The National Webinar on International Women’s Day: “Debate on Marital Rape: A Constitutional Perspective” by the Faculty of Law, the University of Delhi on March 8, 2022. About the Organiser Campus Law Centre, Faculty of Law, University of Delhi: Campus Law Centre is the time-tested legal institution par excellence. It is the national hub of legal studies. Since its inception in 1924, the Department has been a leader producing many legal luminaries, supreme court and high court judges, leading advocates, political leaders, policy makers and trendsetters in all walks of life. About the Webinar The issue of marital rape in the contemporary Indian society has been a topic of intense debate and controversy. The sexual offence against the spouse is widespread than many realise, but it is yet to recognize as separate offence under section 375 of Indian Penal Code 1860. The law enforcement and judicial authorities are also reluctant to take cognizance of sexual assault against the spouse since accused is nobody but the life partner of the victim. It is also a challenging task to investigate, prosecute and launch judicial trial in spousal rape cases. The penal proposition with regard to rape law significantly exempt the sexual offence between spouses. The debate regarding marital rape resurfaced when many women approached the courts to seek remedy against the brutal sexual treatment in their matrimonial home and family life. The section 375 of the Indian Penal Code 1860 says that sexual acts by a man on a woman against her free will or consent would constitute rape. However, there are two exceptions to this. The first exception says that “a medical procedure or intervention shall not constitute rape”. As per the second exception, “sexual intercourse or sexual acts by a man with his own wife” when the wife is above 18 years of age would not constitute rape. It is this provision that is being constitutionally tested. While marital rape is not a criminal act in India, a woman could file a case under Protection of Women from Domestic Violence Act 2005 or provision of cruelty under Indian Penal Code, and could claim separation or divorce or seek punishment against her husband. A particular section of Indian society especially women activists want exemption provided in section 375 should be struck down due to its unconstitutional nature. Further, the exemption of section 375 also violates right to equality, right to life, dignity and self-esteem of women as guaranteed under the Constitution of India. Those who strongly advocates about the seriousness of marital rape and believe that it should be a punishable offence also highlights some anomalies in the law relating to cruelty where battering, physical and psychological torture against wife is a criminal offence but not raping her. In numerous judicial pronouncements the forced sexual relation between the spouses is a factor of divorce and punishment but this area has been completely ignored by the protagonists. Acknowledging the marital rape as a separate offence on the line of section 375 may also cause serious repercussions viz who will look after the children if husband imprisoned, what will be the status of women after conviction of her husband, whether she will go for divorce or maintenance. Some legitimate concern of the ruining of Indian family values, culture and future of the children can’t be ruled out as happened in the past with heavy misuse of Sec 498A of Indian Penal Code. The Ministry of Women and Child Development has indicated that marital rape is a serious issue and it should be addressed as per the Indian legal system. If marital rape declared as separate offence under the law, children will be the main victims of these laws. Moreover, if a wife is subject to sexual cruelty, then a civil remedy of divorce is available with her and since cruelty is already a criminal offence, what’s the need to bring in an extra category of crime at the time when people are already running away from marriage. Apart from that many unanswered questions are also lining up about the socio-economic protection of wife, children, parents and other dependents of the husband. The issue of bodily autonomy is also there when we discuss about Article 21 of the Constitution and right to personal liberty also applies on married woman. Further, in 2018, while decriminalising adultery the court held that even marital relations are not exempted from constitutional scrutiny. The primary objective of the webinar to discuss and explore some avenues as how to address the marital rape conundrum and what are the challenges ahead if the law enacted. Prime focus of this webinar will be to analyse the possible consequences of the Court’s suggestions and their impact on Indian families. Team Composition The team composition, for the competition, shall comprise either two members (being designated as Speakers) OR three members (two of them shall be designated as Speakers and one as a Researcher). The Researcher may be permitted to argue as a Speaker in case of illness or any unforeseen event, but the permission of the Moot Court Committee in such case shall be mandatory. Once registered, a team will not be permitted to vary the composition of the team in any manner. Changes, if any, may only be made with the express permission of the Moot Court Committee (at their discretion), if due reason is shown for the same. Any changes with respect to the contact details shall be notified to the Organizing Committee with immediate effect. This obligation to inform shall continue throughout the course of the Competition. The Virtual Conference on ‘Policing in India: Contemporary Issues, Challenges, and way Forward’ is organized by MMM’s Shankarrao Chavan Law College, Pune from April 7-9, 2022. The present International Conference is another step in the same direction. Theme of the Conference Police are a crucial component of Criminal Justice. As well-defined by Professor Francis Pakes, “Police refers to the specialized body of people who carry out the organized forms of order maintenance, peacekeeping, rule of law enforcement, crime investigation and prevention, and other forms of investigation and associated information brokering….” Amongst all the functions, the task of investigation is the most crucial, as it has an impact on the accused and society at large. The process of investigation is the bedrock of the Criminal Justice System and it is, therefore, the most