HNLU in collaboration with Tribal Research and Training Institute, Government of Chhattisgarh and Thakur Pyarelal State Institute of Panchayat and Rural Development is organizing a two-day National Conference on Tribal Transition in India: Issues, Challenges and the Road Ahead that is scheduled on 26-27 November 2021.   About HNLU Hidayatullah National Law University (HNLU) was established under the Hidayatullah National University of Law, Chhattisgarh, Act, (No. 10 of 2003). It is recognized by the University Grants Commission u/s 2(f) and 12(B) of the UGC Act, 1956 and also by the Bar Council of India u/s 7 (1) of the Advocates Act, 1961. HNLU ranked 5th in India Today Ranking 2021 and 51-100 on crisis management during COVID by the World’s Universities with Real Impact (WURI) Ranking 2021 and 201-300 among the innovative and emerging Universities by WURI is set to scale new benchmarks in the years to come.   About TRTI Keeping in view the population of Scheduled Tribes in the state of Chhattisgarh, Tribal Research and Training Institute (TRTI) was established in the year 2004 under the centrally sponsored scheme by the State Government. The institute conducts research work and surveys on the socio- economic, culture, language and life of Tribals. About TPSIPRDThakur Pyarelal State Institute of Panchayat & Rural Development (TPSIPRD) is the premier Institute under the Department of Panchayat & Rural Development, Government of Chhattisgarh. It was established in year 2002 with the main objective of building the capacity of the Panchayati Raj Institutions, functionaries and  members of the civil society organizations engaged in rural development.   About the Conference Tribals constitute 8.6% of total population of India. Albeit their profound culture and traditional knowledge, a vast majority of the Tribals stay at the low stratum of the society. Decades of development have prompted a reformist disintegration of the conventional rights over their traditional assets including the forest. This can be suitably attributed to the lacunae in the law and flaws in execution. Against this backdrop, Hidayatullah National Law University in collaboration with TRTI and TPSIPRD is organizing a Two-Day National Conference on “Tribal Transition in India: Issues, Challenges and the Road Ahead” on 26-27 November, 2021. The present conference is intended to provide a platform to discuss and deliberate the theme in detail during the technical sessions followed by the Panel Discussions being chaired by subject-matter experts.   Rationale of the Conference In the historical backdrop, the tribal identity has experienced numerous changes and challenges. The powers of globalization which entered in to their ancestral world with dynamic state support have added torments in the existence of the clans. Even after seventy years of planned development, the financial state of clans has not improved and tribal regions are considered as under developed in our country. Advancement measures in the tribal regions should consist of bringing harmony among safeguarding ancestral identity, culture and qualities, while expanding and guaranteeing their admittance to standard educational facilities, wellbeing and vocation. Feeble land record frameworks, destitution, ignorance and exploiation have brought about persistent drainage of assets thereby prompting pauperization of tribal communities.   Theme and Objectives Hidayatullah National Law University Raipur in collaboration with Tribal Research & Training Institute, Government of Chhattisgarh and Thakur Pyarelal State Institute of Panchayat & Rural Development, is organizing two-day National Conference on “Tribal Transition in India: Issues, Challenges and the Road Ahead” on 26-27 November, 2021. To understand the functioning of local self-governments in the tribal communities of India To support indigenous people and their traditional agriculture and livelihood systems by deliberations in legal framework To learn their unique subsistence systems and provide solutions to socio-cultural issues for their active involvement To discuss schemes and international norms related with the welfare of indigenous communities for their overall development To create awareness on indigenous peoples’ rights in the society To provide inputs to the concerned authorities for further policy formulation and implementation   Sub Themes Historical Background of Self Autonomy of the Tribes; A Review of PESA: The Impairment of Tribal Rights in a Decentralized Government; Power of Traditional System of Local Self-government in resolving the Conflict; Designing an Alternative Legal System for tribal governance in India; Gender and Customary Laws; Community claims on Forest Resources: A Review of Forest Rights Act,2006; Culture and Ethnic Identity; Tribal women and empowerment; Contribution of Judiciary in Protection of the Rights of Tribes; Conditions of the Internally Displaced Tribal Population; Protection of IP rights and Traditional knowledge of the tribes; Violations of the Rights of Indigenous Peoples by the Security forces and Armed Opposition Groups; Right to food of indigenous communities; Right to life and occupations of indigenous communities; Tribals and International Humanitarian Law; Social justice lawyering, free legal aid for tribal communities. These sub-themes are only suggestive areas and are not exhaustive. Gujarat Law Society of GLS University is organizing the Shri I.M. Nanavati National Moot Court Competition for Law Aspirants from January 7-9, 2021.   About Gujarat Law Society Gujarat Law Society (GLS) is a premier educational group, offering courses in multiple disciplines. It stands as a synonym for contemporary education in the region with its state-of-the-art infrastructure which houses nearly 29 institutes in various spheres.. The society has a particularly expansive alumni group too which echoes the values that GLS has imparted, right since its inception. Nanavati This stalwart of law was born in the city of Jambusur near Bharuch in 1920 and bore the name ShriI.M. Nanavati. He came to Ahmedabad for law studies and at a very young age joined the barin the footsteps of his father. In the initial years of his practice he joined Maneklal Harilal Mills to look into Labour and Company Matters. With his foresight and hard work he became famous and in a short time span he became one of the renowned advocates of India. He always took a keen interest in overall development of the people and in development of Educational Institutions. He was deeply interested in the promotion of education and did tremendous work in that field. His busy practice however was no bar to his love for social and educational activities, in which he took leading and prominent part. The inspiring zeal and managerial ability of Late Shri I.M.Nanavati had gone a very long way in establishing Gujarat Law Society. He contributed greatly to the stability and steady growth of the society during the period of his association with the Gujarat Law society. He was a teacher at the Law Faculty and is even today remembered for his outstanding quality and contribution as a teacher of Law, a very able administrator, and a noble human being who made his mark not only in the courts in Gujarat but also in the Supreme Court of India. He was an aware educationalist, a leading lawyer and the then Hon’ble Secretary of Gujarat Law Society. He left for the heaven on January 15,1981 