The Centre for Advanced Study in Criminal Law (CASCL) at RGNUL, Punjab is organizing an Essay Writing Competition, on the topic ‘Exploring Gender Justice: The Laws and the Lacunae’.   About RGNUL The Rajiv Gandhi National University of Law (RGNUL), Punjab, was established by the State Legislature of Punjab by passing the Rajiv Gandhi National University of Law, Punjab Act, 2006 (Punjab Act No. 12 of 2006). The University was accredited with ’A’ Grade by National Assessment and Accreditation Council (NAAC) in 2015   About CASCL RGNUL has established a Centre for Advanced Studies in Criminal Law (CASCL) to undertake: advanced study and research in the emerging areas of criminal law. The Centre aims to bring about reforms in the substantive and procedural criminal law in view of the modern crime scenario; development of sound criminal justice policy and practice: to generate respect for human rights and rule of law in the administration of criminal justice; training and technical assistance to agencies concerned with administration of criminal justice; renewal ef sentencing policies and correctional systems; revamping justice to the victims of crime, and legal aid and speedy disposal of the criminal cases.   Objectives The objectives of the Competition are to cultivate good reading and writing communication skills coupled with encouraging "passion for writing" and "creativity", a quality which every human being possesses, which is possibly hidden and may be unknown to the individual himself. The CASCL gives a platform to the young professionals to shawcase their characteristics that illuminate the good students and potentially great writers. This Essay Competition invites students to explore a wide range of challenging amd interesting questions beyond the confines of the college curriculum.   Eligibility Undergraduate and Post-Graduate Students from in the competition. Article 324 of the Constitution provides that the power of superintendence, direction, and control of elections to parliament, state legislatures, the office of the president of India, and the office of vice-president of India shall be vested in the election commission. Participants can choose any one of the following two topics: Topic 1: Legal Framework For Social Media Regulations During Elections With political parties, election contestants and stakeholders considerably digitalising their election campaigns and advertisements, a new trend has developed over the last decade. Consequently, there is immense scope to reimagine the traditional legal framework that regulates these aspects. Is there a necessity to create a new legal framework uniquely to monitor electoral activities on social media apart from the current rules that discipline print and broadcast media? What should be the nature of that alternate legal system for effective regulation of speech and expenditure by parties/candidates on social media which are powered by big data analytics and management teams? These questions can be addressed from the perspective of maintenance and promotion of electoral integrity in the digital space. Alternatively, essays can adopt a rights-based discourse to deal with them, as any regulation of campaigns and advertisements on social media will obviously prompt concerns about freedom of speech and constitutional sustainability. Additionally, legal issues surrounding the intermediary liability of social media companies in this structure could play a role in the discussions. Besides, potential practical challenges like enforcement of electoral silence periods for campaigns on social media and controlling publication of fake and unauthorised exit poll results before the polling finishes that any future legal framework must consider and pay attention could also be discussed. In fact, all these sub-themes could be studied comparatively to justify legal arguments and proposals. Topic 2: The ECI's Role In Protecting And Preserving Electoral Democracy This topic may be viewed from several perspectives. Essays could consider the ECI’s role in protecting the integrity of our electoral democracy. How can the ECI play a role in the decriminalisation of politics? What should be the road ahead for ensuring transparency in fundraising and regulating illegal and unregulated expenditures by political parties during elections?  Further, participants may discuss how the legal framework around the Model Code of Conduct could be reworked to ensure that ECI is able to effectively keep politicians and parties in check with regard to violations of the Code. This may be done apart from analysing whether the ECI should be conferred the power to deregister political parties for grievous violations of the rules, and principles of inner party democracy. Besides, one can assess how the ECI may enhance the democratic quotient of this electoral democracy. Essays on voting rights and facilities for NRI voters, diversification of voter education activities to improve voter turnouts, legal aspects concerning the integrity and verification of votes through EVMs, and prevention of voters’ exclusion from electoral rolls may fall under this wing. Additionally, contributions could also focus on addressing the ECI’s institutional independence as an aspect that may help the ECI to perform its role effectively.   Submission Procedure A participant can submit only one entry. The Centre for Criminology, Criminal Justice and Victimology (CCV) of RGNUL is organizing their 1st Legislation Drafting Competition 2021 on Victims of Crime (Rights, Protection & Assistance) Bill.   