39th All India Moot Court Competition, Dr. Ambedkar Government Law College, Puducherry

Dr. Ambedkar Government Law College, Puducherry is organizing its 39th All India Moot Court Competition, on January 21-23, 2022. About the College Dr. Ambedkar Government Law College, Puducherry was established in the year 1972 by the Government of Puducherry and presently it is affiliated to Pondicherry University and approved by Bar Council India. Being a pioneering institution in India to conduct Moot Court Competitions, Dr. Ambedkar Government Law College, Puducherry frequently conducts national level moot court competitions every year on various themes with the objective to train the law students about the practical aspects of court procedure. During the competition, law students/participants are divided into teams and they are required to argue on a specific problem before a panel of Judges in the same manner as done in a Court of Law so that they can hone their advocating skills and prosper well in the legal profession. The best performers are given cash awards in the presence of Dignitaries. The Institution has been conducting National Moot Court Competition since its inception and so far conducted 45 National Level Moot Court Competitions including 5 Regional Language (Tamil) Moot Court Competitions and one All India Women Moot Court Competition exclusively for girls student. Date and Venue Date: 21-23 January, 2022 Venue: Dr. Ambedkar Government Law College, Mathur Road, Kalapet, Puducherry- 605014 Eligibility Participation is restricted to bona fide undergraduate students of 5 years/ 3 years LL.B. programme of any University/College/Institution (recognised by the Bar Council of India). Language The official language for the Moot Court Competition is English. Dress Code For Boys-Black Pants, White Shirt with Black Blazer. For Girls- Black Pants, White Shirt with Black Blazer or White Churidar Suits with Black Blazer or White Sari with White Blouse and Black Blazer. Team Composition Each Institution participating in the competition shall send only one team consisting of two Speakers and one Researcher. In any case, the team shall not consist of more than 3 participants. Their travelling expenses shall be borne by the respective participating Institution. Each team will have a team code. Teams shall not disclose their identity or that of their institution or city etc. Such disclosures will invite penalties including disqualification. The decision in this regard shall be at the discretion of the Organizing Committee. Registration Institutions those are interested in sending a team to participate in this Moot Court Competition are required to send an e-mail to draglc.pdy.mcs@gmail.com to provisionally register for the same. The last date for provisional registration is 27th December, 2021. A confirmation e-mail will be sent to the colleges who send in the provisional registration mails. The participating team must submit the hard copy of Registration Form along with DD and travel form on or before 6th January, 2022. The Registration Form along with the demand draft should be sent by post to The Principal, Dr. Ambedkar Government Law College, Mathur Road, Kalapet, Puducherry - 605014. Upon the receipt of the hard copy of the registration form, team codes of the participating teams will be sent via E-mail. After Registration, any request for change of name/ participants will not be entertained except at the sole discretion of the Moot Committee. Registration fee is Rs. 2500/- for each participating team, payable only by way of DD drawn in favor of The Principal, Dr. Ambedkar Government Law College, Puducherry, payable at Puducherry. Competition Rounds The Competition shall consist of Preliminary Rounds, Quarter-final Rounds, Semi-Final Rounds and Final Round. The top 8 teams from the preliminary rounds shall qualify to participate in the Quarter Finals. Winners of the Quarter-Finals will proceed to Semi- Finals. Winners in the Semi-finals will qualify for the Final Round. Teams shall argue cases against each other. For the said purpose, fixture of teams will be decided by draw of lots prior to each round of the competition commencing on 21st January, 2022 at Dr. Ambedkar Government Law College, Puducherry. About the Book The biodiversity rich North-East has always been on an enigmatic absence in the history of India. Objectives of the Competition The Client Counseling Competition promotes greater knowledge and interest among law students in the preventative law and counseling functions of law practice. It also encourages students to develop interviewing, planning, and analytical skills in the lawyer-client relationship in the law office. Interviewing and advising are a significant part of most lawyers’ work. Too often, it is assumed that lawyers have the listening and questioning skills needed to conduct an effective interview. The Competition provides an opportunity for a valuable educational and cultural interchange between students, law teachers, and legal practitioners. Nature of the Competition The Competition simulates a law office consultation in which two law students, acting as lawyers (attorneys/solicitors/legal practitioners), are presented with a client matter. The students are given a brief written memorandum that identifies the general nature of the subject-matter of the client’s problem (e.g., that a client wants advice about a problem arising from the construction of a house, that the client is facing a shoplifting charge, etc.) before the interviews are held. The students conduct an interview with a person playing the role of the client. Students are expected to elicit the relevant information from the client, explore with the client his or her preferred outcome, outline the nature of the problem, and present the client with a means (or range of