in the city of Nairobiat South Africa. In the Will of Shri I.M.Nanavati he express his wish that “In the end, I desire that when I pass away, my mortal remains be drawn through the Ellisbridge Campus of the Gujarat Law Society of which I was a student and which I have served for more than 20 years as Hon. The clarifications, if any, provided by the college shall be considered as if it were a part of the Moot Proposition and shall have no individual significance. “Competition” means Shri I. M. Nanavati Memorial National Moot Court Competition,2021-22 “Institution” means any recognized law school/college or university. “Participating Team” means the team which has registered itself for the competition as per the rules for registration. “Participating Institution” shall be presumed to be the parent institution of the participating teams. From each institute only one teams can represent the institute “Organizer” means the Faculty of Law, GLS Law College, Ahmedabad “Rebuttals” refer to those arguments /questions that the Complainant may raise at the end of the main pleadings of all the Orators. This shall be replied to in the appropriate manner by the Respondent. “Written Submission” means the memorandum of written submissions submitted by any Team. Organizing Committee” means the Moot Court Committee hereinafter referred to as MOC or MCC “MEC” means Memorial Evaluation Committee.   Dress Code The participants shall adhere to following dress code when present in any courtroom during the Competition. Female: White salwar and kurta or white shirt and black trousers along with black coat and black shoes; Male: White shirt, black trousers and black tie along with black coat and black shoes.   Language The language of the Competition shall be English   Eligibility The Competition shall be open to students who are– Pursuing an integrated 5 year LL.B. program in India or pursuing a 3 year LL.B. program in India. Only 32 teams on first come first basis shall be allowed to register. Provided in furtherance to the above clause, the first 32 teams shall be reckoned on basis of the final registration.    Team Composition Each team shall constitute of 3 members, two ‘Oralists’/‘Mooter’ and one ‘Researcher’. Only the team member(s) designated as Oralist/Mooter shall be allowed to put forth oral submissions. Under no condition shall a team consisting more than 3 members be allowed to participate.   Anonymity of Teams Teams shall not reveal the identity in any form, except by means of the Team Code allotted to them during the Competition. The Written Submissions shall not reveal the identity of the team in any form and should not bear the logo, name etc. of the University represented. Any material presented to the Panel should be devoid of any identification marks/seal of the Team. If any such mark/seal exists, it must be rendered unrecognizable. Any violation of the above rules shall attract severe penalty or disqualification as determined by the MCC. The decision of the MCC in this regard shall be final, binding to the participating team and shall not be subject to challenge by any team.   Registration The participating institutions must have to register by filling the Google form till 15thNovember, 2021 by 11:59 PM (IST) In order to confirm participation, teams of every Institution should register themselves with the Registration forms duly signed by the heads of the institution along with the fees of Rs.2500/-per team. Any team requiring accommodation will have to pay registration fees of Rs. 5000/-. Any form  received after the last day of registration will not be allowed. The amount once paid shall not be refunded   Change in Team Composition Any change in team composition will not be entertained after the registration. In case of any unforeseen contingency where it becomes imperative to change the team competition, the participating team shall send an email regarding the same to the Administrator and MCC containing the compelling reason for the change. However, the change in the composition shall be done at the discretion of the MCC   Researcher's Test The Researchers’ Test shall be conducted on January 7, 2022 The test shall be for duration of sixty (60) minutes only. The test shall consist of objective questions based on General Principles of the Statement of Facts, matter(s) of Law involved in the Moot Problem and General Principles of National and International Law. The Researchers’ Test shall test the knowledge of the laws involved as well as the factual details of the Moot Problem and the application of the relevant laws to the circumstances in the Moot Problem. No notes, bare acts, books or any other material or electronic aid shall be permitted during the Researchers’ Test. ONLY the Researcher as mentioned in the Registration Form shall be eligible to appear for the test.   Format of the Competition and Oral Arguements The Competition is divided into 4 rounds: Preliminary Round, Quarter Final Round, Semi Final Round, Final Round. The time split between the speakers must be communicated to the Court Bailiff/clerk prior to the commencement of each Round. Once so informed, these timings shall not be changed. Use of any electronic gadgets is not permitted during the course of oral proceedings. Teams shall not disclose, in any manner whatsoever, for the entire duration of the Rounds, either their own individual identities or the identity of the institution that they represent, even if asked by the judges. Teams can pass on compendium of the sources they cite in their Memorials if so permitted by the judges. Team scores shall not be disclosed after every round. Teams must not make any attempt to gather any such information, until notified by the Organizing Committee. In case of absence of any team or failure of any team to reach in any of the oral submissions round will render disqualification of the team for that round. In such a case, their opponent shall make their oral submissions ex parte and the calculations shall be made accordingly. The oral arguments should be confined to the issues presented in the memorial. Discrepancy shall not be permitted. The researcher may sit with the speakers during the oral submissions. However, No Researcher of any Team shall be permitted to address the Panel. Evaluation shall be done on the basis of following criteria: Particulars Marks Articulation of Issues 20 Presentation Abilities and Citation of Authorities 20 Court Mannerism 20 Application of Legal Principles 20 Response to the queries of Court 20 Any Team which violates any of the Rules with respect to the Oral Pleading Sessions would be penalized. The decision of the Bench shall be final in this regard.   