About RGNUL Rajiv Gandhi National University of Law (RGNUL), Punjab, was established by the State Legislature of Punjab by passing the Rajiv Gandhi National University of Law, Punjab Act, (Punjab Act No. 12 of 2006). The Act incorporated a University of Law of national stature in Punjab, thereby fulfilling the need for a Centre of Excellence in legal education in the modern eraof globalization and liberalization. The University has been ranked among the top 10 law schools in India in the National Institutional Ranking Framework (NIRF), by the Union Ministry of Human Resource Development, Government of India. The University has been adjudged as cleanest amongst Government residential universities in the category of Government institutionsin Swacch Campus Ranking, 2019 conducted by Ministry of Human Resource Development, Government of India   About the Centre for Criminology, Criminal Justice and Victimology, RGNUL (CCV-RGNUL) Keeping in view the broad policy of RGNUL to promote research in the field of law, the Centre for Criminology, Criminal Justice and Victimology (CCV) has been purposefully established under the able leadership of Prof. (Dr.) G.S. Bajpai, Vice-Chancellor, RGNUL, to providecritical and necessitated focus towards fostering the objective of carrying fundamental and applied research on the evolving aspects of transformative criminal justice system including the dimensions of victimology and criminology as particular areas of interest. The Centre understands and caters the progressive and dynamic nature of the developing criminal jurisprudence in India and across the world and therefore, firmly intends to conceptualize pro- victim research, training, policy analysis and consultancy with specifically prioritizing the aspect of interdisciplinary approach while fulfilling the desired goals. The Centre is uniquely determined to examine, express, elucidate and expedite the systematic delivery and efficient redressal of the rights of the victim within the comprehensive criminal justice system in India so as to mitigate the hardships faced by the victims.   About the Competition Rajiv Gandhi National University of law, Punjab’s Centre for Criminology, Criminal justice and Victimology (CCV) is hosting its 1st RGNUL-CCV Legislation Drafting Competition, 2021. This competition provides a platform where the best minds can come forward and critically utilize this opportunity of curating and drafting the legislative bills whereby experiencing the nuances of framing the law with the aim of encouraging the students towards the process of law making and governance. The objective of the competition is to provide a platform to the brilliant minds to undertake analytical research of laws related in different jurisdictions and to come up with intellectuallydriven provisions that can be implemented within the Indian framework. Legislative drafting helps individuals to enhance their knowledge, implementation and interpretation of the law and nurtures their ability to identify the current challenges in laws and suggest solutions. The competition seeks to provide a platform for the exchange of ideas and experience & invites law students and legal practitioners to draft legislations.   Topic for the Competition Participants have to draft a legislation titled “Victims of Crime (Rights, Protection & Assistance) Bill. As the scope of Victimology has been shifted from victim precipitation to protecting the rights of victim, there is a need for specific law in India that can comprehensively deals with the rights of victim. Time and again Supreme Court of India as well as Law Commission of India has recommended to have a particular legislation that can be implemented in an efficient manner that shall contribute to a having a victim sensitive criminal justice system so as to provide a mechanism where victims the safety of victim and its rights are protected and that victims is provided necessary assistance in all means. Through this competition, the Centre seeks to create awareness of having a proper legislation that is dedicated to promote and protect the rights and ensure proper safeguards to a victim. The Centre aims that through this competition, a solution can be found that can help in providing assistance and protection to the victims at every stage of investigation, trial, and post-trial within the Indian criminal justice system. Bill that is to be drafted should inculcate those aspects that particularly deal with the rights, protection and assistance of a victim and each of the provisions should cover the operational and the procedural part with elaborative details on the extent of the Bill to show which all crime victims are covered within its ambit. The Bill should also cover those provisions that the drafters find incidental or ancillary to the topic of the Bill and thinks that certain provisions should come under the main theme of the competition.   Eligibility The Competition is open to all law students pursuing LLM or LLB. (3-Year or 5-Year course from a recognized university within the territory of India).   Team Composition Participants may register as individual or in a team of two. There is no restriction on the number of entries from any college or university. Multiple teams can participate from a single university.   Format of Draft Legislation The Long Title The Preamble The Enacting Clause The Short Title Extent and Commencement Clause Definitions The Operative Section Procedural Provisions Penalties and Offences (if required) Provisions regarding Delegated Legislation (if any) Repealing and saving clauses (if any) Miscellaneous provisions   Submission Guidelines The Draft shall be in English language only. The Draft shall not exceed more than 25 pages, excluding the cover page. 2 marks shall be deducted as penalty for each page exceeding the page limit. The Draft should not reveal the identity of participants, in any manner whatsoever. For submission only the team code provided by organizers should be mentioned as mark of identity. Formatting – Font Style – Times New Roman, Font Size – 12, Line Spacing – 1.5, Alignment – Justified, Paragraph Spacing – 0 pt. before and after, Margin – One inch margin on all sides. The Content of the legislature drafted should be original and not plagiarized (15% limit) or there shall be deduction of 1 mark each for every percent or can lead to disqualification. The decision of organizers shall be final. Submission shall be made in .doc or .docx and .pdf formats. No other format would be considered and will directly lead to disqualification. Teams are requested to send their soft-copies on or before the provided date on the given subject matter only. JSS Law College in collaboration with Surana & Surana International Attorney, Chennai is organizing Moot Court and Judgement Writing Competition scheduled to be held on 12th to 14th November 2021.   