Centre for Social Justice, a socio-legal, Non-Governmental Organisation (NGO), is anchoring the Young Professionals Program for Legal Empowerment (YPPLE).    About Centre for Social Justice Centre for Social Justice is a socio-legal, Non-Governmental Organisation (NGO) initiated by the Institute for Development Education and Learning (IDEAL) in 1993. CSJ is one of the first organizations of its kind in India that uses the judicial system to fight for the rights of marginalized people.   About the Program The Young Professionals Program for Legal Empowerment (YPPLE) was started by the Centre for Social Justice (CSJ) in 2014 with the objective of equipping young legal professionals to become powerful change agents by giving them the opportunity to develop a holistic understanding of how legal empowerment at the grassroots play a catalytic role in bringing social change.   What will you do under YPPLE? A group of young legal professionals will be placed for a minimum period of one year in the field where CSJ is implementing its interventions. A learning/ performance road map will be developed jointly with the selected candidates. Each individual will spend a substantial duration in the field areas and the remaining time will be dedicated towards research and writing, reflections, inputs, and capacity building.   Eligibility The Program is open to young law graduates/legal professionals who wish to pursue a career in the field of human rights as lawyers, practitioners, researchers, or academics. Willingness to engage with field realities, to live in challenging conditions, and to travel extensively, are things every candidate must be willing to do. Candidates must, above all, display a strong drive, motivation, and commitment towards working for social change.   Role Conduct field based research on law and policy issues for formulating interventions and creating policy documents. Coordinate training and capacity building programs and develop training materials. Supervise data collection for research programs/projects. Collaborate/coordinate programs with stakeholders including representations with various government authorities. Contribute to the legal work of the organization. Organize events to initiate public debate on issues. Bring in creative approaches and perspectives to the existing work of the organisation.   Stipend A stipend of Rs. 33,000 per month will be paid to the selected candidates. Please Note: The Program is designed as a two-year engagement. At the end of the mandatory one-year commitment, candidates would have the option to either continue working with CSJ or opt out.   Location Ahmedabad, Gujarat   Application Process Candidates interested in applying for the Program must submit an online application with the following attachments. The ILS Law College Pune is organizing a National Legislative Drafting Competition, to be held online from April 4 to 7, 2022.   About ILS Pune The Indian Law Society was established in 1923 as a Public Charitable Trust registered under the Societies Registration Act, 1960. It is a non-profit organization established with the sole purpose of imparting legal education. The Society is a voluntary association of persons, who came together with a pledge to launch legal courses having social utility and social relevance. The founder members of the Indian Law Society were the legal luminaries like Sir Narayanrao Chandavarkar, Shri J. R. Nanasaheb Gharpure, Diwan Bahadur and P. B. Shingane.   About ILS Law College Established in 1924, ILS Law College is one of the oldest law schools in India and has been playing a pioneering role in legal education and scholarship in the country.   About the Competition Legislations or statutes are considered as one of the important sources of law. Most of the legislation are written in a manner that is complex for laymen to understand. Thus, to create legal literacy and legal awareness amongst the common man legislations have to be drafted in clear, simple language with accuracy and precision. Drafting is an onerous task and requires proficiency. A person drafting legislation should pen down every word with exactness. Legislative drafting is the art of creating a nexus between legislation and the intention behind it. Efficacy of a law is dependent on the wisdom with which it is drafted. It is often observed that good policies may turn out to be a bad law because of the ambiguity or incorrect placement of words, thus precision in drafting a law gains importance. The purpose of organizing the National Legislative Drafting competition is to encourage law students to get introduced to the skills of legislative drafting and also to emphasize upon them the significance of the subject.   Eligibility Students of III, IV & V year of 5-Year Integrated Law Degree Program & Students of II & III years of 3-Year LL. The Department of Law, Maharishi Markandeshwar (Deemed to be) University, Mullana-Ambala is organizing the 5th MM National Moot Court Competition 2022 from April 19-21.   About the Organiser Accredited by NAAC with the grade A++, MM (DU) has built its goodwill as the best university of North India with a rich legacy of excellence in research, innovation and skill development.   