About DSNLU Damodaram Sanjivayya National Law University (DSNLU), was established by the Government of Andhra Pradesh vide the DSNLU Act, 2008 in Visakhapatnam, to impart quality legal education.   About the Seminar On the Eve of the commemoration of 39 years of Bhopal Gas Tragedy, DSNLU presents you a National Seminar on Mass Torts and Industrial Disasters. It is important to stimulate scholarly debate of an overlooked trend that will reshape mass tort litigation in the upcoming decade. The search is on for new rules of law which would require those engaged in particular activities, especially hazardous ones, to bear collectively the operative cost including the distribution of losses consequent as a result of carrying on such activities. Chernobyl and Bhopal are not just significant events: they are dreaded words in the vocabulary of all industrial nations, words that mean that, technologically, the unthinkable can happen.   The objective of the Seminar To provide a platform for scholarly discussion on Cases involve war-time herbicides, defective medical devices, countless pharmaceutical cases involving staggering side effects, severe personal injury, and product liability disputes. To analyze the key features of many mass tort cases, with particular emphasis on the profile of modern mass tort cases that have sought bankruptcy protection. To explore the dimensions of new species of mass tort litigation has evolved over the last 10 years including those involving the opioid crisis, sexual abuse involving non-religious entities, and product liability with significant latent injury risks. To draft a Vizag Declaration on Mass Torts.   Eligibility The seminar is open for academicians, researchers, practitioners, professionals, interested learners and students.   Theme Mass Torts and Industrial Disasters   Sub-Themes Mass Torts in a World of Settlement. Characteristics of property damage mass tort – Global Perspectives. Toxic Torts – An Overview. Theories of liability related to both toxic products and environmental pollution. Theories of liability: land-based claims. Liability for “take-home” toxins – Perspectives from USA Regulation of hazardous releases into the environment. Theories of liability related to both toxic products and environmental pollution with specific reference to mass disasters. Simple property damage mass torts – Perspectives from Europe. Economic loss mass torts – Leading Cases. Limited personal injury mass torts without latent harm – A Contentious Issue. Complex personal injury mass torts. Submission Guidelines The full paper should be between 2,500 words to 5,000 words in length. It should be accompanied by an abstract of not more than 250 to 300 words. The upcoming Conference on International Trade and Global Energy Transition is being organized on the occasion of the completion of the successful ten years of the Centre.About The ConferenceThe issue of trade and the environment is being discussed since many years. Some writers have stated that increased trade leads to economic development, which in turn increases the capacity of people to care for the environment and spend on environmentally friendly products and services. On the other hand, critics contend that an increase in trade leads to an increase in production, transportation, and consumption, which has a damaging effect on the environment and is responsible for climate change. The economic basis of liberal trade policy is the idea of comparative advantage. Comparative advantage leads to abundance in production, which encourages increased consumption. Traditionally, the idea of ecological balance is based on self-restraint and consideration for the life and finite resources on the planet Earth. Therefore, theoretically, liberal trade and ecological balance have opposite objectives. That is why conservation policies have been mentioned as an exception to WTO requirements under the General Agreement on Tariffs and Trade (GATT) and under the General Agreement on Trade in Services (GATS). The challenge, therefore, is to increase compatibility between the two policies.Consumption of energy resources increases with the increase in trade. The increase in production and transportation results in increased consumption of energy. The world ha started a transition towards green energy resources, but fossil fuels are the main source of energy generation. Can trade policies help in the energy transition? The Conference is being organised to discuss this issueThe WTO norms are not very clear. Generally, WTO norms do not encourage protectionist policies. Decisions of the Dispute Settlement Body in cases such as US-Reformulated Gasoline, India-Solar Cells, and Canada-Feed in Tariff show that the WTO rules do not favour protection, even for the promotion of clean energy. A pertinent issue is whether the development of local industry for clean energy should be seen as a protectionist measure. Do some WTO norms, such as those relating to subsidies, require flexibility for the transition to clean energy? The Seminar aims to act as a catalyst for discussions on the key aspects of technology & law, its future trends, and impacts. It also seeks to gather inputs from a diverse range of stakeholders on legal issues relating to technology as well as to get a broader understanding of the developments of legal issues in this field in the past that will help generate a more holistic viewpoint about the existing concerns in the field of law and technology.   Call for Papers University Invites well-researched and unpublished research papers, case analysis, articles by Academicians, Policymakers, Journalists, Lawyers, Bureaucrats, Research scholars and Students. Research papers shall be subject to the approval of the Editorial Board for inclusion in the seminar. The Seminar calls for papers under the following sub-themes. However, the list is only indicative and not exhaustive.