About JSS Law College JSS Law College, a professional autonomous college functioning under the aegis of JSS Mahavidyapeetha, was established in the year 1982. The college has been recognized by UGC as a “College with Potential for Excellence”.    Aim & Purpose The Surana & Surana National Corporate Law Moot has been conceived with the aim of creating opportunities for learning the development of jurisprudence on emerging trends in Corporate Law besides developing cutting edge skills in research, writing and advocacy. The judgment1 writing competition will be a part of Surana & Surana National Corporate Law Moot Court Competition with the following principle and purpose: A Judgment has a social and civic function besides the primary principle of promoting Rule of Law & upholding justice. To achieve the above, it must “have clarity of thought, explain decision to the parties, communicate reasons for the decision to public and provide reason for an appeal court to consider”.2 To develop a well balanced judicious mind Prevent abuse of legal process (Full rules mentioned in Clause XVI)   Venue and Date The 19th Surana & Surana National Corporate Law Moot Court Competition shall be held virtually from 12-14 November 2021   Language The competition shall be in the English language.   Eligibility The competition is open for students who are studying LLB three year or five year course during the current academic year interested in Tax, Corporate and Commercial Laws and who belong to institutions that have been invited. Students of The Institute of Chartered Accounts of India & The Institute of Company Secretaries of India are also eligible to participate. Students who have completed their law/Company Secretary/ Chartered Accountant degrees/courses are not eligible.   Team Composition Each team should consist of a minimum of 2 and maximum of 3 members. This number cannot be modified under any circumstances. There shall be 2 speakers and 1 researcher designated for each team. The researcher shall be allowed to argue with prior permission of the court and National Administrator in case of illness of the designated speakers. Each team will be provided a team code during orientation. Teams should not disclose the identity of their institution; such disclosure shall invite penalties including disqualification. The decision for the same shall be at the discretion of the National Administrator. Member Swapping: For the Semi-final and the Final rounds teams shall be permitted to request participants from other teams to plead before the court on their behalf. That participant shall however still retain his/her individual code and shall address the court accordingly. In the event a team, which has exercised such an option, wins the competition that particular participant shall receive 1/4th of the prize money and a winning certificate from the organisers.   Registration Online registrations are open from 1st October 2021. The teams must register online by 28th October 2021. Teams will have to register online at www.moot.in. Only 50 teams will be registered to participate in the competition on first-come-first serve basis No temporary registration requests will be entertained. Kindly refrain from sending such requests to Surana & Surana or JSSLS. Participants will receive an automated system generated acknowledgement on successful submission of registration. Participants will receive an approval as acceptance of their request for participation latest by 30th October 2021 or earlier. The Registration form cum Approval letter as provided in the rules duly signed & sealed by your university / college / moot society An email communication from the official id ( to be filled as notification email id during online registration process) of the institution, from your university / college / moot society to complete the registration process. Note: Signatories on the registration form should be any of the following :- Facultyin-charge of MCA / MCS / MCC, Registrar, Dean, Principal, Director, Chancellor or Vice-Chancellor, Registration without the scanned copy of the approval letter / an email communication from the college/institution/university or duly attested registration form will not be valid. Soft copy of the registration and approval letter/ an email communication as a single PDF to be sent by email to: [email protected] marked as 19th SURANA & SURANA NATIONAL CORPORATE LAW MOOT COURT COMPETITION REGISTRATION as subject of the mail latest by 29th October 2021. The provisional team code shall be allotted to the registered teams by Host University soon after receiving of registration particulars In the event a team drops out of the competition or is disqualified the team next in line as per registration data (When the registration exceeds beyond the permitted 50 teams) will be offered the chance to participate in the competition at short notice. Such teams will have to submit memorials to be eligible at least 3 days prior to the start of the competition.   Rounds There will be two preliminary rounds of arguments, an octa final, a quarterfinal, a semi-final and a final round.Octa final will be conducted if the participation exceeds 30 teams. Quarter final will be conducted if the participation exceeds 16 teams   Results Results of the preliminary rounds shall be announced after the completion of rounds of all the teams. Similarly, the results of the Quarter-Final/Semi-Final Rounds shall be announced after completion of the rounds of all qualified teams of respective rounds. The results of the Final Round shall be announced during the Valedictory Ceremony.   