crucial component to run the Criminal Justice System. The investigation is generally entrusted to state agencies in India. It has been provided in Schedule VII, List II, State List, Entry 2 of the Constitution of India. However, the Central Government, by its powers under Schedule VII List I, Union List has created specialized investigative agencies. Indian Police System is largely based on the Police Act of 1861, which has a colonial legacy. This law was passed by Britishers on the background of the First War of Independence of 1857 to protect their imperial, colonial and commercial interests. We are not ready to change the outdated laws and colonial outlook after 75 years of Independence. Even today, police are addressed as police force instead of being addressed as police service. An Indian citizen feels that there is no police commitment to his/her basic human rights according to the law of the land. The work culture of police is such that they are less bothered about the protection of Constitutional Values like equality, secularism, rule of law and more concerned about their political masters. The Police are not trained professionally for the investigation. The system carries many lacunas like lack of expert knowledge, lack of accountability & suitable work- culture and most importantly in-house machinery which will prevent the illegitimate pressure from the outsider. Now in these days, internal security is not only a base for national growth but also is linked with national security because organized crime operates in a borderless world. Terrorism, naxalism, economic frauds, violence against weaker & protection of interests of minority sections of society are some of the challenges before the police. The unholy coalition between some of the communal leaders, criminal gangs, police, bureaucracy & politicians are challenging the democratic process of the nation. These are the contemporary issues primarily discussed at this international conference. He was also taught the importance of keeping fasts. The deaths of his younger sister and his uncle from cholera caused Dayananda to ponder the meaning of life and death. He began asking questions that worried his parents. He was engaged in his early teens, but he decided marriage was not for him and ran away from home in 1846. About the Competition After the success of the last 6th National Moot Court Competitions, our Team Vidhigyaan is organizing the 7th National Moot Court Competition in an online mode; comprising of the National Moot Court Competition along with Client Counselling Competition this year which is an attempt to offer students with fair opportunities of learning as it serves as a concurrence of the academic appraisal with pragmatic sensibility. Eligibility The Competition shall be open for the students who duly enrolled and are pursuing an integrated 5 years or 3 years Law Program in India from an institution recognized by the Bar Council of India in the academic year 2021-22. Team Composition Each college shall send only one team which shall comprise of Minimum Two and Maximum Three members. This number cannot be modified under any circumstances. Each team which consists of three members shall comprise of Two Mooters and One Researcher (Moot Court Competition) and each team shall participate in all the events as per prescribed compositions compulsorily. Each team should identify such speakers and researcher at the time of their registration for the Moot Court Competition. During the Moot Court Competition the researcher won’t be required nor allowed to speak except under special cases and only with express permission of the organizers/Judges. If a team consists of Two Members, then both of them shall be mooters only and they will require participating in all the events of the competition. For Client Counselling Competition, no more than 2 (two) members of a team shall participate. If a Team consists of more than 2 (two) members then they shall have the liberty to allow any 2 (two) or 1 (one) of their team members to participate for the Client Counselling Competition who shall be represented only by the Team Code assigned. Each team will be given a unique team code which will thereafter be the identity of the team and its members. During the course of the competition, the identity of the college must not be disclosed to the judges or to any other person. Any such disclosure shall lead to disqualification. The decision for the same shall be at the discretion of the organizers. The 9th Mahamana Malaviya National Moot Court Competition 2022 is organized by Banaras Hindu University, Varanasi. About Banaras Hindu University Banaras Hindu University is an internationally reputed temple of learning, situated in COMPETITION 2020 the holy city of Varanasi. This creative and innovative university was founded by the great nationalist leader, Pandit Madan Mohan Malviya, in 1916 with the cooperation of great personalities like Dr Annie Besant, who perceived it as the University of India. Banaras Hindu University was created under the Parliamentary Legislation - The B.H.U. Act 1915. The Faculty of Law, BHU has a hundred-year-old history which is incomparable to any traditional institution in this country. This fine law institution has produced great legal luminaries in the past and continues to produce the world's greatest minds to serve in the legal field. About the Competition This is the 9th edition of the prestigious Mahamana Malaviya National Moot Court Competition organized by the Faculty of Law, Banaras Hindu University, Varanasi. The moot proposition dealt with Dispute Resolution and Arbitration. The multiple rounds of the event were judged by eminent professors, lawyers and judges. The final round was judged by Vibhu Bakhru J., Pratibha M Singh, J and, Mr. Abhinav Bhushan. Eligibility Students pursuing either a 3-Year or a 5-Year LL.B. degree in the Academic Year 2021-22 at any recognized Law School/College/University in India are eligible to participate. Each participating University shall send only one team to the Competition. Team members must be bonafide students of the University they are representing. Once registered (after Final Registrations), a Team will not be permitted to vary their composition in any manner. 12th UPES Dr. Paras Diwan Memorial International “Energy Law” Moot Court Competition 2022

