Child Rights Centre, CNLU organizes a webinar on “Reproductive Choice of Women: A Fundamental Right” on 27th November 2021 sponsored by NCW, New Delhi.   About Chanakya National Law University (CNLU) Chanakya National Law University (CNLU) is a public law school and a National law University in Patna, Bihar, India. It was established in 2006 by the Government of Bihar (Bihar Act 24 of 2006) as a public university dedicated to the field of legal education. The Chief Justice of Patna High Court is the ex officio chancellor of the university. It is one of the autonomous law schools in India. The campus is located right near the heart of the city in the Mithapur area and has an area of approximately 18 Acres. The university came into being on 15th August 2006 under the guidance of its vice-chancellor/pro-chancellor, Prof. Dr. A. Lakshminath, former dean and registrar, NALSAR University of Law, Hyderabad, HRD Principal Secretary Madan Mohan Jha, a 1977 batch IAS and Registrar(I/C) Vijay Kumar Himanshu Dy. Admission to the total 40 seats for the LL.M course is provided through the Entrance Test conducted by the university.   About the Webinar Bihar is a state which is the least developed as compared to other states of India. The condition of women in India is also not up to the mark since most of the population of Bihar population are belonging to Villages. If we see the health profile of this state, then we come to know that Bihar has the lowest health profile. There are various reasons behind it and pregnancy is also one of the reasons behind it. If we talk about the rights of women in the context of pregnancy in India there is no appropriate law for it. In about 70 years of Independence of India, women are working in many sectors parallel to the men. In the context of Reproductive Rights, judgments of Puttaswamy, recognize the constitutional right of the women which give freedom to make their reproductive choices. It is covered under Article 21 of the Indian Constitution (Justice K S Puttaswamy v Union of India 2012a: para 72, 2012b: para 46, 2012c: para 38). The bench also reiterated the position adopted by a three-judge bench in Suchita Srivastava v Chandigarh Administration (2009), which held that reproductive rights include a woman’s entitlement to carry a pregnancy to its full term, to give birth, and to subsequently raise children; and that these rights form part of a woman’s right to privacy, dignity, and bodily integrity. But things are very much different in reality. If we talk about life expectancy, it is higher in developed countries as compared to India. In India, we can see that the expectancy of females is not the same as the women of developed countries which indicate the poor health of women in India. This poor health might be due to different reasons and reproductive choice is one of them. One big issue of Indian society is that the choice of getting a son and these things are governed by the elder of the family. Such practices of getting a son as a baby are very common in northern India especially in Uttar Pradesh and Bihar. The Department of Laws, Panjab University is organizing its 1st Online National Moot Court Competition, scheduled to be held from December 11 to 12.   About the Organiser The Department of Laws, Panjab University was originally established at Lahore in 1889, re- established at Shimla in 1948, and finally re-located at the University Campus at Chandigarh in 1959. Its Alumni include Judges of the Hon’ble Supreme Court and High Courts, Union Cabinet Ministers, State Chief Ministers, Cabinet Ministers and other legal luminaries. The stature of the Department of Laws is as big as its strength and has a great legacy in terms of its research and academic work related to national and international relevance. The Department with utmost pleasure announce that it is organising a National Moot Court Competition and everyone is cordially invited to participate.   About the Moot The present moot court competition shall be conducted with an objective to provide learning opportunities to the students. The Department believes in imparting value added education and thus present event shall help students in enhancing their research skills, writing and advocacy. The present moot problem is based on Constitutional Law, Parliamentary Privileges and their exercise by the members of Parliament.   Date and Venue of the Competition The ‘Department of Laws National Moot Court Competition, 2021’ will be held from December 11, 2021 to December 12, 2021 virtually over Google Meet.   Team Eligibility and Composition The competition is open for students who are pursuing LLB three year / five-year course during the current academic year. Only one team is permitted to participate from each participating Institution. Each team shall consist of three members. This number cannot be modified under any circumstances. In a team consisting of three members, two members shall be designated as ‘Speakers’ and third member shall be designated as ‘Researcher’.   