Memorials The following requirements for memorials must be strictly followed. Non-conformities will be penalised: Each team must prepare memorials for both parties to the dispute (Petitioners and Respondent). Soft copy of the memorials in word format must be mailed to [email protected] and [email protected] . Late submission will be penalized by two points for each memorial for every hour of delay after due date. Subject to a maximum of 20 penalty points. Memorials will not be accepted beyond 1 day of delay. Once the memorials have been submitted, no revisions, supplements, or additions will be allowed. The memorials have to be submitted on typed A 4 size paper printed on one side and must contain: The table of contents The index of authorities The statement of jurisdiction The statement of facts (1 page only and argumentative statement of facts would attract penalties) The statement of issues The summary of arguments (not more than 1 page) The arguments advanced (not more than 15 pages) The prayer The font size should be 12 (doubles space) and for footnotes it should be 10 (single space) & double space between two foot notes. Uniform font size should be used throughout the memorial Footnoting to conform to The Bluebook: A uniform system of citation (20th edition) Non Compliance will result in a penalty of 1 mark per page. Substantive/ speaking footnotes are strictly prohibited. The memorial must have a margin measuring one inch on all sides of each page The page numbering should be on the top right side of each page. Covers must be placed on briefs as follows: Petitioner: Light Blue Color; Respondent: Light Red Color. The cover page of the memorial must state the following The cause title Identify brief as Petitioners / Applicant & / Respondents as is applicable Team Code(on the top right corner) Identity of the institution shall not be revealed anywhere in the memorial. Violation of this provision shall result in penalties including disqualification. The National Administrator’s decision shall be final. The teams may share a separate paper book (compendium) of not more than 50 pages, which will carry all the annexure and case laws that have been referred to in the memorial. The paper book will have a white cover. The teams may submit through screen sharing with judges or submitted during virtual registration before commencement of the Competition as advised by the organisers. Any identifying marks/seal of the college/university shall attract severe penalties including disqualification.   Oral Round Preliminary Round, Octafinals & Quarterfinals Each team will get a total of 30 minutes to present their case. This time will include rebuttal and sur-rebuttal time. The division of time is at the discretion of the team members, subject to a maximum of 15 minutes per speaker. Division of time shall be informed to the court officer before arguments begin. The oral arguments need not be confined to the issues presented in the memorials. Passing of notes to the speakers by the researcher during the rounds is allowed. It is however to be done discretely so as to not to disrupt the court proceedings The researcher shall sit with the speakers at the time of the orals. Semifinal & Final Each team will get 45 minutes to present their case that will include rebuttal and sur-rebuttal time The division of time is at the discretion of the team, with a maximum of 25 minutes per speaker. The oral arguments need not be confined to the issues presented in the memorials. The researcher shall sit with the speakers at the time of the orals.   Scouting Teams will not be allowed to observe the orals of any other teams. Scouting is strictly prohibited. Scouting by any of the team members shall result in disqualification.   Scoring Orals The parameters for judging the oral presentation on a scale of 0 – 100 points are: Knowledge of facts Logic and reasoning Organisation and clarity Persuasiveness Deference to the court Proper and articulate analysis of the issues arising out of facts Understanding of the legal principles directly applicable to the issues Ability to explain clearly the legal principles in general keeping to the time allotted Knowledge and use of legal sources and authorities and general principles of national law Ingenuity (ability to argue by analogy from related aspects of law) Written Submission (Memorials) The memorials shall be marked on a scale of 1-100 points each. Any revisions, supplements or additions to the memorials after submission shall attract severe penalties subject to the discretion of the National Administrator. Award of the points shall be based on the following parameters: Neatness, legibility, no typographical errors or format errors Logical progression of ideas Effective use of headings to outline arguments Understanding essential legal issues presented Focus on essential (not collateral) issues Clear, concise and unambiguous writing style Forceful and persuasive presentation Integration of facts into legal argument Understanding of strengths and weaknesses of case Discussion of viable alternative arguments Understanding and analysis of authority Proper use of citations and citation form Effective use of authority to support arguments Ability to distinguish adverse cases Non- compliance of the rules mentioned in Clause VII above shall attract severe penalties    Awards Winning team – Rs. 30000 Runner up team – Rs. 15000 Best Memorial – Rs. 10000 Best Student Advocate – Rs. 10000 Second Best Memorial – Rs. 5000 Second Best Student Advocate – Rs. 5000  In addition to the above awards, plaques and certificates are given to other categories of winners All participants will be awarded participation certificates.   Anonymity Student counsel may introduce her/himself to the court in the usual manner and may also state her/his names. However, the team's college / institution affiliation may not be mentioned at any time before the awards ceremony. Further, all team members, coaches, advisors, and observers shall refrain from identifying a team’s school at any time and in any manner, including, but not limited to, wearing any identifying items, such as school clothing, ties, patches, or pins or carrying identifying material (such as a books with a college logo, or college seal).   