alternatives, if appropriate) for resolving the problem. The interview with the client is then followed by a post-consultation period during which the students, in the absence of the client, analyze the interview and discuss the legal and other work to be undertaken. The students are evaluated against specific criteria that emphasize the use of listening, questioning, planning, and analytical skills in a lawyer/client interview. Once the judges have completed their evaluation of the interview, the students are called back in and the judges provide a brief critique of the team’s handling of the consultation and post-consultation periods. School of Business & Law, Navrachana University is conducting a National Opinion Writing Competition 2021 on Constitution Day. About the Competition Right to Life is one of the basic as well as fundamental right without which other rights cannot be enjoyed. But, if the person has a right to life, the question arises whether the same person can also exercise his right to die. Especially during the pandemic, we have noticed an enormous death doll in India during the second wave. Team Composition Each Team may consist either two members, comprising two speakers or three members, comprising two speakers and one researcher. Any alteration in the status of the team members, whether as a speaker or researcher, must be informed through mail to mootclub@iujharkhand.edu.in. If any team is willing to alter the team composition, can do so by intimating the organizing committee via e-mail ten days before the competition. Any such requests after the given time shall not be entertained except in case of unprecedented circumstances. The inability of any team member to participate in accordance with the rules of this Competition shall lead to immediate disqualification of the Team from the Competition. The timeline of the event is attached herein above. The Competition shall consist of the following Oral Pleading Sessions: The Preliminary Rounds, The Quarter Final Rounds, The Semi-Final Rounds, The Final Round The Teams participating in a Round will be provided with a soft copy of the opposing Team's Written Submission prior to the Oral Pleading Session. Technical Rules The Competition will be conducted using online live video conferencing platform. The details of the platform shall be shared with the teams via mail. To ensure the smooth functioning of the competition, in adherence to the rules of Social Distancing and Government Guidelines, all participants will participate from their respective places. Invitation link of the meetings including the link to join the courtroom shall be sent to participants on their respective Email IDs submitted by them in Registration Form and through WhatsApp prior to each round. The Participants are expected to be seated in a quiet space free from any echo and isolated from any form of disturbances. The Participants must make sure that the Background is plain and sober which does not disturb the judges. Preference will be given to a White background. The participants should make necessary preparations before entering the meeting room i.e., downloading the required Application and ensuring that their device is compliant to the terms mentioned. The participants should only use their team code as their username while joining the meeting room. All participants shall join at least five (5) minutes prior to the commencement of their round. In case any team fails to join the Court Room within five (5) minutes of its commencement, the opposite team shall proceed ex -parte. During the ongoing proceedings the participants must keep their video on throughout its duration. When a speaker is making his/her submissions, other participants shall keep their microphones on mute. In case a participant is found disturbing the other participant in any way, he/she may be disqualified. No additional documentation or screen sharing will be allowed and any information which has to be provided to the court should be submitted beforehand along with the Compendium and the Memorial. In case internet connection of Speaker 1 is lost or if that Speaker faces any other difficulty in connecting, a time limit of ten (10) minutes shall be given to that speaker to reconnect. After ten (10) minutes, Speaker 2 will take over to put forth his arguments. If Speaker 1 fails to reconnect, the team shall be marked on the basis of arguments put forth by Speaker 2 and Speaker 1 only if he has put forth any arguments before disconnection. The Organizers shall not be responsible for any loss due to slow or non - functional Internet Connection during the Competition. In any case whatsoever, the decision of the Organizing Committee shall be final and binding. Result The results shall be announced shortly after each round. The decision of the judges in the rounds shall be final. For all purposes and in any dispute, the decision of the Organizing Committee of the Competition shall be final and binding. The result of final round shall be announced at the valedictory ceremony, to be held on December 20th 2021. Awards Winning Team Award – The winning Team will receive a cash prize and each member will receive a Certificate of Achievement. About Gautam Buddha University Gautam Buddha University, established by the Uttar Pradesh Act (9) of 2002, commenced its first academic session at its 511 acres lush green campus at Greater Noida in August 2008. Moot Court Competition Guidelines Participation and Eligibility The Competition is open to all bona fide regular students enrolled in any undergraduate law course or its equivalent in any University or Institute within or outside India recognized by the Bar Council or State Government or Central Government as the case may be. Each team shall comprise three members i.e. two speakers and one researcher. A team may also be comprised