Anonymity Each participating team shall be allotted a team code upon initial Registration and same shall be conveyed on email provided by the team. Teams shall not disclose, in any manner whatsoever, for the entire competition, either their own individual identities or the identity of the Institution that they represent, even if asked by the Judges. The team shall not disclose their identity anywhere in their written Memorials and instead should use the code allotted. The students of the batch of 2025, who are currently pursuing ‘Law of Contracts – II’ are organizing the TNNLU National Essay Writing Competition, on the Feminist Perspectives on Indian Contract Act and Surrogacy in Independent India.   About TNNLU TNNLU is located in Srirangam Taluk of the Tiruchirappalli Corporation, formerly known as Trichinopoly. The Government of Tamil Nadu established this institution of learning by an Act of State Legislature (Act No. 9 of 2012) to provide quality legal education. A woman hired to bear a child for another woman or a couple, which she turns over to the hirer is called a surrogate mother. The concept of surrogacy with modern technological advancements has taken on a new dimension, but the practice of one woman bearing a child for another is prevalent since a long time. India is the largest and cheapest market for surrogacy. The practice of surrogacy is growing every year. Surrogacy has got the commercial character these days which has resulted in parties agreeing to enter into surrogacy contracts. When the whole process of surrogacy has become more commercial in nature, ethical and legal concerns are raised about surrogate motherhood. Seventy-five years of Independence has witnessed changes in women’s role and has opened up various opportunities for their growth and advancement in independent India. However, the social hierarchies faced by women is always hindering their well-being and growth. Surrogacy is one such issue where there is no clarity with regard to the rights and liabilities of the parties involved. Moreover, a proper regulatory mechanism does not exist. The Indian Contract Act, 1972 is considered as the basic law relating to contracts in India. As we are nearing our 75 years of Independence, it is high time we analyse the nexus between the Indian Contract Act, 1872 and the surrogacy contracts from a feminist perspective. National Essay Writing Competition, IDIA Hyderabad Chapter

IDIA ( Increasing Diversity by Increasing Access to Legal Education) Hyderabad Chapter is organizing a National Essay Writing Competition on various themes.   About IDIA IDIA helps students from underprivileged and marginalized communities to secure admission to the leading law colleges in India. The aim is to create lawyers from within these communities. Since law is an instrument of power, access to premier legal education empowers these communities in the long run and helps them help themselves. The IDIA movement has now spread to at least 18 different states and union territories. Local teams have visited a large number of schools across India, from the Sunder bans in West Bengal and Pelling in the North East to Jitholi in Uttar Pradesh and Srinagar in the North to Tumkur in the South. The modus operandi for selection and training is thus: A simple aptitude test (involving mostly logical reasoning questions) is administered to check the students'aptitude for the study of law. In addition, the IDIA has been pushing relentlessly for reforming the CLAT. These concerted efforts have resulted in the CLAT Committee agreeing to various affirmative measures—for instance, removing the section on static general knowledge, and legal knowledge completely from the paper. The rationale is to test the aptitude of the students, rather than the knowledge.   About the Competition The Hyderabad Chapter of IDIA is hosting an essay writing competition with multiple themes, and the competition is open to all law students, academicians, and legal practitioners. They encompass a spectrum of civil, political, economic and social rights, ranging from the rights to health and life, to the rights to equality and non-discrimination, privacy, information, and to be free from torture or ill-treatment. In other words these rights include access to contraception, the right to a legal and safe abortion, the right to make decisions concerning reproduction free of discrimination, coercion and violence, the right to not be subject to harmful practices such as the coerced bearing of children (including with their spouse); and equal entitlement of LGBTQ persons to the same sexual and reproductive health services as all other groups The recognition of reproductive rights can be found in various international instruments such as the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW); the International Covenant on Civil and Political Rights (ICCPR); the International Covenant on Economic, Social and Cultural Rights (ICESCR); and the Convention on the Rights of the Child (CRC). India being a signatory to these instruments, owes an obligation to respect these rights in letter and spirit. Further in recent time we can find various judgments of constitutional courts which have