Video Recording The organisers will arrange for the video recording of only the finals of the competition. Teams that wish to obtain a copy of the recording may do so on payment of Rs. 750/- per copy The recording shall be sent to the college on payment of Rs. 750/- per copy in the form of a Demand Draft (DD only) drawn on a nationalized bank payable at Mysore in favor of The Principal, JSS Law College, Mysore.   Policy for Virtual Rounds The Oral Rounds for the competition will take place virtually via Google Meet platform. It would be the responsibility of every team to ensure a stable internet connection. The audio and video of every member of the team should be clear. Every team must ensure a proper background. The organisers will under no circumstances be obligated to provide the participants with any such facility. All participants should mandatorily join with their laptops or desktops and other forms of device are to be avoided. The link or the ID and password for the room on Google Meet will be conveyed to the participating teams before the oral rounds. Each participating member of every team is advised to install the Google Meet platform on their devices well in time. Each team is required to join the room at least twenty minutes before the scheduled time of commencement of the oral rounds. The participants’ camera and microphone shall be firmly positioned throughout the oral rounds so as to show speakers and to ensure their voices are clearly audible. All participants must keep their cameras on at all times during the rounds. Camera to be switched off in case of technical glitches with the permission of the bench. At the time when one participant is speaking, others are expected to keep their microphones on mute. In case a participant is found disturbing the other pleader anyway, he/she or the entire team to which such participant belongs may be disqualified upon the discretion of the bench. Each participant is responsible for finding a suitable venue and background to participate. The venue must be a quiet location and one which has adequate and reliable internet connectivity and has a desk and chairs for the oralist. Locations in open spaces or hallways or cybercafes or similar areas are NOT permitted. Participants are cautioned to ensure that all equipment has a power supply sufficient to last for at least two hours without interruption. In case of a loss in internet connection, each team will be given a reasonable time to reconnect. If the problem still persists the decision made by the organisers shall be final and binding. In the event where one or both of the speaker could not join due to connectivity issue, the team may be disqualified from the competition and at no circumstances can other member of the team be allowed to switch roles. Where a team does not appear within 10 minutes of the scheduled time for the round, the round shall proceed as ex-parte. Compendium & memorials shall be mailed to [email protected] with a copy to [email protected] along with the team competition codes on completion of the Orientation as directed by the organisers. Any compiled Research Material (Compendium) or other supplementary documents may be, as per the discretion of the bench, presented by the team by using the “screen sharing” option given they have fulfilled the preceding sub-clause. Participants will not be allowed to use the feature of personal chat on Google Meet to communicate with their team members or members of the opposing team. Teams shall not use internet or any other devices during the rounds for anything, except participating in the rounds. Participants can only sip water on screen during the competition. Consumption of other beverages or eatables is not permitted. Non-Speakers are to switch off video before drinking water. Participating speakers and researcher are permitted to join for the Virtual Competition from the same premises/room. However, the screen space shall be independent and the speakers, researcher to represent before the bench through individual/separate devices. Appropriate court room demeanor is to be maintained. This is mandatory. Participants are expected to cooperate with the organisers and the judges, in case anyone faces any issue. The organizers shall take best available measures to resolve or mitigate any connectivity issues that may arise. However, in cases where that is not possible, the organizer cannot be held responsible for the unforeseen issues which includes (but are not limited to) – Software failure and connectivity issues The decision of the Organizers in consultation with the judges shall be final and binding.   Rules of the National Judgment Writing Competition on Corporate Law The competition will be called “Surana & Surana National Judgment Writing Competition on Corporate Law”. This judgment writing competition will be a part of Surana & Surana National Corporate Law Moot Competition. Besides the rules given below all relevant rules of the National Corporate Law Moot rules are applicable. The teams participating in the Surana & Surana National Corporate Law Moot Court Competition. The structure of the judgment will reflect the forum / court in which the moot case is set and argued The participant team must compulsorily submit to the administrator a judgment arising out of the National Corporate Law case in M S Word format not exceeding 3000 words including footnotes, citations etc. The soft copy of the judgment must be submitted by way of email / CD / pen drive on 14th November 2021(Sunday) 10.00 a.m. A soft copy of the same must be forwarded to [email protected] with a copy to [email protected] Evaluation criteria (based on application of principle & objective): Format (All the steps of a judgment) Language and style (lucid expressions, brevity not at cost of clarity) Facts in brief Issues Application of law Ratio Decidendi Justification of decision Operative order Obiter dicta (the judge’s mind) Creative interpretation of citations, facts, law and innovative approach   Prizes and Certificates Winner: Rs. 25000/- Runner up: Rs. 15000/- 3rd and 4th best will be awarded certificates. They have developed a system of international labour standards aimed at promoting opportunities for women and men to obtain decent and productive work, in conditions of freedom, equity, security, and dignity.   