The Constitution has effectively withstood several challenges ever since its formation without budging an inch from its goal i.e. attainment of the entrenched democracy. Nonetheless, seventy years later, the performance of Parliamentary democracy in India calls for a serious review. Today, there exists a wide scope of issues and questions that necessitate extensive research and deliberation. The diversity of scholarly interest in Constitutional Law and Political Justice also reflects the interdisciplinary conversation that the field invites. A sincere and dedicated engagement on our part can go a long way in building for ourselves a secured future that would nurture a culture of democracy and efficient governance. The National Law University, Jodhpur is organizing a two day National Seminar on “Assessing India’s Performance as a Parliamentary Democracy”. The Seminar shall be held over a period of two days where esteemed speakers from across the world shall be discussing and deliberating on the key issues pertaining to parliamentary democracy in India. The event shall be organized on Cisco Webex Platform (ONLINE). Objectives of the Seminar The following are the objectives of this seminar: To understand the various dynamics of parliamentary democracy in India through the lens of the Constitution. To impart knowledge and create awareness regarding the interdisciplinary conversation of Constitutional Law and Political Justice. Encourage participants to engage in research on the niche area of Constitutional Law and Political Justice. To promote discourse on parliamentary processes and parliamentary history of India and encourage participants to develop an analytical perspective. Engage students and scholars in the academic developments on parliament, opposition rights and electoral reforms. Promote scholarship on parliamentary processes and representation for strengthening democratic institutions. The 4th Intellectual Property and Innovation Researchers of Asia (IPIRA) Conference, which will take place virtually from February 9 to 12, 2022. Interested candidates must submit their applications by December 10, 2021 About IPIRA The IP & Innovation Researchers of Asia (IPIRA) Network is an initiative aimed at providing a forum for teachers and researchers studying and writing on Intellectual Property (IP) and Innovation related topics in and beyond Asia. The activities of the IPIRA Network include: the organization of the Annual IP & Innovation Researchers Asia (IPIRA) Conference in collaboration with universities in Asia and beyond Asia, and international organizations, as well as the facilitation of workshops on topics of national and regional interest. About the Conference The IP & Innovation Researchers of Asia (IPIRA) Network is pleased to announce the Fourth IP & Innovation Researchers of Asia (IPIRA) Conference, which will be held on 9-12 February 2022. Due to the continuing challenges of the COVID-19 pandemic, the Fourth IPIRA Conference will again be held entirely ONLINE. Format and Time for Presentations The Fourth IPIRA Conference will feature a combination of plenary and parallel sessions. Presenters will have approximately 25 minutes for their presentation including comments/questions from the audience. We encourage participants to speak for no longer than 15 minutes, reserving a considerable amount of time for comments/questions. All presenters are strongly encouraged to attend the whole Conference if possible. As in previous editions, the Fourth IPIRA Conference will feature keynote speakers and plenary panels with senior scholars and officials from international organizations. Conference Schedule The first day of the Fourth IPIRA Conference, Wednesday, 9 February 2022, will be a half day, starting in the early afternoon and ending in the evening (Asia time). The second, third, and fourth days of the Conference—Thursday, 10 February 2022; Friday, 11 February 2022; and Saturday 12 February 2022—will be full days starting in the morning and continuing until the evening (Asia time). Due to the Online format of the Conference, and the fact that participants will be in different time zones (within Asia and beyond), the Organizers will attempt to create a flexible and inclusive schedule to accommodate the majority of participants. Right to vote in elections is one of the prime ways of participating in the democratic government. It ensures that the government of the day undergoes periodic assessment, and the people exercise their right to elect their representatives. The mere promise of right, however, is not sufficient for ensuring its meaningful exercise by the citizens. The right to vote is a statutory right, however, the exercise of the right has been held by the Supreme Court to be a fundamental right protected under Article 19(1)(a) of the Constitution. In the essay, the participants are expected to explore the barriers that may abridge one’s exercise of right to vote, and to suggest methods through which such barriers may be overcome. KSLR (Kathmandu School of Law Review) is conducting its 2nd International Research Paper Writing Competition (IRPWC). About KSLR KSLR is a double-blind peer-reviewed, open-access and faculty-student edited flagship journal of Kathmandu School of Law. About the Competition KSLR is a double-blind