About the Competition The Department of Law, Maharishi Markandeshwar (Deemed to be) University, Mullana-Ambala has previously conducted National moot court competitions during the last four academic years and this year again the 5th edition of the same is being organized. In the last edition of the MM National Moot court competition which was organized from 14.10.19 to 16.0.19, teams from across 23 different Law universities and colleges from all over the country participated. Out of these 23 teams, the teams from GLC, Mumbai, and Jindal Global Law School, Sonipat reached the final round. Out of the two teams, the team from GLC, Mumb ai was declared as the winner.   Eligibility The Competition shall be open for Students, duly enrolled and are pursuing an integrated 5years or 3 years Law Program in India from an institution recognized by the Bar Council of India. Students enrolled and pursuing a post-graduate diploma or short-term certificate courses in law are not eligible to apply. This becomes pertinent because traditional approach has failed to solve the chronic problem of delayed justice. In addition to above, a welfare state like India, where justice occupies uncompromising stature, it calls for greater and focused attention. In this regard, ADR is one such creative approach which will help in achieving justice through securing faster and adequate justice for the masses so that the true meaning of justice is realized. A variety of disputes are amenable to mediation including commercial, contractual, business, corporate, employment, intellectual property, matrimonial disputes etc. Mediation as a mode of Alternative Dispute Resolution is playing a pivotal role in providing justice to common people. It is empowering common people in the society and imparting justice in a cost effective and expeditious manner. The thought that has necessitated for organizing such a conference is that the awareness of people regarding their rights has increased in recent times. Such increase has boosted the confidence of common man and enhanced his willingness to undertake litigation. Unfortunately, the infrastructure with the state has not increased commensurately resulting in backlog of cases. The increment and presence of backlogs have been causing an excruciating delay in the administration of justice. It was reported that millions of cases are pending in various courts across the country and India is facing unprecedented “litigation explosion”. As per the last census by Ministery of Law and justice the ratio of judges million 17.48%. However, a novel course of action is required as a remedy to this malaise which serves as a compliment to the traditional judicial system, there by helping to reduce the heavy burden of litigation and at the same time not compromising with the standards of equity, justice and good conscience. Mediation as an ADR mechanism is a process of resolving disputes with the help of a third neutral person who assists the parties at dispute to reach a negotiated resolution. It is voluntary, party centered and structured negotiation process in which a third neutral person assists the parties in amicably resolving their disputes. In a country like India, where the course of development is skewed and affecting each and every citizen, the demand for justice is increasing at greater pace given the fact that major chunk of our population still remains marginalized, deprived and destitute. The fisheries agreement currently being negotiated is the latest example. The increasing concern about the consequences of growth in trade and consumerism for the ecology of the planet has intensified the trade and environment debate. But tussle continues as to which side the concept of sustainable development should tilt, on the side of the environment or development. The lack of consensus on the draft Fisheries Agreement under the WTO is a reflection of this tussle. The idea of sustainable fishing is based on the US policy of Maximum Sustainable Yield (MSY) adopted in 1948. Although claimed to be based on science it was guided more by international politics and economics. Writers have since long criticized MSY and attributed the depletion of fish stocks to US policy and industrial fishing. Scientists argue that the ocean is different and techniques and policies employed for agriculture management cannot be transposed to manage the ocean environment. Instead of concentrating on particular fish species, the focus should be on the assemblage of fish species. The draft Agreement appears to be based on the MSY policy. Moreover, the draft lacks the support of many developing countries. This is because the provisions relating to subsidies allegedly do not take into account the concerns of coastal less developed countries and their farmers for whom subsidy is a question of livelihood.   Submission Guidelines Original papers within 5000 words are invited from teachers, researchers, students and others for presentation in the webinar. The paper is to be written in Times New Roman, Font Size: Heading-14, Text-12 in A4 format, Line Spacing-1.5, Alignment-Justified. Authors are requested to adhere to the Bluebook (21st ed.) citation format for footnoting in Times New Roman Font 10 size with Line Spacing-1. There can be a maximum of one Co-Author on a paper. The Chamber of Tax Consultants is organizing the Dastur Essay Competition 2022 for Students of Law and Accountancy.   About the Organiser The Chamber is one of the oldest professional organisations founded in 1926. The Chamber has been organising the Dastur Essay Competition since 2012 for Law Students and Articled Trainees pursuing CA, CS and ICWA Courses, where essays on current topics are invited and then the same are judged by senior professionals with prizes and certificates being awarded to meritorious essays.   