UPES School of Law is organizing the 12th UPES Dr. Paras Diwan Memorial International “Energy Law” Moot Court Competition from April 15-17, 2022. About UPES School of Law UPES, Dehradun, founded in 2003, is one of the top-ranking universities in India which offers multiple courses and specializations. With wide variety of constituent colleges including business, law, engineering and design, the University has expanded over the years. The University has been accredited with grade ‘A’ by the National Assessment and Accreditation Council, Government of India in year 2021 and strives to achieve more heights in the coming years. The School of Law, a wing of UPES, envisions an assemblage of specialist legal professionals, able to contribute to an increasingly diverse field wherein courses involve Energy Law, Corporate Law, Cyber law, Banking, Finances, and Intellectual Property Rights’ specialization. It has been ranked amongst the Top 25 Law Schools of India by the National Institutional Ranking Framework in 2021. About the Competition UPES School of Law has been successfully organizing the UPES Dr. Paras Diwan Memorial International ‘Energy Law’ Moot Court Competition with an aim of creating opportunities for learning and development of jurisprudence on emerging trends in Energy Law by budding professionals by developing cutting-edge skills in research, writing, and advocacy. The competition has sought to preserve and advance the legacy of Dr. Paras Diwan, an eminent Indian jurist and a stalwart in the field of law. Since its inception in 2011, the competition has grown by leaps and bounds and went international in 2015 and has furthered the banner of Energy Laws throughout the world. The competition sees participation from top law schools of India and abroad and is considered one of the most coveted moots of the country. In the light of the pandemic, the 12th edition will be held virtually this year. The platform for the competition is via virtual conference. Eligibility and Team Composition The Competition is open to all students, enrolled bona-fide at the time of the competition on a regular basis in an undergraduate law course or its equivalent conducted by any recognized Institution/College/University. A recognized Institution/College/University shall be entitled to send only one Team for the Competition. Each Team shall comprise of three members. Two members of the Team shall be designated as Orators and the third member shall be designated as the Researcher. Any additional member or Team Coach accompanying a Team shall not be recognized and will not be entitled to a certificate from the OC. Registration Each Team must register by filling up the Registration Form available in ANNEXURE I of these Rules. Further, each team is required to also fill up the Google form as provided in Rules of the Competition. Each Team shall complete such registration on or before March 14, 2022 (11:59P.M. IST). Eligibility The Policy Drafting competition is open for all the students enrolled in 5-year or 3-year LL.B and LL.M programme. There is no cap on registration on number of teams from a college / University. A team shall be composed of two students only. Location Online/Virtual Submission Guidelines The language of the submission should be in English. The word limit of Policy Submission should be between 3000-4000 words, exclusive of footnotes. The draft shall not reveal the identity of the participants, whatsoever. For submission, a team code shall be given by organisers which shall be the mark of identity. The manuscripts must pertain to the field of intellectual property law or to related fields such as media and technology law. The deadline for submission for manuscripts is 27th March, 2022. The Journal subjects all articles to a review process by our student editors prior to publication. We also benefit from the guidance of our illustrious Board of Advisors who help the Journal attain its objectives. The Journal stands by the ideals of open access to scholarly works and it will be published online on an open-access platform for everyone to read and cite freely. Theme The manuscripts must pertain to the field of intellectual property law or related fields such as media and technology law. General Guidelines Manuscripts must conform to the scope and theme of the Journal of Intellectual Property Studies (‘the Journal’). The Journal is dedicated to publishing nationally and internationally relevant content relating to law and policy in intellectual property rights. This includes overlapping areas such as competition laws and technology laws. All submissions must primarily deal with these subject areas. All submitted manuscripts shall be original. Any form of plagiarism would lead to immediate rejection of the submission. Submitted manuscripts should not have been published previously. Once a manuscript has been selected for publication or has been published in the Journal, the author(s) must seek permission from the Editorial Board before publishing it elsewhere. Such permission may or may not be granted at the discretion of the Editorial Board. The author(s) must inform the Editorial Board if the manuscript has also been submitted to another journal, website or forum. The Editorial Board must be notified immediately if an offer for publication from another journal, website or forum is accepted by the author(s). The text and citation styles shall conform to the rules prescribed in The Bluebook: A Uniform System of Citation (20th edition). Manuscripts The body of the manuscripts shall not contain or disclose any information pertaining to the author’s name, affiliation or credentials. The Journal accepts the following kinds of submissions: Articles: Must extensively and holistically discuss the subject-matter (4000 up to 10,000 words). Articles must be accompanied by an abstract of 250-300 words. Case Comment: Critical analysis of significant case laws (up to 5,000 words). Case comments must be accompanied by an abstract of 150-200 words Legislative Comment: Comprehensive analysis of recent legislative developments (1000- 3000 words). Legislative comments must be accompanied by an abstract of 150-200 words. While authors are required to adhere to the prescribed word limits, departures from the same will be considered on a case-by-case basis. Submission Procedure The Journal accepts submissions on a rolling basis. Issues are published bi-annually in January and July respectively. Submissions must be made in Word Format (.doc)/(.docx) by filling the Google Form through this link.