peer-reviewed, open-access and faculty-student edited flagship journal of Kathmandu School of Law. It aspires to become one of the growth-stimulators for the budding legal scholarship in Nepal, by publishing quality and balanced contents of local, national, regional, international, and universal value. Although KSLR uses a wide-angle lens and acknowledges that its publications may be instrumental for everyone and every field of scientific inquiry, it primarily aims to be an enabling and accessible publication for scholars and professionals who have stakes in the field of law and legal studies. To this end, KSLR conceived the IRPWC in 2020 specifically as a competitive and incentivized opportunity for emerging scholars and professionals. We believe that the 1st IRPWC, themed ‘International Order Post COVID-19’, was a prodigious stride towards our aim, to continue which, KSLR announces the commencement of the 2nd IRPWC, and invites submissions within the theme of: “Contemporary Issues in Migration Law” Purpose Governance of human migration has persisted as an important subject-matter for discourse. However, the COVID-19 pandemic introduced new complexities in the human movement, mobility, and migration phenomena and aggravated the existing ones. Judicious legal and policy interventions are required to protect the rights of the migrants, and to foster order and humanity in the management of migrations. We invite authors to research, critique, and provide actionable law and policy related recommendations to enhance the governance of human migration. The IRPWC’s working definition of human migration For the purpose of the 2nd IRPWC, human migration has an open-ended definition inclusive of any factor that induces human migration, and any continuing or new pattern of human movement, whether internal or transnational, regular or irregular, permanent or temporary, voluntary or involuntary, or of a nature that is currently unclassifiable but deserves discussion. Sample Issues Following is a sample (non-exhaustive list) of broader issues based on which specific topics for research may be formulated: Issues within the definition and classification of ‘migration’ and ‘migrants’; Issues within various international legal frameworks applicable to human migration. These include: human rights law, international labour standards, refugee law, the law against transnational organized crimes, environment law (notably the law on climate change), humanitarian law, international health regulation, and such; Relativism in law, policies and practices among states of origin, transit and destination, and the consequential gaps in protection of migrants; The role and functions of inter-governmental organizations and the national government(s) in managing human migration and protecting migrants; Accountability of non-state actors; Legal and policy amendments to address the disruptions in and emerging patterns of human migration in the wake of the COVID 19 pandemic. Sample Topics In order to justify research in any issue such as those listed above, a research paper should be limited to a specific research area and topic within the broader issue/area. Following are some examples of narrow and clear research areas derived from actual journal publications: A paper that builds up a conclusion that the principle of non-refoulement under human rights treaties has a broader and more protective interpretation than under the Refugee Convention. A paper that categorically investigates the absence, necessity and possibility of a global migration law. A paper that recommends policy interventions to reduce the insecurities among migrants caused by disruptions in migration as a result of COVID 19 Pandemic. It narrows down the research area by pinning on a specific theoretical approach and building upon the findings of a specific report, which in turn is limited to a comparative study on nature of migration and its governance system in 7 countries, including Nepal. A paper that “questions the conflation of transnational domestic work with trafficking”, at least an automatic one. In doing so, it “explores the experience of several young Nepali women who spent time in the Persian Gulf as transnational domestic workers, and argues that migration served to increase their sense of autonomy and agency”. For additional ideas for topic formulation, you may browse through the International Organization for Migration (IOM) catalogue of migration related journals, which also features law journals. Eligibility The competition is open to students enrolled in bachelors, masters or Ph.D. level of studies, research scholars, and early career academicians with no more than 7 years of experience in their profession. A paper may have up to three authors. Only one submission is allowed per author. Registration Procedure and Deadline Registration for the competition shall be free of cost. Submission of the research paper shall automatically register author(s) for the competition. The research paper should be submitted at https://forms.gle/N5cSCYNCN9JKfreJ9. The deadline for submission of the research paper, without any exception, is 20 December 2021, 11:59 PM NPT (GMT +5:45). Formatting & Styling The research paper should be submitted as a Word file (.doc/.docx) at the link specified in