts, industry stakeholders, and lawyers. Live online sessions for each module will be conducted over the weekends every month. E-Learning materials and readings will be shared before and during the course. Coursework related assessment, and exercises would be administered periodically and will contribute towards the cumulative assessment of the student. Our study will focus on the basics of transfer pricing: the 'arm's length principle', comparability and transfer pricing methods, but will also address business restructurings and include a case study.   Week 5: European Union law & fiscal state aid In this fifth module, we will take a look at the developments in the area of corporate tax planning within the EU, focusing on recent developments and the actions which have been taken within the EU to ensure that international tax planning of multinationals does not negatively affect corporate taxation within its territory. His stellar list of research and publications includes reputed national and international journals and over 16 books.   Dr. K.P Krishnan Dr. Krishnan is a retd. IAS officer (1983 batch) and has served in various field and secretariat positions in India in the Government of Karnataka and Government of India. How did Chinese families organize themselves and their landscapes in China’s past? How did African slaves from different cultures form communities in the Americas? What influences informed the creation and evolution of Broadway musicals? How can I understand or interpret 1,000 books all at once? How can I create a visualization that my students can interact with? The answers to these questions can be explored using a wide variety of digital tools, methods, and sources. As museums, libraries, archives and other institutions have digitized collections and artifacts, new tools and standards have been developed that turn those materials into machine-readable data. Optical Character Recognition (OCR) and the Text Encoding Initiative (TEI), for example, have enabled humanities researchers to process vast amounts of textual data. However, these advances are not limited just to text. Sound, images, and video have all been subject to these new forms of research. This course will show you how to manage the many aspects of digital humanities research and scholarship. You will also recognize under which circumstances the government has an interest in individuals' genomes in a criminal law context and review the basics of the CODIS STRs (Combined DNA Indexing System). WEEK 4: Forensic Genomics In this module, you will learn about how genomics is used to estimate ancestry and predict physical appearance or traits in criminal investigations, and review the current evidentiary standards for utilizing genetic evidence. You will also examine the scientific viability of using genomics to estimate phenotypic traits, understand the accuracy of genetic estimates for ancestry and phenotypic traits, review the current evidentiary standards under Frye and Daubert, and identify the best methods to utilize genomics evidence under current legal evidentiary standards. WEEK 5: Intellectual Property In this module, you will review the history, economic, and legal reasoning behind intellectual property protection.  You will then examine the basic requirements to obtain a patent, and identify which types of biological materials or processes are patent eligible using current case law.  Additionally, comparative intellectual property legal regimes will be introduced. WEEK 6: Genomics and Tort Law In this module, you will explore issues related to genomics that arise in Tort Law. You will examine some of the issues that can arise against medical practitioners as well as explore the implications of genomics in toxic tort cases. ISHR (International Service for Human Rights) is inviting applications for online course ‘Human Rights Defenders Advocacy Programme (HRDAP22) (of 2022).   About ISHR The International Service for Human Rights is an independent, non-profit organisation promoting and protecting human rights. Founded in 1984, ISHR has offices in Geneva (Switzerland) and New York (United States), as well as a permanent presence on Abidjan (Côte d’Ivoire). ISHR’s mission is to support human rights defenders, strengthen human rights systems, as well as lead and participate in coalitions for human rights change. ISHR Academy: ISHR Academy is ISHR’s e-learning space, helping human rights defenders strengthen their advocacy skills with the UN for greater impact on the ground. Their learning modules demystify the UN human rights system and build capacity to push for change.    About the Course ISHR conducts regular training courses on the use of the main human rights mechanisms, including the Human Rights Council, the UN Special Procedures, the UN Treaty Bodies and the Universal Periodic Review (UPR). The Human Rights Defenders Advocacy Program, (HRDAP) equips human rights defenders with the knowledge and skills to integrate the system into their existing work at the national level in a strategic manner. The programme also provides an opportunity for participants to engage in lobbying and advocacy activities at the UN with the aim to effect change back home. HRDAP22: Due to travel restrictions and changes in modalities of the UN Human Rights Council Sessions related to COVID-19, HRDAP22 will take place fully online, through a 12-week distance learning course and remote coaching and advocacy support, enabling participants to conduct advocacy and lobbying activities at the UN remotely.   