provided the strong foundation for the recognition of reproductive rights of women. A decade ago the Supreme Court in the Suchita Srivastava V. Chandigarh Administration, 2009 (9) UJ 4151, upheld that woman’s right to make reproductive choices is a dimension of personal liberty as understood under Art. 21 of the Constitution of India and refused to recognize any restriction to curtail the right. Recently in Justice K S Puttaswamy v Union of India the Supreme Court has specifically recognised the constitutional right of women to make reproductive choices, as a part of personal liberty under Article 21 of the Indian Constitution. This judicial pronouncement as to women’s autonomy to take informed decisions regarding their own bodies, fertility, and reproduction is likely to impose variety of challenges specifically with respect to abortion, surrogacy and involuntary sexual intercourse within the marital relationship. The right to reproductive healthcare is one of the important facet of reproductive rights the enforcement of which is hampered by various issues including maternal mortality and morbidity, unsafe abortion and poor quality of post-abortion care, lack of access to the full range of contraceptive methods and reliance on coercive and substandard female sterilization, child marriage, and lack of information and education on reproductive and sexual health. Further the decriminalization of the same sex relationship is likely to lead demand of reproductive rights by those in such relationship. In this backdrop, the scrutiny of enforcement of reproductive rights by women in Indian society becomes utmost necessary for the holistic understanding of these rights. The Centre for Social Justice, Institute of Law, Nirma University is organizing an Essay Writing Competition on ‘Elimination of barriers to the exercise of the right to vote’.   About Institute of Law, University of Law The Institute of Law, Nirma University (ILNU) is a constituent institute of Nirma University located in Ahmedabad, Gujarat. It was founded in 2007 on the vision of Padmashri Dr Karsanbhai K Patel.   About the Centre The Centre for Social Justice is a research centre at the Institute of Law, Nirma University. The Centre engages with discourses in pressing social dilemmas and their interface with law. We work with the aim to promote causes of social justice through rigorous research, collaborations and exchange of knowledge. The Centre is organising its first essay writing competition.   About the Competition The topic for the essay writing competition is “Elimination Barriers to the Exercise of Right to Vote”. Right to vote in elections is one of the prime ways of participating in the democratic government. It ensures that the government of the day undergoes periodic assessment, and the people exercise their right to elect their representatives. The mere promise of right, however, is not sufficient for ensuring its meaningful exercise by the citizens. The right to vote is a statutory right, however, the exercise of the right has been held by the Supreme Court to be a fundamental right protected under Article 19(1)(a) of the Constitution. In the essay, the participants are expected to explore the barriers that may abridge one’s exercise of right to vote, and to suggest methods through which such barriers may be overcome.   Topic for the Competition “Elimination Barriers to the Exercise of Right to Vote”   Eligibility Students who are presently enrolled in and pursuing an undergraduate (Bachelor) or Master’s Degree at any University/College in India may participate in the competition. Members of the Centre for Social Justice, the Institute are not eligible to participate in the competition.   Submission Guidelines The Essay shall be written in the English language. References shall be provided in the essay in the form of endnotes. The word limit of the essay should be between 1800 – 2500 words excluding the endnotes. The following formatting shall be used for the essay: Font Times New Roman Font Size 12 for text; 14 for headings Line Spacing 1.5 Alignment Justified Co-authorship is allowed to the maximum extent of only two authors. Your submission must be an original and unpublished work. The submission shall be subject to plagiarism test. The submissions made shall include the manuscript and a separate cover letter. The cover letter shall contain: Name, Institution, Course, and Year of Study. The details mentioned in the cover letter shall not be included anywhere in the manuscript. NLIU-Legal Aid Clinic (LAC) is organising a PIL Drafting Competition on the auspicious occasion of Constitution Day i.e., November 26, 2021. The deadline to register for the same is November 16, 2021.   About NLIU-LAC The NLIU - Legal Aid Clinic (“LAC”), which is driven by the ethos of Article 39A of the Indian Constitution, has been established under the aegis of the National Legal Services Authority. It is a student-run initiative, which aims to provide free legal aid to the marginalized sections of the society. Our aim is to provide pro bono legal representation and advice to the weak and downtrodden sections of the society. Additionally, we also organize various legal literacy workshops and training programs to spread legal awareness and to further the cause of legal literacy.   