section 5.3. Plagiarism and Referencing The research paper should be the original work of the author(s). Refer to section 8.1. The research paper should not have been published elsewhere in significant parts or as a whole. If it has been submitted elsewhere for consideration for publication, the submission must be retracted before submission at IRPWC, and the proof of retraction must be submitted. References must comply with the KSL Comprehensive Style to Legal Citation. Specific Quality Indicators Following are the quality indicators applicable to all submissions to KSLR, including the IRPWC: The research paper should not have a plagiarism report exceeding 15% when scanned by a reliable plagiarism detection tool. This excludes commonly used terminologies. Automatic paraphrasing or any other text manipulation should not be used to mask plagiarism. The footnotes should be uniform in format, authentic, accurate and complete, and as prescribed in section 7.3. The content of the research paper should be a novel contribution to the area of legal scholarship (specifically the migration law in case of IRPWC 2021). The title should be clear, concise, appealing, and compatible with the paper’s overall content. The abstract should be an apt gist of the paper. Any breakthrough or remarkable conclusion of the paper should be included in the abstract. The introduction should contain a clear thesis, that is the statement(s) of the problem being investigated. After the thesis, the introduction should contain a concise paragraph describing the arguments that will be developed in the paper. The arguments of the paper should be logical and well-substantiated: Facts and legal authorities should be presented sincerely, accurately, and referenced properly. Every argument should be founded upon clear reasoning. Supporting reasons should be backed by appropriate referencing. Generalizations and sweeping statements should be supported by numerous confirming sources. Diverse opinions should be considered before taking stances. Differing opinions should be indicated while making debatable claims. Personal biases should be disclosed when they may influence the readers. The conclusions should be based on the arguments of the paper. Unsubstantiated conclusions take away from an otherwise well-researched and credible paper, and should be avoided. The contents and their presentation should be engaging. The articulation should be clear and comprehensive. Use of purposive jargon, especially legal terminologies is encouraged. However, verbosity should be avoided. All expressions should conform to the established principles and rules of human rights, including those on sexual and gender orientation and identity, as well as the reasonable limitations to the freedom of opinion and expression. Evaluation and the Scale or Marking The research paper shall be marked on a scale of 100. Specific scales of marking shall be: The Extent and Depth of Research 30 Novelty and Creativity 20 Logic and Organization of Arguments 30 Grammar and Vocabulary 10 Formatting 10 Anonymity of the author(s) shall be maintained throughout the evaluation. There shall be two rounds of evaluation. In the first round, the papers will be evaluated for plagiarism, formatting in accordance with the KSL Comprehensive Style to Legal Citation and timeliness of the submission. Papers whose plagiarism score exceeds 15% as specified in section 8.1. will not proceed to the second round. The second round of evaluation shall be performed by an independent panel of evaluators. The cumulative marking shall be final and binding. Penalties Improper formatting: 1 point shall be deducted for each instance where the formatting is inconsistent with Chapter 1 of the KSL Comprehensive Style Guide to Legal Citation. Improper footnote: 0.2 point shall be deducted for each instance. Compounded deductions: for sections 10.1 and 10.2 shall not exceed 10 marks. Breach of the word limit: 1 point shall be deducted for every 100 extra words. Awards The best paper with the highest scores will receive a corresponding certificate and a cash prize of US $150/- (Inclusive of bank transfer charges wherever applicable). The second-best paper with the second-highest scores will receive a corresponding certificate and a cash prize of US $100/- (Inclusive of bank transfer charges wherever applicable). The third best paper with the third highest scores will receive a corresponding certificate and a cash prize of US $50/- (Inclusive of bank transfer charges wherever applicable). Each outstanding paper falling short of three best scores will be awarded an “Honorary Mention” and receive a corresponding certificate. Publication of Papers The editorial board of KSLR shall hold a meeting at the earliest following the termination of the competition to shortlist papers submitted to IRPWC 2021 for publication in the closest issue of the journal. The Board should prioritize the papers mentioned in sections 11.1-11.3 for that purpose. Papers under section 11.4 may also be considered for publication. Papers not mentioned in sections 11.1-11.4 may be considered for publication under special circumstances after careful discussion among the board members. The shortlisting shall be based on the initial review standard of KSLR. All the shortlisted papers