Duration of the Course 12-Week Distance Learning Course: April 24 – June 24, 2022   General Details Platform: The HRDAP Platform, where you can access interactive learning materials including e-learning courses on each key UN human rights mechanism (the Human Rights Council; the Special Procedures; the Treaty Bodies; the Universal Periodic Review) and on advocacy and lobbying strategies Materials: Interactive learning materials and case studies on the ISHR Academy Mode of Sessions: Live Q&A sessions with human rights experts Tools & Resources: Other tools and resources to support defenders’ advocacy work   Key Deliverables of the Course ISHR will provide support and advocacy accompaniment to support defenders to engage (remotely or when possible, in-person) with key advocacy opportunities during the 50th session (June 2022) and the 51st session (September 2022) of the UN Human Rights Council. Such opportunities include (please note that this list is neither exclusive nor exhaustive): Reports by key Special Procedures mandates (UN experts) in the area of human rights defenders, including on the protection against violence and discrimination based on sexual orientation and gender identity; freedom of expression; summary executions; violence against women; contemporary forms of racism, racial discrimination, xenophobia and related intolerance and on the issue of human rights and transnational corporations and other business enterprises (HRC50). Discussion of human rights situations and reports by experts on Belarus (HRC50), the Occupied Palestinian Territory (HRC50) and by the Independent International fact-finding mission on Venezuela (HRC51). Discussion of human rights situations and reports or oral updates by the High Commissioner for Human Rights on the situation of human rights in Myanmar (HRC50) and on the situation of human rights in Ukraine (HRC51). Annual debates and resolutions on women’s rights, and in the area of environmental protection and climate justice, including on the adverse impact of climate change on the full and effective enjoyment of human rights (HRC50) and on the rights of indigenous peoples (HRC51).   Eligibility This programme is directed at experienced human rights defenders in non-governmental organisations, who have existing advocacy experience at the national level and some prior knowledge of the international human rights system. The applicants must possess the following to be eligible for signing-up for the course. There must be a match between applicants’ area of work/expertise and ISHR’s strategic priorities and/or the opportunities provided by the 50th and 51st Sessions of the Human Rights Council; Knowledge of human rights and their experience and willingness to engage with the UN human rights system and integrate it effectively into domestic level advocacy; Experience of carrying out advocacy at the national and/or regional level; Advocacy responsibilities and role within their organisation; Willingness to contribute to peer education in a diverse group of participants; Demonstrated commitment to the principles of human rights, including the principles of universality and non-discrimination; Communication, language and organisational skills; The potential for a strategic partnership between ISHR and the applicants’ organisation;   Course Requirements In order to complete HRDAP22, participants will be required to: Complete approximately 5 hours of work/week, which includes completing pre-reading resources, including ISHR Academy modules and pre-recorded webinars Take part actively and consistently in live webinars, Q&A sessions and forum discussions Attend and participate in individual and group coaching sessions, which will be held via videoconference Develop and submit a set of personal advocacy objectives by submitting short individual assignments every two weeks, as well as a final submission at the end of the course which will outline the defender’s “Advocacy Roadmap” (i.e theory of change).   Certificate Defenders will receive a certificate of completion on the condition that they participate actively throughout the course and submit their assignments on time.   Registration Fee ISHR relies on contributions from partner organisations and donors to be able to deliver HRDAP to a set number of participants. As HRDAP22 will be delivered entirely online, there will be no participation cost incurred by participants directly.   How to Apply? You will then explore case studies of how global businesses have used intellectual property law to generate enormous value from these intangible assets.   Course: 2 - Copyright Law Copyright law is unique in the greater intellectual property regime, as it protects original expression that is fixed in a tangible medium and is the product of authorship.  This course is designed for creative professionals — such as screenwriters, musicians, documentary filmmakers or artists — who want to understand the scope and limits of which works can enjoy U.S. copyright protection. The course will introduce students to the workings of copyright law through an examination of the system’s basic principles, rules, and institutions. But what exactly is trademark law, and how is such enormous value created? This course examines the fundamentals of U.S. trademark law and the ways in which the manufacturers of various products and services can establish and protect their identities and the identities of their products in the marketplace.   We will explore the purpose of trademark law, identify the different types of trademarks, including names, designs, logos, and trade dress, and explore strategies for choosing and protecting strong, potentially valuable trademarks. We will also discuss strategies for strengthening descriptive marks, and lay out the steps for filing for federal trademark protection. Finally, we will address how to design an ongoing maintenance strategy to protect, extend, and maximize the value of trademarks, and discuss strategies for responding to possible trademark infringement.   Course: 4 - Patent Law In our modern technologically-based economy, the creation and enforcement of patent rights can make or break a business. With record numbers of patents being issued every year, the stakes for inventors (and, indeed, their lawyers) continue to rise, even as the patent law and its administration faces growing criticism.  This course begins with an examination of the fundamental justifications for and creation of U.S. patent rights as well as the relationship between patent law and other “intellectual property” concepts. We will then delve into the details of the U.S. requirements for patentability, and explore the scope of patent rights, again considering how the policies expressed reflect the justifications for patent rights. Then we will look at an actual patent document and analyze the different pieces of an issued patent with a special focus on the importance of patent claims.