About the Competition The NLIU-LAC in collaboration with Dept. of public relations of the M.P. government (‘Jan Sampark’) & the Committee for Legal Aid to Poor (‘CLAP’) is organising the 2nd edition of PIL Drafting Competition on the Constitution Day i.e., 26th of November 2021.   Eligibiliity The competition shall be open for the students currently pursuing their bachelor’s degree in law i.e. 3-Year LL.B. course or 5-Year LL.B. course from any recognized university/college in India.    Team Composition “Individual Participation” as well as “Participation in a team of two” is allowed. Participants from two different universities may also form a team. Only queries sent through a mail shall be entertained.   Submission Guidelines Topic of PIL The participants may submit a PIL draft on any issue of contemporary relevance that they deem fit.   Submission of PIL Drafts Each Participating Team must submit ONE PIL draft. If a participant/team wishes to submit any annexure to support his/her arguments contained in the Draft [for instance Reports, Commentaries, News Clippings, Pictures, etc.] a compendium of all the relevant annexures must be prepared and should be sent along with the memorial. All PIL drafts must be sent on the email address: [email protected] till 20th November 2021 midnight with the Subject of the email as “PIL Draft, Team Code” Any submission made after the deadline will not be considered for evaluation, and will result in the cancellation of candidature as well as forfeiture of the registration fee. Any submission with any name reference of the participant will be disqualified. Substantial Plagiarism shall amount to disqualification; therefore, the Participants must not submit plagiarised content (as the Drafts will be put through ‘Turnitin’). In case the draft of two or more participants/teams is found “substantially similar” to each other, both the participants/ teams shall be disqualified.   Formatting Guidelines All the drafts must be submitted in both Microsoft Word Document format (.doc/.docx) and PDF Format (.pdf)[i.e. each participant is required to send 2 files- One in MS Word format and one in PDF format]. The body of the submissions must be in the font “Times New Roman” with font size 12, with line spacing of 1.5 and justified. KSLR (Kathmandu School of Law Review) is conducting its 2nd International Research Paper Writing Competition (IRPWC).   About KSLR KSLR is a double-blind peer-reviewed, open-access and faculty-student edited flagship journal of Kathmandu School of Law.   About the Competition KSLR is a double-blind peer-reviewed, open-access and faculty-student edited flagship journal of Kathmandu School of Law. It aspires to become one of the growth-stimulators for the budding legal scholarship in Nepal, by publishing quality and balanced contents of local, national, regional, international, and universal value. Although KSLR uses a wide-angle lens and acknowledges that its publications may be instrumental for everyone and every field of scientific inquiry, it primarily aims to be an enabling and accessible publication for scholars and professionals who have stakes in the field of law and legal studies. To this end, KSLR conceived the IRPWC in 2020 specifically as a competitive and incentivized opportunity for emerging scholars and professionals. We believe that the 1st IRPWC, themed ‘International Order Post COVID-19’, was a prodigious stride towards our aim, to continue which, KSLR announces the commencement of the 2nd IRPWC, and invites submissions within the theme of: “Contemporary Issues in Migration Law”   Purpose Governance of human migration has persisted as an important subject-matter for discourse. However, the COVID-19 pandemic introduced new complexities in the human movement, mobility, and migration phenomena and aggravated the existing ones. Judicious legal and policy interventions are required to protect the rights of the migrants, and to foster order and humanity in the management of migrations. We invite authors to research, critique, and provide actionable law and policy related recommendations to enhance the governance of human migration.   The IRPWC’s working definition of human migration For the purpose of the 2nd IRPWC, human migration has an open-ended definition inclusive of any factor that induces human migration, and any continuing or new pattern of human movement, whether internal or transnational, regular or irregular, permanent or temporary, voluntary or involuntary, or of a nature that is currently unclassifiable but deserves discussion.   