Conduct of the Oral Rounds Preliminary Round Draw of Lots: The matchup of teams in Preliminary Rounds shall be determined on the basis of draw of lots. Each team will get 20 minutes to present their case. Total of 5 minutes can be reserved for Rebuttal, subject to the discretion of Judges. These  5 Minutes are exclusive of the 20 minutes given to each team. Each team shall argue from both the sides in the Preliminary Rounds. There shall be two Preliminary Rounds. No team shall argue the same side twice in the Preliminary Rounds. Win or loss of a team shall be determined on the basis of aggregates core of pleadings. Only one (1) speaker from each team shall be permitted to rebut/sur-rebut. In the preliminary rounds, the team with the higher aggregate speaker scores in the courtroom (including the rebuttal scores) shall win that round. If there is a tie in the aggregate speaker scores in case of a division bench, then the team with the higher memorial scores shall win that round. The top 8 teams based on their Win/Loss ratio and Total Preliminary Score in the Preliminary Rounds, shall qualify for the Quarter Final Rounds. Win/Loss Ratio shall be the ratio of number of Wins versus the number of Losses in the Preliminary Rounds. Total Preliminary Score is the total score obtained by both the speakers (including the rebuttal score) in both the Preliminary Rounds. Total Preliminary score does not include the memorial scores. Following shall be the system for determining the teams that advance to the Quarter Final Rounds: If there are more than 8 teams that have a Win/Loss ratio of 2:0, then out of such teams, the top 8 teams based on their Total Preliminary Score, shall qualify for the Quarter Finals If there are less than 8 teams that have a Win/Loss Ratio of 2:0, then firstly, all such teams that have a win/loss Ratio of 2:0 shall advance for the Quarter Finals Rounds. Secondly, out of the teams that have a Win/Loss Ratio of 1:0, the remaining spots in the Quarter Final Rounds shall be filled, based on the Total Preliminary Score of such teams. If there continues to be a tie, then the team with the higher Memorial scores shall qualify to the Quarter Final Rounds Quarter Final Rounds Eight teams based on the result of the Preliminary Rounds will qualify for the quarter- finals. The team shall argue only once in the quarter-finals. The side on behalf of which the team shall argue for the quarter-finals shall be decided by way of draw of lots prior to the Quarter Final Round. The quarter-finals shall be a knock-out round. Each team is allotted a total of 20 minutes to present their oral arguments. The timing can be divided between both the speakers according to the wish of the team subject to a maximum of 12 minutes and minimum of 08 minutes perspeaker. The time division has to be informed to the Court Manager/Clerk before the beginning of the oral arguments. A maximum of 5 minutes may be reserved per team for rebuttal and surrebuttal which shall be at the discretion of the judges which shall be exclusive of the above time limits. The allotment of extra time shall be at the discretion of the judges Semi-Final Rounds Four teams from the Quarter-Final Round shall qualify for the Semi-Final Rounds. Semi-Final Rounds shall also be knock out rounds. Each Team shall argue only one side in the semi-finals, the side of which shall be decided by the way of the draw of lots. Each team shall be allotted a total of 30 minutes to present their oral arguments. The time division can be divided between both the speakers as per the discretion of the teams subject to a maximum of 17 minutes and minimum of 13 minutes per speaker. A maximum of 5 minutes may be reserved per team for rebuttal and surrebuttal which shall be at the discretion of the judges. The said 5 minutes shall be exclusive of the above time limits. The allotment of extra time shall be at the discretion of the judges. Any time extension without due permission of the judges shall invite negative marking.  Final Round In the final round, the win-loss shall be decided on the basis of the aggregate score. No memorial score shall be added in the finals. Each team shall be allotted a total of 45 minutes to present their oral arguments. The time division can be divided between both the speakers as per the discretion of the teams subject to a maximum of 17 minutes and minimum of 13 minutes per speaker. This time division has to be informed to the Court Masters/ Clerks before the start of Oral Arguments. A maximum of 5 minutes may be reserved per team for rebuttal and surrebuttal which shall be at the discretion of the judges. The said 5 minutes shall be exclusive of the above time limits. The allotment of extra time shall be at the discretion of the judges. Any time extension without due permission of the judges shall invite negative marking.   Rules for Written Submission/ Memorial Evaluation Teams shall prepare and submit memorials from both the sides. Late  submissions beyond the stipulated time shall be penalized according to the format mentioned herein in this section.   Format of Memorial Body of the memorial shall include: The cover page with the cause title Table of contents List of Abbreviations Index of Authorities Statement of Jurisdiction Statement of facts Statement of issues Summary of Arguments Arguments Advanced Prayer The font of the body of the memorial should be in the following format:  Font of the body of the memorial Times New Roman, size 12 Line spacing 1.5 Heading Font size 14 The font to the foot notes Times New Roman size 10 Alignment Justified Teams shall cite all authorities in the Written Submission using footnotes following the Bluebook Method of Citation (20th edition). NOTE: Footnotes should be limited only to citations and in no case shall footnotes contain additional information or arguments. Any such attempt shall invite Negative Marking.   Additional Rules for Memorial Submission Memorial should be spiral bound. Pages should be numbered at the bottom middle. All the Memorials Received within the time schedule will be evaluated by the MEC. The Evaluation done by the MEC will be final and binding. Each team shall send one hardcopy of each side to the organizers within the time limits prescribed in the rules. Any difference in the hardcopy and the softcopy submitted will attract disciplinary action as per the discretion of MCC. The teams will have to send 1 hard copy of the memorial from each side on or before the date of submission of Hard Copies of the memorial in adherence to the dates provided in the rulebook. The remaining 8 copies of the memorial of both the sides have to be brought along by the teams on 17th January 2020. The memorials shall not contain any form of identification apart from the team code. If any such identification or mark, symbol, etc. which has the effect of identifying the team is found on the memorial, then it shall result in instant disqualification. The Law and Technology Society is organising its National Debate Competition on October 23 and 24, 2021.   About The Organisers The Law and Technology Society of NLSIU, Bangalore is a group committed to exploring the boundless contours of the intriguing interface between law and technology. The main objective of the Society is to develop up-to-date learning opportunities in this field by organizing a series of fantastic events. The Dialogue is a research-driven think-tank working on the intersection of technology, society, and public policy. By facilitating informed policy debates at various levels, it aims to drive a progressive narrative in India’s policy discourse.   