must be peer reviewed according to the double-blind peer review standard of KSLR. KSLR has the exclusive right to publish all the papers submitted to IRPWC 2021 from the date and time of the submission. The exclusive right to publish will be transferred to the respective authors under following conditions: If any shortlisted paper is not approved for publication, subsequently. In case of papers not shortlisted, from the date and time of such decision. In case of papers that do not reach the second round of evaluation mentioned in section 9, from the date and time of the disqualification. All IRPWC 2021 papers published in KSLR shall abide by its copyright policy. Miscellaneous The participant, by registering in the competition, agrees to indemnify the Administrator from and against claims, suits, and damages based on any allegations of copyright infringement, plagiarism, or unauthorized use. The participants can retract their paper. To do so, they must inform the organizers prior to the publication of the results. ALC Pune’s Online National Moot Court Competition will be conducted via online/virtual mode (Through Cisco WebEx Meetings Platform) from 8th January to 9th January 2022 by the Army Law College, Pune. About Army Law College Army Law College, Pune was established in July 2018 with a noble objective of imparting the quality legal education to the children of our brave, patriotic & selfless Army Personnel. Proceedings For any technical glitch/lack of internet connectivity/any other technological problem at the end of the participating speakers (which cannot be resolved within reasonable time) in any Round, the entire Team shall be disqualified. In such a situation, the opposite Team shall be declared winner in the concerned Round after making oral pleadings automatically. However, the organizers reserve the right to re-schedule the Round in their discretion. All Rounds shall be “Knock-Out” Rounds. A team shall be credited with a win in the respective Rounds if their Round total score is greater than that of the opposing team. In the event of a tie in the Round Total of the teams, the team with a higher Memorial Score will be declared as the winner of the round in question. In case the tie persists, the decision of the judges will be deemed to be final. In the Preliminary and Semi-Final Rounds, each Team will have 30 minutes for arguments. Policy for Virtual Rounds The Oral Rounds for the competition will take place virtually via Cisco Webex platform. It would be the responsibility of every team to ensure a stable internet connection. The audio and video of every member of the team should be clear. Every team must ensure a proper background. The organisers will under no circumstances be obligated to provide the participants with any such facility. All participants should mandatorily join with their laptops or desktops and other forms of device are to be avoided. The link or the ID and password for the room on Cisco Webex will be conveyed to the participating teams before the oral rounds. Each participating member of every team is advised to install the Cisco Webex platform on their devices well in time. Each team is required to join the room at least twenty minutes before the scheduled time of commencement of the oral rounds. The participants’ camera and microphone shall be firmly positioned throughout the oral rounds so as to show speakers and to ensure their voices are clearly audible. All participants must keep their cameras on at all times during the rounds. Camera to be switched off in case of technical glitches with the permission of the bench. At the time when one participant is speaking, others are expected to keep their microphones on mute. In case a participant is found disturbing the other pleader anyway, he/she or the entire team to which such participant belongs may be disqualified upon the discretion of the bench. Each participant is responsible for finding a suitable venue and background to participate. The venue must be a quiet location and one which has adequate and reliable internet connectivity and has a desk and chairs for the oralist. Locations in open spaces or hallways or cybercafes or similar areas are NOT permitted. Participants are cautioned to ensure that all equipment has a power supply sufficient to last for at least two hours without interruption. In case of a loss in internet connection, each team will be given a reasonable time to reconnect. If the problem still persists the decision made by the organisers shall be final and binding. In the event where one or both of the speaker could not join due to connectivity issue, the team may be disqualified from the competition and at no circumstances can other member of the team be allowed to switch roles. Where a team does not appear within 10 minutes of the scheduled time for the round, the round shall proceed as ex-parte. Any compiled Research Material (Compendium) or other supplementary documents may be, as per the discretion of the bench, presented by the team by using the “screen sharing” option given they have fulfilled the preceding sub-clause. Participants will not be allowed to use the feature of personal chat on Cisco Webex to communicate with their team members or members of the opposing team. Teams shall not use internet or any other