of two members i.e. two speakers only. The composition of the team shall not be changed once a team has registered under any circumstances whatsoever. The members of the team must be designated as either ‘Speaker’ or ‘Researcher’ and such designation shall be conveyed to the Administrators at the time of registration. No researcher under any circumstances shall be allowed to present any arguments during the Oral Rounds. Changes in the aforementioned designations shall not be made without a request by the responsible Faculty in Charge or Head of the Institution or Department of the Team seeking such change, as the case may be. The discretion to allow or disallow such change shall solely rest with the administrators depending upon the reasonability of the cause shown, stage of the Competition, and compliance with the aforementioned rules. About the Webinar A print disability is a learning disability, a visual impairment or a physical disability due to which individuals with such disability cannot access print in the standard way. For them, a work is perceived by either visual or auditory (or both) senses. The persons with print disability find themselves at an absolute disadvantage with protected works perceivable only through print format. Individuals with cognitive disabilities express difficulty in processing complex information, requiring a transformation of material into more easily understood forms. The Marrakesh Treaty seeks to dismantle copyright barriers by requiring countries which ratify the Treaty to make an exception to domestic copyright law for visually impaired and print disabled people. Indian Copyright Law has adopted the similar provisions in 2012. There are many assistive technologies which helps people with disability to learn, communicate and function better. According to the “WIPO Technology Trends Report 2021: Assistive Technologies”, over 1 billion people currently need assistive technology - a figure expected to double in the next decade as populations age. However globally, only 1 in 10 people currently have access to the assistive products they need. The report shows that innovations, ranging from small improvements in existing products to cutting-edge developments in frontier technologies, can greatly improve the lives of persons with functional limitations. The Tech Trends report identified more than 130,000 patents related to conventional and emerging assistive technologies published between 1998 and mid-2020. Intellectual property has enabled the growth in innovation in assistive technologies. However, there is a requirement of making these technologies more inclusive. About the Webinar Bihar is a state which is the least developed as compared to other states of India. The condition of women in India is also not up to the mark since most of the population of Bihar population are belonging to Villages. If we see the health profile of this state, then we come to know that Bihar has the lowest health profile. There are various reasons behind it and pregnancy is also one of the reasons behind it. If we talk about the rights of women in the context of pregnancy in India there is no appropriate law for it. In about 70 years of Independence of India, women are working in many sectors parallel to the men. In the context of Reproductive Rights, judgments of Puttaswamy, recognize the constitutional right of the women which give freedom to make their reproductive choices. It is covered under Article 21 of the Indian Constitution (Justice K S Puttaswamy v Union of India 2012a: para 72, 2012b: para 46, 2012c: para 38). The bench also reiterated the position adopted by a three-judge bench in Suchita Srivastava v Chandigarh Administration (2009), which held that reproductive rights include a woman’s entitlement to carry a pregnancy to its full term, to give birth, and to subsequently raise children; and that these rights form part of a woman’s right to privacy, dignity, and bodily integrity. But things are very much different in reality. If we talk about life expectancy, it is higher in developed countries as compared to India. In India, we can see that the expectancy of females is not the same as the women of developed countries which indicate the poor health of women in India. This poor health might be due to different reasons and reproductive choice is one of them. One big issue of Indian society is that the choice of getting a son and these things are governed by the elder of the family. Such practices of getting a son as a baby are very common in northern India especially in Uttar Pradesh and Bihar. The Department of Laws, Panjab University is organizing its 1st Online National Moot Court Competition, scheduled to be held from December 11 to 12. About the Organiser The Department of Laws, Panjab University was originally established at Lahore in 1889, re- established at Shimla in 1948, and finally re-located at the University Campus at Chandigarh in 1959. IDIA ( Increasing Diversity by Increasing Access to Legal Education) Hyderabad Chapter is organizing a National Essay Writing Competition on various themes. They encompass a spectrum of civil, political, economic and social rights, ranging from the rights to health and life, to the rights to equality and non-discrimination, privacy, information, and to be free from torture or ill-treatment. In other words these rights include access to contraception, the right to a legal and safe abortion, the right to make decisions concerning reproduction free of discrimination, coercion and violence, the right to not be subject to harmful practices such as the coerced bearing of children (including with their spouse); and equal entitlement of LGBTQ persons to the same sexual and reproductive health services as all other groups The recognition of reproductive rights can be found in various international