Theme of the competition The dynamic nature of the internet requires us to revisit the traditional frameworks and explore more enabling policies for regulating competition in digital space. South Asia is home to major democracies of the world. It shares a common base with culture, social, economic, political, and linguistic diversities. It is home to 24.89% of the total world population with growing poverty, weak governance, and dwindling democracies and economic structures. Recurring problems have led to the instability of the democracies making it a volatile ground for the overthrowing of the Constitution of the countries. There are multi-fold reasons for these instabilities. Constitutionalism can guarantee democracy. For a long time, the South Asian countries have looked towards the West for adopting the ideas and solutions to their problems but these problems can only be solved by the indigenous and homegrown approaches. Academic discussions can play a vital role in this continuous process of evolution of the Constitution and democracies. The colloquium will help in the concurrence of learners and researchers from different countries which will lead to an exchange of thoughts, expression, creativity, novelty, and innovation. It has also led the South Asian States to change, amend and replace their existing constitutional structures. Comparative constitutional law jurisprudence in the subaltern context in South Asia exposes how institutional safeguards like constitutional courts, human rights commissions, regional institutions have been compromised due to instabilities like the militarized constitutional politics, subservience of democratic principles, and flawed constitutional designs. The unconventional jurisprudence evolving in this region exposes how decolonial South Asia is developing its own subaltern constitutionalism. The colloquium through critical cases studies of crisis in India, Pakistan, Sri Lanka, Malaysia, Myanmar, and Nepal traces how ethnic politics, religion, nationalism, authoritarianism, decolonisation has all contributed to the creation of distinctive constitutionalism in South Asia. On average, Constitutions have lasted only 17 years since 1789. Within this, Constitutions in the post-colonial countries, which gained independence after World War II, have been particularly fragile. Pakistan, for example, has had three different Constitutions and large periods of rule without any Constitution. Among the 12 Asian countries that gained independence soon after World War II and drafted Constitutions, only three Constitutions have survived - India’s, Taiwan’s, and South Korea’s. During the course of the colloquium, the participants will delve into political, historical, or constitutional analysis comparing South Asian constitutional experiment with its indelible geopolitical and internal crisis legacy. South Asian subaltern constitutionalism is a break as well as a continuity, which is the result of the intersection of mutually constitutive post-structuralism and post-colonialism. The success of South Asian democracies will lie in tracing the stability of constitutional institutions, empowering marginalized minorities, and proselytizing subaltern constitutional ethos. Despite strong constitutional guarantees, South Asian states have witnessed legitimisation of discrimination and delegitimization of rule of law. Thus, the realization of women’s rights and gender equality is crucial for sustainable development. The international momentum for promotion, protection of Women’s rights coupled with Gender equality initiatives has percolated to national level mandating effective redress of violations of human rights. Within the frame work of the Indian democratic polity, he laws, development policies and plans have aimed towards advancement of women rights and gender equality. Hence, the need to accentuate women’s rights emanates from the inter-linkages between Gender inequality and human development wherein as per the Global Gender Gap Report 2021 India ranks 140th out of 1506 countries in-spite of pro-women laws and constitutional tenets of affirmative action alternatively positive discrimination in favour of women. The Constitution of India embodies the principle of gender equality, in the Preamble, Fundamental duties and the Directive Principles. However, women continue to face discrimination, harassment consequentially, violation of their rights. The need of the hour is to develop appropriate strategies to eliminate any form of discrimination against women so that women can participate equally in all walks of life. This Virtual National seminar will throw light on several issues and challenges faced by women with special reference to post pandemic era and discuss the needs for the advancement of women in all walks of life. International Labour Organization is inviting submissions for its 7th Annual Global Media Competition 2021 on Labour Migration.   About International Labour Organization International Labour Organization (ILO) is a United Nations agency whose mandate is to advance social justice and promote decent work by setting international labour standards. They have developed a system of international labour standards aimed at promoting opportunities for women and men to obtain decent and productive work, in conditions of freedom, equity, security, and dignity.   About the Competition The Competition aims to recognize fair and balanced media reports that contribute to the elimination of public misperception, xenophobia and discrimination against migrant workers and highlight the positive contributions they make. This year, specific media coverage of the impact of COVID-19 on labour migration and fair recruitment, including contributions of migrant care workers, will be viewed favourably, as well as stories about migrant domestic workers to mark celebrate the 10 year anniversary of the ILO Domestic Workers Convention, 2011 (No. 189). The competition is open to both professional and student journalists. The winners will be selected by a panel of experts in international migration and journalism, based on creativity, accuracy and balance, protection of migrants, and positive portrayal of labour migration    Entry Criteria For the professional awards, this contest is open to media professionals and professional journalists who are 18 years of age and older. For the student award, this contest is open to students from journalism schools/universities who are currently enrolled in a journalism school or university curricula. To enter the contest, all participants must fill in the Online Entry Form. No postal submissions or e-mail will be accepted. Entries should fall into one of the following two categories: i) Professional or ii) Student. For each entry submitted the author should indicate which type of production is being submitted: written press, photo essay, multimedia, video, radio (referred to below as “media pieces”). The Octa-Final, Quarter- Final, Semi-Final and the Final Round shall be knockout rounds where each team will argue only once either for the Petitioner/Applicant or Respondent.   Researcher's Test The Researcher’s Test will be conducted prior to the oral rounds. The test shall be proctored and be conducted on an online platform. The questions for the test shall be objective based on the applicable law, precedents and facts pertaining to the Moot Proposition i.e. MCQ based test. There shall be a total of 25 Questions for 2 marks each. The test shall be taken by the team’s researcher. In case the team has no designated researcher, one of the speakers shall be required to take the Researcher’s Test. Please note that the marks scored in the test shall not contribute to the overall score and is only to determine the winner of the Best Researcher's award. Rules and Regulations with regards to the conduct of Researcher’s test shall be sent to the participants in due time.   