Sample Issues Following is a sample (non-exhaustive list) of broader issues based on which specific topics for research may be formulated: Issues within the definition and classification of ‘migration’ and ‘migrants’; Issues within various international legal frameworks applicable to human migration. These include: human rights law, international labour standards, refugee law, the law against transnational organized crimes, environment law (notably the law on climate change), humanitarian law, international health regulation, and such; Relativism in law, policies and practices among states of origin, transit and destination, and the consequential gaps in protection of migrants; The role and functions of inter-governmental organizations and the national government(s) in managing human migration and protecting migrants; Accountability of non-state actors; Legal and policy amendments to address the disruptions in and emerging patterns of human migration in the wake of the COVID 19 pandemic.   Sample Topics In order to justify research in any issue such as those listed above, a research paper should be limited to a specific research area and topic within the broader issue/area. Following are some examples of narrow and clear research areas derived from actual journal publications: A paper that builds up a conclusion that the principle of non-refoulement under human rights treaties has a broader and more protective interpretation than under the Refugee Convention. A paper that categorically investigates the absence, necessity and possibility of a global migration law. A paper that recommends policy interventions to reduce the insecurities among migrants caused by disruptions in migration as a result of COVID 19 Pandemic. It narrows down the research area by pinning on a specific theoretical approach and building upon the findings of a specific report, which in turn is limited to a comparative study on nature of migration and its governance system in 7 countries, including Nepal. A paper that “questions the conflation of transnational domestic work with trafficking”, at least an automatic one. In doing so, it “explores the experience of several young Nepali women who spent time in the Persian Gulf as transnational domestic workers, and argues that migration served to increase their sense of autonomy and agency”. For additional ideas for topic formulation, you may browse through the International Organization for Migration (IOM) catalogue of migration related journals, which also features law journals.   Eligibility The competition is open to students enrolled in bachelors, masters or Ph.D. level of studies, research scholars, and early career academicians with no more than 7 years of experience in their profession. A paper may have up to three authors. Only one submission is allowed per author.   Registration Procedure and Deadline Registration for the competition shall be free of cost. Submission of the research paper shall automatically register author(s) for the competition. The research paper should be submitted at https://forms.gle/N5cSCYNCN9JKfreJ9. The deadline for submission of the research paper, without any exception, is 20 December 2021, 11:59 PM NPT (GMT +5:45).   Formatting & Styling The research paper should be submitted as a Word file (.doc/.docx) at the link specified in section 5.3. The Word file should be named in the following manner: an case of a single author: fullnameoftheauthor_irpwc2021, In the case of multiple authors: lastnameofauthor1_lastnameofauthor2_lastnameofauthor3ifany_irpwc2021 The research paper should be in English. It may be in any standard form of English. The word limit for the research paper is 10,000 words. This includes an abstract of 200-300 words, annex (if any) and footnotes.   Plagiarism and Referencing The research paper should be the original work of the author(s). Refer to section 8.1. The research paper should not have been published elsewhere in significant parts or as a whole. If it has been submitted elsewhere for consideration for publication, the submission must be retracted before submission at IRPWC, and the proof of retraction must be submitted. References must comply with the KSL Comprehensive Style to Legal Citation.   Specific Quality Indicators Following are the quality indicators applicable to all submissions to KSLR, including the IRPWC: The research paper should not have a plagiarism report exceeding 15% when scanned by a reliable plagiarism detection tool. This excludes commonly used terminologies. Automatic paraphrasing or any other text manipulation should not be used to mask plagiarism. The footnotes should be uniform in format, authentic, accurate and complete, and as prescribed in section 7.3. The content of the research paper should be a novel contribution to the area of legal scholarship (specifically the migration law in case of IRPWC 2021). The title should be clear, concise, appealing, and compatible with the paper’s overall content. The abstract should be an apt gist of the paper. Any breakthrough or remarkable conclusion of the paper should be included in the abstract. The introduction should contain a clear thesis, that is the statement(s) of the problem being investigated. After the thesis, the introduction should contain a concise paragraph describing the arguments that will be developed in the paper. The arguments of the paper should be logical and well-substantiated: Facts and legal authorities should be presented