devices during the rounds for anything, except participating in the rounds. Participants can only sip water on screen during the competition. Consumption of other beverages or eatables is not permitted. Non-Speakers are to switch off video before drinking water. Participating speakers and researcher are permitted to join for the Virtual Competition from the same premises/room. However, the screen space shall be independent and the speakers, researcher to represent before the bench through individual/separate devices. Appropriate court room demeanor is to be maintained. This is mandatory. Participants are expected to cooperate with the organisers and the judges, in case anyone faces any issue. The organizers shall take best available measures to resolve or mitigate any connectivity issues that may arise. However, in cases where that is not possible, the organizer cannot be held responsible for the unforeseen issues which includes (but are not limited to) – Software failure and connectivity issues. The needs of children across borders are dynamic and due to the innocence of the children, they become easy victims for the deviants. Formatting Guidelines for Papers The research papers shall adhere to the following formatting guidelines: The length of the paper shall not be less than 3,000 words and more than 5,000 words; The paper shall have an abstract of a maximum of 250 words with four to six keywords; The Heading of the paper shall be typed in Capital, Bold, Font Size 16, Times New Roman, Central Aligned; The main body shall be in Times New Roman, Font Size 12, Line Spacing 1.5, Justified Aligned; Sub-headings shall be in Bold but shall not be in the capital with Font Size 12, Line Spacing 1.5, Justified Aligned; Sub-Sub Headings shall be in italics with Font Size 12, Line Spacing 1.5, Justified Aligned, Sub-sub-sub-Headings shall be numbered with roman numerical; Images shall be Central Aligned and with clarity and authorities shall be duly cited wherein case if images are self-created then such shall be mentioned in the Footnote Section; All charts and tables shall be center-aligned and the authorities shall be duly cited; OSCOLA 4th Edition shall be used for citation and footnotes shall be in Times New Roman, Font Size 10, Justified aligned, and Single Line Spacing. The Magazine Committee of the Government Law College invites entries for The 20th Dinesh Vyas Memorial National Legal Essay Competition. About Government Law College, Mumbai With a heritage spanning over 150 years and a seemingly endless list of eminent alumni, Government Law College, Mumbai has been considered as a premier institute of legal education since its inception in 1855. Having humbly begun as evening classes in a borrowed premises, this college that first lit the candle of legal education in India, stands tall amongst all its contemporaries. Government Law College has a distinguished tradition. The College has, over the years, produced a number of eminent Judges, whose erudition and independence has been and continues to be, a great source of inspiration to the members of the Bar and the Bench. The list of alumni includes statesmen, distinguished lawyers and activists who have been at the forefront of social reconstruction. The interaction of the students with the distinguished members of the legal fraternity in a cultivated institutional environment that is constantly attempting to redefine the parameters of education, adds to the charisma of this institution. About the Magazine Committee méLAWnge 2019-20 is not just an annual publication, it is a part of aeonian history. It is for this reason that students, professors, lawyers and judges have come together, once again, to breathe life into this edition. The cover for this edition is a recreated version of a sketch from a magazine from the 1950s. It is a creative compilation of our college crest, including the Mumbai skyline, Lady Justice with her sword and scales, our college motto, and the Lion depicting our affiliation to Mumbai University. About the Dinesh Vyas Public Charitable Trust The Dinesh Vyas Public Charitable Trust, since its formation on December 16, 2020 has efficaciously promoted the cause of education in diverse fields. In its endeavor to provide a stimulus to education in India, the Trust aims to sponsor various societies and competitions, award fellowships and scholarships, promote e-learning and vocational learning and establish counselling centers and provide appropriate infrastructure for several facilities to encourage quality education in India. Comment upon the glorification and normalization of mob justice and vigilantism in current media and its impact on the perception, in and outside India, of the legal system established by law in India. With the Pandemic bringing India’s mental health crisis to the fore, discuss the existing laws related to Mental Health in India and the need for reform. Comment upon cyber snooping, with special reference to the Pegasus Spyware. The law of sedition: A boon or a bane? Deadline The entries must be submitted on or before 20th November, 2021 No submissions made after that shall be accepted. Eligibility Students pursuing LL.B. (3 Years or 5 Years Courses)/ LL.M. course from any recognised University or College can participate in the competition.