Preliminary Round The preliminary rounds shall be conducted in two stages. Each stage will have one preliminary round where each team will represent either the petitioner/applicant or respondent for that round. Sides will be determined by way of draw of lots. Each team will face a separate team and a separate bench in both the preliminary rounds. The qualification to Octa-Finals will be determined based on the Round Point System as explained in Provision VI. Addendum The teams based on their registration and the team code disclosed therein, shall be allotted either Petitioner/Applicant or Respondent i.e. all teams with an even number code shall be Petitioner/Applicant for the preliminary round and all teams with an odd number code shall be Respondent for the preliminary round. If a team is allotted Petitioner/Applicant for Preliminary Round 1, the same team shall be representing Respondent for Preliminary Round 2. Prior to each round, in furtherance of transparency, the Moot Court Society shall conduct a meeting for draw of lots wherein teams will be paired at random by using particular randomizing software.   Octa-Final Round The top sixteen (16) teams selected by way of Provision VI shall qualify for the octa-final round. A seeding chart shall be prepared with ranks being given to the top 16 teams. To ensure fair play, power match-up shall determine the fixtures which shall be prepared with the top sixteen (16) teams in such a way that Rank one (1) goes against Rank sixteen (16), Rank two (2) goes against Rank fifteen (15) and so on. Only the sides on which the teams shall argue will be determined by way of draw of lots.   Quarter-Final Round The top eight (8) teams selected by way of Provision VI shall qualify for the quarter-final round. A seeding chart shall be prepared with ranks being given to the top 8 teams. To ensure fair play, power match-up shall determine the fixtures which shall be prepared with the top eight (8) teams in such a way that Rank one (1) goes against Rank eight (8), Rank two (2) goes against Rank seven (7) and so on. They shall be dealing with queries of the participants, releasing the schedule of the event, and other essential matters.    Language The Language of the Competition shall be in English.   Interpretation The organizers of the event will have the final authority to interpret the rules.   Eligibiliity Students of any year from Five year or Three-year courses or LLM Courses from any college or university shall be eligible to participate in the event. Only one team can register and represent one university/college, the participants must have a permission letter from their respective college/university.   Team Composition Each team shall constitute a minimum of three members. In a team comprising of three members, two as a speaker and one member shall be designated as a researcher. In an exceptional scenario, the team may comprise of two members and one of the speakers might also be designated as a researcher.   Researcher A researcher shall be allowed to argue only with the permission of the court.   Dress Code The Dress Code shall be formals. Quarter-final Round Day 1. Semi-Final Round Day 2. Final Round Day 2. Each team will have to argue from either of the sides in the Preliminary Round. This order will be decided by the draw of lots at the time of orientation on 28th October 2021. The teams who will score the highest aggregate marks in the Preliminary Round will be eligible for qualification in the Quarter-final Round which shall consist of 8 teams. In case of a tie in the above procedure, the marks scored for the memorials shall be the deciding factor. In case of any doubt, the decision of the organizers will be final. The Sides for the Quarter-Final round will be decided by the draw of lots immediately after the results of the Preliminary Rounds. Quarter-Finals will be decided on a knockout basis. The Qualifying teams shall then argue the case in the Semi-Final Round on 30th October 2021. Semi-Finals will be decided on a knockout basis. The Qualifying teams shall then argue the case in the final round on 30th October 2021   Oral Submissions Each team should have two speakers who shall divide the oral submissions between them. Rebuttals are permitted. Sur- rebuttals are at the discretion of the judges. 2. For the preliminary round, each team shall have a maximum of 15 minutes to present their oral submissions. In the quarter-final round, each team shall have a maximum of 25 minutes to present their oral submissions. For the Semi-final round, a maximum time of 30 minutes shall be given to each team. For the final round, a maximum time of 45 minutes shall be given to each team. However, granting more time will be at the discretion of the Judges and no complaints/appeals regarding the same will be entertained. The division of time between the two mooters shall be at their discretion. The aforesaid time would include the time that each team may want to reserve for their rebuttals. No speaker shall be permitted to address the court for more than 10 minutes in the preliminary round, for more than 15 minutes in the Quarter-final round as well as the semi-final round, and more than 25 minutes in the final rounds. At the commencement of each session of the oral submissions, each team shall notify the time of speaker 1 and speaker 2 to the court clerks.   Marking Criteria The following shall be the marking criteria and the marks allotted per Mooter. Each mooter shall be marked out of 100. The preliminary rounds shall be before a two Judges bench. Thus, the total team marks, per Judge, will be out of 200. and the eight top-scoring teams shall move forward to the quarter- final round. In the quarter-final, semi-final, and final rounds, whichever team secures more marks as against its opponent, shall be considered as having won the round. The decision of the Judges shall be final and binding. After investigation and review, in a verified case of plagiarism, the organizers may (1) disqualify the Team, (2) assess a Penalty between one and 50 points to each offending Memorial.   Moot Penalties The Administrator shall impose a Moot Penalty, if necessary, after consultation with the judges, bailiff, Teams, and/or observers.   Deduction of Penalties by Judges Prohibited Penalty points may be deducted only by the Administrator. Judges may not deduct any Penalty points from the scores of the oralists. Judges shall score the Moot as if no violation occurred, and may take an infraction into account only if so instructed by the Administrator.   Activity Subject to Moot Penalties Penalties may be assessed for violations during a Moot by reference to the following table. No change in the names of the participants shall be permitted after the receipt of the Registration Form, except under exceptional circumstances at the sole discretion of the Organizers.   Date and Venue The 5th Seth Jagannath Bajaj Memorial RNBGU National Online Moot Court Competition will be held Online from 23 October to 24 October 2021 at Google meetplatform.   Dress Code Inside the Court Room the participants shall be in Formal Attire: Girls: White Salwar Kurta or Black Pant and White Shirt with Black Tie along with Black Shoes and Black Blazer Boys: White Shirt, Black Trousers with Tie, Black Blazers and Black Shoes   Language The language for the Moot Court Competition shall be English only   Eligibility Each law college / University in India shall be eligible to send one team of its regular students. The competition is open for bonafide students pursuing three-year LL.B. or five-year integrated law course and they must carry their ID cards and all other necessary documents to justify their eligibility.   