sincerely, accurately, and referenced properly. Every argument should be founded upon clear reasoning. Supporting reasons should be backed by appropriate referencing. Generalizations and sweeping statements should be supported by numerous confirming sources. Diverse opinions should be considered before taking stances. Differing opinions should be indicated while making debatable claims. Personal biases should be disclosed when they may influence the readers. The conclusions should be based on the arguments of the paper. Unsubstantiated conclusions take away from an otherwise well-researched and credible paper, and should be avoided. The contents and their presentation should be engaging. The articulation should be clear and comprehensive. Use of purposive jargon, especially legal terminologies is encouraged. However, verbosity should be avoided. All expressions should conform to the established principles and rules of human rights, including those on sexual and gender orientation and identity, as well as the reasonable limitations to the freedom of opinion and expression.   Evaluation and the Scale or Marking The research paper shall be marked on a scale of 100. Specific scales of marking shall be: The Extent and Depth of Research 30 Novelty and Creativity 20 Logic and Organization of Arguments 30 Grammar and Vocabulary 10 Formatting 10 Anonymity of the author(s) shall be maintained throughout the evaluation. There shall be two rounds of evaluation. In the first round, the papers will be evaluated for plagiarism, formatting in accordance with the KSL Comprehensive Style to Legal Citation and timeliness of the submission. Papers whose plagiarism score exceeds 15% as specified in section 8.1. will not proceed to the second round. The second round of evaluation shall be performed by an independent panel of evaluators. The cumulative marking shall be final and binding.   Penalties Improper formatting: 1 point shall be deducted for each instance where the formatting is inconsistent with Chapter 1 of the KSL Comprehensive Style Guide to Legal Citation. Improper footnote: 0.2 point shall be deducted for each instance. Compounded deductions: for sections 10.1 and 10.2 shall not exceed 10 marks. Breach of the word limit: 1 point shall be deducted for every 100 extra words.   Awards The best paper with the highest scores will receive a corresponding certificate and a cash prize of US $150/- (Inclusive of bank transfer charges wherever applicable). The second-best paper with the second-highest scores will receive a corresponding certificate and a cash prize of US $100/- (Inclusive of bank transfer charges wherever applicable). The third best paper with the third highest scores will receive a corresponding certificate and a cash prize of US $50/- (Inclusive of bank transfer charges wherever applicable). Each outstanding paper falling short of three best scores will be awarded an “Honorary Mention” and receive a corresponding certificate. All remaining participants who reach the second round of evaluation will receive a corresponding certificate of participation. Participants who do not reach the second round of evaluation will not receive a certificate of participation.   Publication of Papers The editorial board of KSLR shall hold a meeting at the earliest following the termination of the competition to shortlist papers submitted to IRPWC 2021 for publication in the closest issue of the journal. The Board should prioritize the papers mentioned in sections 11.1-11.3 for that purpose. Papers under section 11.4 may also be considered for publication. Papers not mentioned in sections 11.1-11.4 may be considered for publication under special circumstances after careful discussion among the board members. The shortlisting shall be based on the initial review standard of KSLR. All the shortlisted papers must be peer reviewed according to the double-blind peer review standard of KSLR. KSLR has the exclusive right to publish all the papers submitted to IRPWC 2021 from the date and time of the submission. The exclusive right to publish will be transferred to the respective authors under following conditions: If any shortlisted paper is not approved for publication, subsequently. In case of papers not shortlisted, from the date and time of such decision. In case of papers that do not reach the second round of evaluation mentioned in section 9, from the date and time of the disqualification. All IRPWC 2021 papers published in KSLR shall abide by its copyright policy.   Miscellaneous The participant, by registering in the competition, agrees to indemnify the Administrator from and against claims, suits, and damages based on any allegations of copyright infringement, plagiarism, or unauthorized use. The participants can retract their paper. To do so, they must inform the organizers prior to the publication of the results. The Administrator reserves the absolute right to cancel, defer or postpone indefinitely, the competition in an event accruing to any contingency, natural or human-made. In case of any dispute, the decision of the Administrator shall be final and binding.