About the Competition The Competition aims to recognize fair and balanced media reports that contribute to the elimination of public misperception, xenophobia and discrimination against migrant workers and highlight the positive contributions they make. This year, specific media coverage of the impact of COVID-19 on labour migration and fair recruitment, including contributions of migrant care workers, will be viewed favourably, as well as stories about migrant domestic workers to mark celebrate the 10 year anniversary of the ILO Domestic Workers Convention, 2011 (No. 189). The competition is open to both professional and student journalists. The Winner of the Test shall be determined based on the highest score attained Note: The Speakers of any team will not be allowed to sit in the Researcher test in any case.   General Rules for Oral Round The Researcher needs to be present with the speakers during all rounds. The Researcher shall not be permitted to address the Court during the Oral Rounds. The Researcher may, however, be permitted to pass notes to the Speakers at the discretion of the Judges. Such notes shall be passed through the court clerks present in the court room. Preliminary Rounds will be held on Thursday 11th November 2021. No two teams shall face each other more than once in the Preliminary Rounds. However, such teams may face each other in the Quarter Finals/ Semi-Finals/ Finals Rounds, subject to their qualification. Speaker 1 and Speaker 2 to remain the same throughout the competition. The top eight teams shall qualify for the Quarter Finals. The qualification to the Quarter finals will be based on: Based on the Total Aggregate Score in the preliminary rounds (Both Round). The top eight teams with the higher aggregate scores in both preliminary rounds will qualify for the quarterfinal’s rounds. The aggregate score of a team shall be computed as the total of Oral Scores of Speakers 1 and 2 of the Preliminary Rounds. In case of a tie in scores, the team with a greater number of wins in preliminary rounds will qualify for the quarterfinal. Further, in case of a tie in the scores as well as in the number of wins, memorial marks of two teams will be considered. In the exceptional case of a tie in all the above qualifications of the teams will be based on the draw of lots/ by the toss of a coin. The Best Speaker (male) and the Best Speaker (female) Award will be awarded based on the scores awarded to the individual speakers in the Preliminary Rounds. Preliminary Rounds and Quarter Final Rounds Each side shall get a maximum time of 30 minutes to present their arguments of which no Speaker shall be permitted to address the Court for more than 18 minutes. The time limit is inclusive of the time for Rebuttal or Sur-rebuttal, respectively. The maximum time for Rebuttal is 2 minutes and the maximum time for Sur-rebuttal is 1 minute. Each speaker is required to speak for a minimum 12 minutes exclusive of time taken for Rebuttals and Sur-rebuttals. Semi Final Rounds Each side shall get a maximum time of 45 minutes to present their arguments of which no Speaker shall be permitted to address the Court for more than 25 minutes. The time limit is inclusive of the time for Rebuttal or Sur-rebuttal, respectively. The maximum time for Rebuttal is 5 minutes and the maximum time for Sub-rebuttal is 2 minutes. Each speaker is required to speak for a minimum of 22 minutes exclusive of time taken for Rebuttals and Sur-rebuttals. Final Round The Maximum time for arguments per side shall be the same as in the Semi-finals. The winner of the Final Round shall be declared the Winner of the Competition   Procedure and Marking of Court Rounds Each team will get a total of 30 minutes to present its case. This includes the time for rebuttal and sur-rebuttal. The division of time per speaker is left to the discretion of the team. The arguments should be confined to the issues presented in the memorial. The Competition provides an opportunity for a valuable educational interchange between students, law teachers and legal practitioners. The Competition simulates a law office consultation in which two law students, acting as lawyers (attorneys/solicitors/legal practitioners), are presented with a client matter. The students conduct an interview with a person playing the role of the client. Students are expected to elicit the relevant information from the client, explore with the client his or her preferred outcome, outline the nature of the problem, and present the client with a means (or range of alternatives, if appropriate) for resolving the problem. The interview with the client is then followed by a post- consultation period during which the students, in the absence of the client, analyze the interview and discuss the legal and other work to be undertaken. The interview and post consultation period last a total of 30 minutes. The students are evaluated by a panel of judges. The students are evaluated against specific criteria that emphasize the use of listening, questioning, planning, and analytical skills in a lawyer/client interview. Once the judges have completed their evaluation of the interview, the students are to be called back in and the judges will provide a brief critique of the team's handling of the consultation and post-consultation periods   About the Previous Editions With the success of the 1st NCU National Client Consultation Competition, it climbed another ladder by organizing the 2nd, 3rd, 4th, 5th and 6th edition of its National Client Consultation Competition. The 6th Edition of National Client Consultation Competition, 2020 was the latest in the series of the annual event. Hon’ble Justice Darshan Singh, Retd. Judge, Punjab and Haryana High Court, and Chairperson, Haryana Real Estate Appellate Tribunal was our Chief Guest of the programme. 