Team Composition Each team shall comprise of two speakers and one researcher. Students from all law colleges/institutions/universities across the country recognized by the Bar Council of India are eligible to take part in the competition. All participants must be currently pursuing their bachelor’s degree in Law, i.e., either 3 year or 5-year courses. Only one team per college shall be allowed to participate. The official language of the competition shall be English.   Rounds The Rounds will be held in three stages, that is Preliminary, Semi-Final and Final. The side to be represented (petitioner/respondent) shall be decided by draw of lots at different Stages during the competition. Orientation and draw of lots will be on 22 October 2021. On 23 October 2021at 9 AM there will be the online inauguration followed by the preliminary rounds. Top 4 teams will qualify to the semi-finals which will be held on 24 October 2021 The qualification to the knockout stage (Semi- Finals) will be based on the win points. In case of tie, teams with the highest aggregate of scores in the preliminaries (Inclusive of Memorial) will qualify to the Semi- Finals. The Semi Final will be a knock-out round which will be evaluated only on the basis of oral arguments. The Final will be held on 24 October 2021. Oral Rounds In each oral round a team will be represented by two speakers who will present arguments. The researcher will not participate in the argument but will be seated along with the speaker during argument. Passing of any notes (oral or written) to the speaker by researcher is permitted to the minimal extent. However, for doing so the Court mannerism must be followed. Otherwise, there will be negative marking for the same. The order of the pleadings in each Round at all levels of the Competition shall be: Petitioner 1< Petitioner 2< Respondent 1< Respondent 2< Rebuttal (Petitioner 1 or 2)< Sur-rebuttal (Respondent 1 or 2) Preliminary Round Each team will get Thirty (30) minutes to present their case including rebuttals and Sur-rebuttals.The time excludes questioning byjudges. The division of time is at the discretion of the team members, subject to maximum of 18 Minutes per speaker. The division of time must be informed to the court officers/ clerks before the beginning of rounds. Oral rounds need not to be confined to the issue presented in the memorial. The Team member delivering rebuttal or sur-rebuttal must be one of the two team members who argued during the team’s main argument, the team need not indicate prior to rebuttal or sur- rebuttal which of its two eligible members will offer rebuttal or sur-rebuttal. A team’s oral pleadings shall not in any way be limited to the scope of the team’s memorial. The scope of the Petitioner’s rebuttal shall be limited to responding to the Respondent’s primary oral pleadings, and the scope of the Respondent’s sur-rebuttal shall be limited to responding to the Petitioner’s rebuttal. If the Petitioner waives the rebuttal, there shall be no sur-rebuttal. No legal issues which were not addressed in the primary pleadings may be raised in the rebuttal or sur-rebuttal. Semi Final Round Four teams shall advance to the semi-final rounds based on the selection criteria specified for the preliminary round. Teams arguing on the petitioners and respondent’s sides will be decided by draw of lots on 22 October 2021 and the semi-final round shall take place on 24 October 2020. Individual WhatsApp groups shall be created for each team to ensure rapport with the organizers. The entire team (including the researcher) shall be present at the virtual oral presentations. Teams advancing to the semi-finals shall presenttheir case before judges. The platform for conducting semi-final rounds shall be Google Meet. Each team shall be given 15 minutes for oral presentations. Teams are at liberty to divide the allotted time between Speaker1, Speaker2. An extra 5 minutes will be given for Rebuttal/Sur rebuttal. The same must be intimated prior to the rounds. The time allotted to the teams shall be overseen by a Court Officer, who shall also pass information to the teams regarding the time left for presentation. Additional time shall be granted at the discretion of the judges. Further information regarding this round shall be intimated through the above-mentioned WhatsApp groups. In case teams intend to make reference to Compendiums submitted, teams are expected to intimate the same to the concerned court officers prior to the commencement of the session. The researcher during the course of presentation may use the “Present Screen” option” available in Google Meet platform to refer to the concerned page of the compendium. Evaluation of teams shall be purely based on oral arguments alone. In case of tie of marks memorial marks from the preliminary round shall be taken into consideration and a final decision shall be made. Rest of the rules for this round will be same as of the preliminary round Final Round Two teams shall advance to the final rounds based on the selection criteria specified for the semi-final round. Teams arguing on the petitioners and respondent’s sides will be decided by drawof lots. Teams advancing to the finals shall present their case before judges. Teams shall not disclose their identity or name of their institutionor city etc. Such disclosure shall invite penalties including disqualification. The decision for the same shall be at the discretion of the Organizing Committee. All participants are expected to maintain the decorum in the Court during the competition and are expected to conduct themselves in a manner befitting the legal profession.   Memorials Each team must prepare memorials from both the sides to the case. Once the memorials have been submitted, no revision, supplements or addition will be allowed. Late submission of memorial will attract (-1) point penalty for each delay for eachmemorial. Speaking Footnotes or endnotes are not allowed.   Disqualification Format Cheating, Intimidationand Misconduct Cheating or using of unfair means of any kind is strictly prohibited and if found to be indulged in, shall result in disqualification of the team. Intimidation in any form is prohibited, and if found to be indulged in, shall result in disqualification of the entire team. Misconduct, whether behavioral or otherwise, is not allowed, and if found to be indulged in, shall resultin disqualification of the entire team. Court Manners (Oral Arguments) Any form of communication found to be between the Bar table and any person other than those on the Bench is prohibited, and if indulged in, will result in a penalty point. Submission of any written material other than the memorials, compendium and any other documents related to the proposition in hand to the Bench prior to, during or after the oral arguments, is not allowed, and if found to be indulged, in will result in a penalty point. Failure to deliver an oral argument shall be considered to be a disqualification. Scouting Speakers, a reserve or persons affiliated with the team, will not be permitted to observe the arguments in any court room in which the team is not one of the contesting teams whilst the team is still in the competition. Scouting by any team will result in disqualification. Any team can file written