instruments such as the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW); the International Covenant on Civil and Political Rights (ICCPR); the International Covenant on Economic, Social and Cultural Rights (ICESCR); and the Convention on the Rights of the Child (CRC). India being a signatory to these instruments, owes an obligation to respect these rights in letter and spirit. Further in recent time we can find various judgments of constitutional courts which have provided the strong foundation for the recognition of reproductive rights of women. A decade ago the Supreme Court in the Suchita Srivastava V. Chandigarh Administration, 2009 (9) UJ 4151, upheld that woman’s right to make reproductive choices is a dimension of personal liberty as understood under Art. 21 of the Constitution of India and refused to recognize any restriction to curtail the right. Recently in Justice K S Puttaswamy v Union of India the Supreme Court has specifically recognised the constitutional right of women to make reproductive choices, as a part of personal liberty under Article 21 of the Indian Constitution. This judicial pronouncement as to women’s autonomy to take informed decisions regarding their own bodies, fertility, and reproduction is likely to impose variety of challenges specifically with respect to abortion, surrogacy and involuntary sexual intercourse within the marital relationship. The right to reproductive healthcare is one of the important facet of reproductive rights the enforcement of which is hampered by various issues including maternal mortality and morbidity, unsafe abortion and poor quality of post-abortion care, lack of access to the full range of contraceptive methods and reliance on coercive and substandard female sterilization, child marriage, and lack of information and education on reproductive and sexual health. Further the decriminalization of the same sex relationship is likely to lead demand of reproductive rights by those in such relationship. In this backdrop, the scrutiny of enforcement of reproductive rights by women in Indian society becomes utmost necessary for the holistic understanding of these rights. Health of citizens is a priority among the governments across the world. To improve the health, the governments of different countries have enacted and implemented various acts and policies which have made great impact on the health status of their citizens. With that intent, IMS Unison University invites legal practitioners, Professors, and scholars to contribute their viewpoint on issues and Laws concerning Health and medical, to promote awareness among the communities. Abstract The abstract must be developed on A4-sheet in Word Document Format typed in Times New Roman in 12 font size with 1.5 line spacing in not more than 500 words, it should not contain more than FIVE keywords. The abstract should contain personal details of the author(s) in the order: Title of the paper, Name, Designation, Institute/ University/ College/Organization, Contact number, E-mail and address (es), of the author(s). Kindly indicate the name of the main author for correspondence in case of more than one author. All abstracts will be peer reviewed and evaluated on the basis of originality, research rigor, relevance to the seminar, and contribution to the theory and practice. Submissions Submissions are to be made only in electronic form. The same may be e-mailed to nationalseminar.sol@gmail.com in MS Word format along with a covering letter addressed to Organizing Secretary. Title Must be written in bold, size 14 and centered margin. Margin Manuscripts must be in single spacing, font size 12 in Times New Roman and all margins: 1.5 inches (left) and 1 inch (top, right and bottom). Table Tables must be placed as part of the text. DO NOT attach tables at the end of the manuscript. Software Manuscript must be submitted in Microsoft Word 2007 in the above format ONLY. Sub-Title Written in bold, size 12 and left margin. Tables/Figures Title of the tables/figure should be w ritten on the top of the tables/figure.Times New Roman, font 12, Bold and centered margin. Footnoting Footnoting should be done strictly according to Bluebook 20th Edition, Times New Roman, Size 10, Line-Spacing 1.5 Word Limit Articles should be generally of 4000-4500 words (excluding references and footnotes). Rules for Participation No abstract or full paper shall be accepted after the last date of submission. Registration is mandatory on confirmation of acceptance of abstract, with the proof of payment of required fees in the bank account. Only registered participants will be allowed to take part in National Seminar. No refund will be allowed once a participant/paper presenter is registered. All the registered participants will be provided participation/paper presentation certificate. The Best Paper of each session will be acknowledged and awarded. In the event of the seminar being conducted in the offline mode the participants will be responsible for the arrangement of their personal accommodation. However, we will extend assistance in this regard. Breakfast and lunch to the participants will be provided by the university. Only one co-author is allowed. In-absentia presentations will not be allowed, at least one author must be present for presentation. Registration Fee Due to the current uncertainty of the COVID-19 situation, the mode of the National Seminar has not yet been finalized. If the circumstances permit the seminar will be conducted in offline mode, in the university campus. If unfavorable situations persist then the seminar will be conducted in online mode. The following are the registration fee for online and offline mode. Considering the COVID-19 situation at the time, the University will duly inform the participants regarding the preferred mode of the Seminar well in time.