25 teams from all over the Country came down to participate in the event. After the preliminary round 12 teams made to Quarter-Finals, and 4 teams made it to the semi-finals from which ultimately 2 teams reached the final round. The 2 semi-finalists were from Symbiosis Law School, Hyderabad and Law Centre-II, Faculty of Law, University of Delhi. All the participants must be dressed in a dignified manner befitting the legal profession for the competition. Friendly and healthy interaction among the participating teams and with the students of the host college are encouraged and expected. Use of Mobile phones is strictly prohibited during the competition. Participants shall not reveal the identity of his/her college/university at any point of time during the competition. Participants shall not interact with the clients before the allotted time. The organizers at any point of time will not be responsible for any internet network/ connectivity issues during the competition. Scouting or any other unethical/unprofessional conduct is strictly prohibited, and may lead to disqualification.   Rules and Regulations The event will be conducted in four Rounds namely, Preliminary Round, Quarter Finals, Semi Final Round and Final Round. Preliminary Round will be conducted in two slots; each team will get only one chance to appear in the round. Top 25 teams will go to quarter finals; top 4 teams will go to the semi-final round and top 2 teams will go to Finals. In case of a tie for the 4th place, all the tied teams will be eligible to go to semi-finals. Top two teams from the semi-final rounds will go to the final round on the basis of team scores. The problems for the competition will be set from the area of Criminal Law, Constitutional Law, Civil Law, Corporate Law, Family Law and Contemporary Issues of Law. The organizers will select the clients to play the role as required by the problems.   Competition Procedure The teams will have a maximum of 30 minutes of which first 5 minutes will be allotted for settling the rooms for the clients, Teams can make use of all kinds of material befitting the legal profession for the competition while doing the same. 15 minutes will be for client interviewing and counselling. The remaining 10 minutes shall be for discussion between the participants and the judge. During the post interview period of 10 minutes when the client will not be there, the students will have to summarize the interview, analyze the problem and indicate the course of action to be undertaken to the judge. During this time the judges may also seek clarifications from the teams regarding their approach and analysis of the issues. During this period of 25 minutes, if necessary, the competing students can consult any books or laptop, which they may bring with them. Teams shall not exceed the allotted time but Judges can extend the same for another 2 minutes only after which there will be an automatic negative marking and 1 mark will be deducted for each extra minute. In the interviewing and Counselling stage as well as post interviewing and counselling stage, one member of the team will take the lead role and the other a supplementary role. There should be good coordination between the two team members throughout the 30 minutes period.   Judging Criteria The competition shall be judged on the basis of the following criteria: Establishing the working atmosphere and professional approach. The Bail Application and Argumentation competition experience will help the law students to develop the ability to identify the legal subject, arrange various law material, plead arguments, the nature of the judicial system of India and answering the questions raised by the other side. This Competition will develop an art which will follow the student for the rest of his professional life.   Rules, Procedures, Guidelines of the Competition The competition is open for students who are studying LL.B. three year or LL.B. five- year course. A minimum of one to maximum 3 teams per college shall be admissible. Team composition – Team of 2; 1 Speaker & 1 Researcher Clarifications regarding the bail problem will be submitted by 18th October. The Competition will be conducted through the online platform Zoom. All the teams should ensure they have strong internet connection along with proper audio and video facilities. Teams must make sure they don’t have any background disturbance from their end that can disrupt the smoothness of the competition. If the team members are facing any network issues, they must inform the organizing committee in order to get reasonable time to join in. The teams must keep their video on throughout the round and must be on mute unless it is their chance to speak. Team members must enter all the rounds with their team codes as their name. All the participants should appear in a formal dress code. The decision of the judge is final and binding. No challenge to the decision will be tolerated. At the time of submission of Essay the author is required to give an undertaking that the article/essay is his/her original work and has not been submitted, accepted or published elsewhere. Co-authorship is not allowed. The similarity index should be below 10%. Plagiarism will result in summary rejection of the submission. The length of the essay must not exceed 5000 words including endnotes. All submissions must be in English. Kerala Law Academy is conducting its 21st National Client Counselling Competition [Virtual] 2021, scheduled to be held from November 11th to 13th, 2021.   