complaint with the Organizing Committee, regarding a case of scouting and this committee’s decision will be final and binding. The researcher will be seated with the speakers at the time of arguments and shall not attend the court session of other teams participating in the competition   Marking Criteria Oral Round (For Mooters) The judges would assign marks to each individual speaker out of Hundred (100) marks. The team score would be the average of the total marks for oral presentations of the 2 speakers out of Hundred (100) marks. The participant shall certify in writing the originality of the material contained therein and shall be responsible for any claim or dispute arising out the further use and exhibition of thesematerials. In case the contingency is not mitigated, teams shall be awarded marks based on the arguments submitted till the point connections were lost. In a team consisting of three members, the member designated as Researcher shall take part in the test. Participants are requested to write only the Team Code on the question paper. The researcher’s Test shall be objective as well as subjective with the questions based on the applicable law, precedents, and facts pertaining to the Moot Problem. The duration of the Researcher’s Test shall be 30 minutes. The use of mobile phones, laptops, or any other electronic gadgets/ written material is strictly prohibited during the Researcher Test. The Winner of the Test shall be determined based on the highest score attained Note: The Speakers of any team will not be allowed to sit in the Researcher test in any case.   General Rules for Oral Round The Researcher needs to be present with the speakers during all rounds. The Researcher shall not be permitted to address the Court during the Oral Rounds. The Researcher may, however, be permitted to pass notes to the Speakers at the discretion of the Judges. Such notes shall be passed through the court clerks present in the court room. The use of mobile phones, laptops, or any other electronic gadgets is strictly prohibited during the Oral Rounds, subject to the discretion of the judges. Participants may use their own bare acts, print outs and commentaries provided anonymity is not violated during the Rounds. The decision of Judges as to the marks allotted to each team shall be final and binding. The Competition shall consist of the following rounds: Preliminary Rounds (Two), Quarterfinals, Semi-finals, Final   General Procedure Preliminary Round Registration, Orientation, and Draw of Lots will be held on Thursday 11 th November 2021 and the teams are requested that in all probability to kindly report latest by 9:00 AM at the Venue. Preliminary Rounds will be held on Thursday 11th November 2021. No two teams shall face each other more than once in the Preliminary Rounds. However, such teams may face each other in the Quarter Finals/ Semi-Finals/ Finals Rounds, subject to their qualification. Speaker 1 and Speaker 2 to remain the same throughout the competition. The top eight teams shall qualify for the Quarter Finals. The qualification to the Quarter finals will be based on: Based on the Total Aggregate Score in the preliminary rounds (Both Round). The top eight teams with the higher aggregate scores in both preliminary rounds will qualify for the quarterfinal’s rounds. The aggregate score of a team shall be computed as the total of Oral Scores of Speakers 1 and 2 of the Preliminary Rounds. In case of a tie in scores, the team with a greater number of wins in preliminary rounds will qualify for the quarterfinal. Further, in case of a tie in the scores as well as in the number of wins, memorial marks of two teams will be considered. In the exceptional case of a tie in all the above qualifications of the teams will be based on the draw of lots/ by the toss of a coin. The Best Speaker (male) and the Best Speaker (female) Award will be awarded based on the scores awarded to the individual speakers in the Preliminary Rounds. Individual Aggregate Score shall be determined as the sum of the following: The Score of Speaker in Preliminary Round I, The Score of Speaker in Preliminary Round II Teams will be provided with their opponent team’s memorials after the conclusion of the draw of lots. Return of the other side’s memorial immediately after the preliminary round to the Court - clerks are compulsory Quarter Final Rounds The Quarter Final Rounds would also take place on Thursday 11th November 2021. The teams will be provided their opponent’s memorial after the declaration of preliminary results and the draw of lots for the Quarter Final Rounds Quarter Final Rounds will be knockout rounds. The Winners of the Quarter-final shall advance to the Semi-finals Semi Final Rounds The Semi Final Rounds will be held on Friday 12th November 2021. Semi Final Rounds will be knockout rounds Final Round The Final round will be held on Friday 12th November 2021. Final round will be knockout round.   Time Scheme for Oral Rounds At the commencement of each session the team shall notify the Court Clerk as to the division of time between the 2 speakers (including rebuttal/ sub-rebuttal) 10 minutes prior to the commencement of the Rounds. Preliminary Rounds and Quarter Final Rounds Each side shall get a maximum time of 30 minutes to present their arguments of which no Speaker shall be permitted to address the Court for more than 18 minutes. The time limit is inclusive of the time for Rebuttal or Sur-rebuttal, respectively. The maximum time for Rebuttal is 2 minutes and the maximum time for Sur-rebuttal is 1 minute. Each speaker is required to speak for a minimum 12 minutes exclusive of time taken for Rebuttals and Sur-rebuttals. Semi Final Rounds Each side shall get a maximum time of 45 minutes to present their arguments of which no Speaker shall be permitted to address the Court for more than 25 minutes. The time limit is inclusive of the time for Rebuttal or Sur-rebuttal, respectively. The maximum time for Rebuttal is 5 minutes and the maximum time for Sub-rebuttal is 2 minutes. Each speaker is required to speak for a minimum of 22 minutes exclusive of time taken for Rebuttals and Sur-rebuttals. Final Round The Maximum time for arguments per side shall be the same as in the Semi-finals. The winner of the Final Round shall be declared the Winner of the Competition   Procedure and Marking of Court Rounds Each team will get a total of 30 minutes to present its case. This includes the time for rebuttal and sur-rebuttal. The division of time per speaker is left to the discretion of the team. The arguments should be confined to the issues presented in the memorial. The researcher needs to be present with the speakers during all the rounds. The researcher is allowed to pass chits to the speaker during the rounds. Decision of organising committee on every dispute raised shall be final. Maximum scores for the court rounds will be 100 marks per speaker. The court rounds will be Judged on the following parameters: Knowledge of Facts and law 20 marks Recognition of Issues and Structure of Arguments 20 marks Proper and Articulate Analysis 20 marks Extent and Use of Research 20 marks Ingenuity and Ability to Answers questions 10 marks Overall Presentation (Clarity, Style, Grammar, Language, Structure, Format, Citations and Plagiarism) 10 marks   Dress Code The participants shall be in Formals inside the Court Room. Female(s): White Salwar and Kurta /White Shirt, Black Trouser and Black Tie along with Black Blazer and Black Shoes. Male(s): White Shirt and Black Trouser along with Black Tie, Black Blazer and Black Shoes   Anonymity No coach or participant of any team at any time after the commencement of the competition, including during registration, during the continuation of the competition, and before its completion discloses the identity of his/her college or institution under any circumstance in any manner including, but not limited to, bearing any identifying items like clothing, ties, patches, pins, etc. containing the name or logo of the college or institution that the team is representing or disclosing the name of the team members to the Judges during the competition. In the event, any such disclosure is made, and this rule is violated, the team shall be severely penalized and this may involve disqualification. The penalty to be imposed shall be at the discretion of the organizing committee.   