About the Competition We, at The Chamber believe that young students are the future leaders of our nation. They have the strength to bring ideas to life. Writing, a dying art today, is an important tool for encouraging the young fresh minds with novel ideas, to express themselves on topics of professional interest and get recognised by a professional forum, with around 4,000 members, through publication of the top three essays in 'The Chamber's Journal'. If yes, how should it be regulated?   Eligibility Participation is restricted to students enrolled in the 3-year LL.B course or the 5-year integrated law course or CA Articled or CS/ICWA trainees only. Participants must be below 28 years of age as on date of submission   Registration The essay must comprise not less than 5,000 words and not more 7,000 words including footnotes. The participants should send their entries by e-mail in PDF File document forwarded to [email protected]. Since its inception in 1924, the Department has been a leader producing many legal luminaries, supreme court and high court judges, leading advocates, political leaders, policy makers and trendsetters in all walks of life.   About the Webinar The issue of marital rape in the contemporary Indian society has been a topic of intense debate and controversy. The sexual offence against the spouse is widespread than many realise, but it is yet to recognize as separate offence under section 375 of Indian Penal Code 1860. The law enforcement and judicial authorities are also reluctant to take cognizance of sexual assault against the spouse since accused is nobody but the life partner of the victim. It is also a challenging task to investigate, prosecute and launch judicial trial in spousal rape cases. The penal proposition with regard to rape law significantly exempt the sexual offence between spouses. The debate regarding marital rape resurfaced when many women approached the courts to seek remedy against the brutal sexual treatment in their matrimonial home and family life. The section 375 of the Indian Penal Code 1860 says that sexual acts by a man on a woman against her free will or consent would constitute rape. However, there are two exceptions to this. The first exception says that “a medical procedure or intervention shall not constitute rape”. As per the second exception, “sexual intercourse or sexual acts by a man with his own wife” when the wife is above 18 years of age would not constitute rape. It is this provision that is being constitutionally tested. While marital rape is not a criminal act in India, a woman could file a case under Protection of Women from Domestic Violence Act 2005 or provision of cruelty under Indian Penal Code, and could claim separation or divorce or seek punishment against her husband. A particular section of Indian society especially women activists want exemption provided in section 375 should be struck down due to its unconstitutional nature. Further, the exemption of section 375 also violates right to equality, right to life, dignity and self-esteem of women as guaranteed under the Constitution of India. Those who strongly advocates about the seriousness of marital rape and believe that it should be a punishable offence also highlights some anomalies in the law relating to cruelty where battering, physical and psychological torture against wife is a criminal offence but not raping her. In numerous judicial pronouncements the forced sexual relation between the spouses is a factor of divorce and punishment but this area has been completely ignored by the protagonists. Acknowledging the marital rape as a separate offence on the line of section 375 may also cause serious repercussions viz who will look after the children if husband imprisoned, what will be the status of women after conviction of her husband, whether she will go for divorce or maintenance. Some legitimate concern of the ruining of Indian family values, culture and future of the children can’t be ruled out as happened in the past with heavy misuse of Sec 498A of Indian Penal Code. The Ministry of Women and Child Development has indicated that marital rape is a serious issue and it should be addressed as per the Indian legal system. If marital rape declared as separate offence under the law, children will be the main victims of these laws. Moreover, if a wife is subject to sexual cruelty, then a civil remedy of divorce is available with her and since cruelty is already a criminal offence, what’s the need to bring in an extra category of crime at the time when people are already running away from marriage. Apart from that many unanswered questions are also lining up about the socio-economic protection of wife, children, parents and other dependents of the husband. The issue of bodily autonomy is also there when we discuss about Article 21 of the Constitution and right to personal liberty also applies on married woman. Further, in 2018, while decriminalising adultery the court held that even marital relations are not exempted from constitutional scrutiny. The primary objective of the webinar to discuss and explore some avenues as how to address the marital rape conundrum and what are the challenges ahead if the law enacted. Prime focus of this webinar will be to analyse the possible consequences of the Court’s suggestions and their impact on Indian families.