About the Client Consulting Competition Amidst COVID-19 pandemic, the prestigious 21st National Client Consulting Competition for Justice P. Govinda Menon Memorial Ever Rolling Trophy, hosted by the Kerala Law Academy will be held on virtual mode from 11th to 13 th of  November 2021 from the Kerala Law Academy Campus, Peroorkada, Thiruvananthapuram, Kerala. The Client Consulting Competition is intended to explore the client-lawyer interaction skills and to improve the problem analysing techniques of the students and giving such information which a client would like to know regarding his legal problem/case. Since its inception in 2013, the Competition has explored diverse issues in topics ranging from international trade laws to financial regulatory laws. Today, it has evolved into a nationally anticipated event. The list of the indicated sub-themes is given below to aid the participants: Invisible Labour & Labour Law Frameworks Invisible labour usually constitutes labour that goes unnoticed, unregulated, and unpaid. This may be in the form of informal sectors of the economy, domestic unpaid labour and sex workers. Lately, there have been attempts to define the term 'invisible labour' in the legal sense. Participants may try exploring whether there is a need to recognize new categories of labour force and if so, may present how the matter can be approached. In addition to scrutinizing existing labour law frameworks, participants may also try conducting comparative studies with other jurisdictions to highlight the best ways to protect the rights of those involved in invisible labour. The Four New Indian Labour Law Codes The Indian Government has recently consolidated 44 labour laws into 4 labour codes. These are the Code on Wages, the Code on Social Security, the Industrial Relations Code and the Occupational, Safety, Health and Working Conditions Code. These labour codes have already received a mixed response from experts in the field and are likely to have far-reaching implications once implemented. Participants may discuss the potential impact of the new labour codes on the creation of employment and the precarity of selfemployed workers. They may additionally compare the labour codes with labour laws of foreign jurisdictions. The Status of Gig Economy Workers in Global Labour Law Frameworks The gig economy refers to a segment of the labour market characterized by the prevalence of short-term contracts or freelance work as opposed to permanent jobs. The rise of the platform-driven gig economy has resulted in a type of relationship between employers and employees which has not been covered under most labour legislations. Participants may try exploring the nature of the relationship between gig economy workers and the companies that utilise their services. Additionally, participants may analyse the International Labour Organization's ("ILO") norms to determine what social security protections and rights the workers ought to be entitled to. Participants may also try exploring topics such as the impact of the COVID-19 pandemic on the gig economy at the national and global level. Accounting for Gender & Vulnerable Communities in the Workplace Participants may discuss the gender disparities in the labour market, especially in the wake of the COVID-19 pandemic. Additional research areas that may be explored include workplace harassment laws, maternity benefits, and the pay gap. Labour law regulations affecting vulnerable grups such as children may also serve as areas of interest. Further, participants may explore the unique position of inter-state labourers and transboundary labour to analyse whether a special framework needs to be made to accommodate their interests. Employment Law - Issues & Concerns A wide range of matters fall within the ambit of employment law. These include individual employment contracts, the application of contract laws, statutory regulations on issues such as the right to organize and negotiate collective bargaining agreements, protection from discrimination, wages, hours, and health and safety. In addition to these topics, the participants may discuss the legal position regarding employee data protection rights. Other areas of interest may include the legality of wage cuts, withheld salaries, and forced unpaid leaves during COVID-19 induced lockdowns. Note: The sub-themes are only indicative. Authors are free to deviate and explore other labour law sub-themes of their own choice.   Eligibility Authors must be pursuing their 5-year integrated LL.B. (Hons.) course / 3-year LL.B. course from any recognised university in India to be eligible to participate in the Competition.   Structure All entries will be judged and ranked by the Committee and Khaitan & Co. The top three entries will be selected for a virtual conference which shall be adjudged by a bench of 3 judges from Khaitan & Co. The final rankings of the authors will be determined on the basis of the paper presentation in the virtual conference. The participants may adopt any suitable means for presenting the papers including audio-visual aids, such as PowerPoint presentations. A participant is encouraged to think like a Judge and reach a well-reasoned and innovative conclusion to render a suitable Judgement. The participants are expected to base their judgments on a thorough and diligent appreciation of the factual matrix. The competition encourages innovative judgments that have meticulously examined and applied relevant legal concepts.   1st Online National Judgment Writing Competition Rule Book Definitions The following terms shall have the corresponding meanings unless otherwise specified: ‘Competition’ shall refer to ‘THE 1st Online National Judgment Writing Competition 2021’. ‘Competition Problem’ shall refer to the facts and issues released by the organizers of the Competition with its clarifications and corrections. ‘Competition Rules’ shall refer to the official rules of the Competition as may be amended from time to time. ‘IST’ shall refer to Indian Standard Time. ‘INR’ shall refer to Indian Rupee. ‘Organizing Committee’ (hereinafter to be referred to as O.C) shall refer to the committee responsible for the administration and conduct of the Competition. ‘Official Email’ shall refer to [email protected].   Eligibility The Participant should be currently pursuing their Bachelor’s Degree in Law i.e. 3 Years L.L.B. course or 5-Year Integrated law or LLM students from any recognized University/Law School.
