It is often observed that good policies may turn out to be a bad law because of the ambiguity or incorrect placement of words, thus precision in drafting a law gains importance. In this regard, ADR is one such creative approach which will help in achieving justice through securing faster and adequate justice for the masses so that the true meaning of justice is realized. A variety of disputes are amenable to mediation including commercial, contractual, business, corporate, employment, intellectual property, matrimonial disputes etc. Mediation as a mode of Alternative Dispute Resolution is playing a pivotal role in providing justice to common people. It is empowering common people in the society and imparting justice in a cost effective and expeditious manner. The thought that has necessitated for organizing such a conference is that the awareness of people regarding their rights has increased in recent times. Such increase has boosted the confidence of common man and enhanced his willingness to undertake litigation. Unfortunately, the infrastructure with the state has not increased commensurately resulting in backlog of cases. The increment and presence of backlogs have been causing an excruciating delay in the administration of justice. It was reported that millions of cases are pending in various courts across the country and India is facing unprecedented “litigation explosion”. As per the last census by Ministery of Law and justice the ratio of judges million 17.48%. However, a novel course of action is required as a remedy to this malaise which serves as a compliment to the traditional judicial system, there by helping to reduce the heavy burden of litigation and at the same time not compromising with the standards of equity, justice and good conscience. Mediation as an ADR mechanism is a process of resolving disputes with the help of a third neutral person who assists the parties at dispute to reach a negotiated resolution. It is voluntary, party centered and structured negotiation process in which a third neutral person assists the parties in amicably resolving their disputes. In a country like India, where the course of development is skewed and affecting each and every citizen, the demand for justice is increasing at greater pace given the fact that major chunk of our population still remains marginalized, deprived and destitute. However, the cost of litigation has risen exponentially, threatening these sections of society to claim what is their legitimate right. The concept of ADR is not new to India and has existed since ancient times. The tribes and villages in India are still pursuing such traditional methods of dispute resolution. Thus, mediation as a process of dispute resolution is not new to our nation, what is required in the changed social scenario is an effective adaptation of the traditional methodology to the new conditions. This calls for untiring efforts and devotion to be dutifully put into this process, right from its inception to its culmination into an effective practice. A recognized institution shall be entitled to send only one team to the competition, whether from the Undergraduate or Postgraduate law course, or a mixed team.   Team Composition The team composition, for the competition, shall comprise either two members (being designated as Speakers) OR three members (two of them shall be designated as Speakers and one as a Researcher). The Researcher may be permitted to argue as a Speaker in case of illness or any unforeseen event, but the permission of the Moot Court Committee in such case shall be mandatory. Once registered, a team will not be permitted to vary the composition of the team in any manner. Changes, if any, may only be made with the express permission of the Moot Court Committee (at their discretion), if due reason is shown for the same. Any changes with respect to the contact details shall be notified to the Organizing Committee with immediate effect. This obligation to inform shall continue throughout the course of the Competition.   Registration Each team shall provisionally register for the competition by sending an email to [email protected] before March 8, 2022. 40 teams will be allowed to participate in the Competition on a first-come-first-served basis. While filling the registration form, the teams must choose a primary contact person. All communications concerning the Moot will be sent by e-mail to the nominated contact person. The registration fee is non-refundable and must be paid by all teams. Upon receiving the intimation of selection, the registration fee as mentioned in clause shall be made by the teams latest by 12th March, 2022. All teams must upload a scanned copy/screenshot of the payment receipt containing transaction no. and date in the Google Form mailed to them.A Confirmation mail of Final registration shall be sent to the teams. Once a team is registered after filling in the registration form, a Team Code shall be assigned to it by the Moot Court Committee. The Moot Court Committee reserves the absolute discretion to refuse or cancel the registration of any team.   Awards The winner of the Final Round will be declared the “Winning Team”, while the losing finalists will be declared the “Runners-Up”. The Teams with the highest total Memorial score will be awarded the “Best Memorial” award. The speaker with the highest average score at the conclusion of the preliminary rounds will be adjudged the “Best Speaker”. The winning team of the national rounds would represent India in the Louis M. Brown and Forrest S. Mosten International Client Consultation Competition, 2022.   About the Competition The Louis M. Brown and Forrest S. Mosten International Client Consultation Competition is an annual competition for the winners of national rounds of the competitions across the world. The 2022 International competition will be held in Online Mode between 19th-24th April 2022 and hosted by the Hillary Clinton School of Law at Swansea University, Wales. This competition provides an exciting opportunity for law students to learn and practice interviewing and counselling skills as well as to meet participants from an amazing range of nations and cultures. Over the last ten years, law students from more than 30 countries have taken part in this competition like: Australia, China, Croatia, England and Wales, Germany, Hong Kong, India, New Zealand, Russia, Sri Lanka, Switzerland, and the United States etc. A Client Counselling Competition for law students was first established in 1969 by Louis M Brown. It was adopted by the American Bar Association in 1972 and the International Competition was inaugurated in 1985. The International Competition was named after Louis M Brown in 1993 and In May 2010, the competition's name was subtly changed from "client counseling" to "client consultation". The Competition is affiliated with the International Bar Association and collaborates closely with law societies and bar associations throughout the world.   About National Rounds of the Competition In National rounds, around 30-35 teams from leading law schools participate. There are two stages in the competition, viz. client interviewing and counselling; and post- interview and counselling stage, without client. The competition is judged on the basis of specific criteria like: establishing the working atmosphere and professional approach, suggesting alternatives, and allowing the client to make an informed choice, etc. The Competition simulates a law office consultation in which two law students, acting as lawyers (attorneys/solicitors/legal practitioners), are presented with a client matter. The participants conduct an interview with a person playing the role of the client. Participants are expected to elicit the relevant information from the client, explore with the client his or her preferred outcome, outline the nature of the problem, and present the client with a means (or range of alternatives, if appropriate) for resolving the problem. The interview with the client is then followed by a post- consultation period during which the participants, in the absence of the client, analyze the interview and discuss the legal and other work to be undertaken. The interview and post-consultation period last a total of 35 minutes. The participants are evaluated by a panel of judges. The participants are evaluated against specific criteria that emphasize the use of listening, questioning, planning, and analytical skills in a lawyer/client interview. Once the judges have completed their evaluation of the interview, the participants are called back in and the judges provide a brief critique of the team’s handling of the consultation and post-consultation periods.   Eligibility Only Law Colleges/Universities recognized by the Bar Council of India are eligible to participate. Only bonafide students pursuing LL.B. Three Year/Five Year Degree programmes in aforementioned institutions [refer 1.1], during the current academic year are eligible to participate. The premier law school was set up with a mission to pioneer legal education reforms, and to anchor the transformation of the Indian legal system through research and policy interventions. The National Law School of India University completed 32 years in 2020. The founding faculty and students of this University have created what is arguably the most successful University in India in this generation. We work to promote scholarship and interest in the fields of international law, international relations, and foreign policy.