Scouting No member of any participating team shall witness the arguments in any other court room in which the team is not participating. On the night of November 11th, 2021, free accommodation shall be provided by the organizers including all meals. The year 2020 has added another feather to its cap with the introduction of the five-year integrated BBA LL.B course. Entry to the five-year course is through the rankings of the CLAT (Common Law Aptitude Test). It has a mix of senior seasoned faculty as well as young and dynamic faculty.   About the Event Maharaja Agrasen Institute of Management Studies 2nd National Moot Court Competition, 2021, aims to provide a platform for students across India to showcase their advocacy and research skills by competing in a professional and challenging environment. The purpose of organizing this competition is to help the participants nurture their prime advocacy skills. The Department of Law, MAIMS has been successful in organizing several mega-events in the recent past, including Intra Moot Court Competition (2019), Intra Trial Advocacy Competition (2020), 1st National Moot Court Competition (2020) as well as an Induction Moot Court Competition. The Inaugural Ceremony of the event will be organised in a Physical Mode (subject to the prevailing Government Protocols). In wake of the pandemic, we are holding the Competition Rounds at a Virtual Platform in order to ensure safety of the participants.   Introduction Moot court competitions provide an opportunity for curious law students to identify and redress the prospective legal issues presented as the moot problem. It aims to hone their problem-solving skills, encourages them to take upon the tasks of real lawyers, and deepen their knowledge of various legislations. Moot courts stimulate real-life proceedings, push the boundaries of one's intellect, advocacy skills, and emphasizes collective team efforts. Moot court competitions provide a foundation for students across different cities to compete and collaborate in a professional setting, to finesse and test their skills before they join the legal fraternity as the lawyers of tomorrow.   Objectives To facilitate practical learning and capacity building of the young law To engage the youth in a learning ambiance during the covid-19 pandemic. To motivate law students all across India and encourage the holistic development of their interpersonal and professional skills.   Program Details The MAIMS 2nd National Moot Court Competition, 2021, will be held in a Hybrid Mode from 26th November to 28th November 2021. The competition is open for students who are pursuing LL.B three-year / five-year course during the current academic year. Only one team is permitted to participate from each participating Institution. Each team shall consist of three members. This number cannot be modified under any circumstances. In a team consisting of three members, two members shall be designated as ‘Speakers,’ and the third member shall be designated as ‘Researcher.’ All the participating teams must confirm participation by filling a Registration Form on or before October 25, 2021. Each team must use the Team Code for further communication with the organizers during the course of the competition. The stage is set for the 7th Edition of The National Client Consultation Competition that is going to be organized by The NorthCap University on 29th – 30th October, 2021. The Competition is aimed at promoting greater knowledge and practical skills among student advocates in the preventive law and counselling functions of law practice. It will encourage students in developing interviewing, planning, and analytical skills in the lawyer-client relationship in the law office. Interviewing and advising are a significant part of most lawyers’ work. The Competition provides an opportunity for a valuable educational interchange between students, law teachers and legal practitioners. The Competition simulates a law office consultation in which two law students, acting as lawyers (attorneys/solicitors/legal practitioners), are presented with a client matter. The students conduct an interview with a person playing the role of the client. Students are expected to elicit the relevant information from the client, explore with the client his or her preferred outcome, outline the nature of the problem, and present the client with a means (or range of alternatives, if appropriate) for resolving the problem. The interview with the client is then followed by a post- consultation period during which the students, in the absence of the client, analyze the interview and discuss the legal and other work to be undertaken. The interview and post consultation period last a total of 30 minutes. The students are evaluated by a panel of judges. The students are evaluated against specific criteria that emphasize the use of listening, questioning, planning, and analytical skills in a lawyer/client interview. Once the judges have completed their evaluation of the interview, the students are to be called back in and the judges will provide a brief critique of the team's handling of the consultation and post-consultation periods   About the Previous Editions With the success of the 1st NCU National Client Consultation Competition, it climbed another ladder by organizing the 2nd, 3rd, 4th, 5th and 6th edition of its National Client Consultation Competition. The 6th Edition of National Client Consultation Competition, 2020 was the latest in the series of the annual event. Hon’ble Justice Darshan Singh, Retd. Judge, Punjab and Haryana High Court, and Chairperson, Haryana Real Estate Appellate Tribunal was our Chief Guest of the programme. 25 teams from all over the Country came down to participate in the event. After the preliminary round 12 teams made to Quarter-Finals, and 4 teams made it to the semi-finals from which ultimately 2 teams reached the final round. The 2 semi-finalists were from Symbiosis Law School, Hyderabad and Law Centre-II, Faculty of Law, University of Delhi. All the participants must be dressed in a dignified manner befitting the legal profession for the competition. Friendly and healthy interaction among the participating teams and with the students of the host college are encouraged and expected. Use of Mobile phones is strictly prohibited during the competition. Participants shall not reveal the identity of his/her college/university at any point of time during the competition. Participants shall not interact with the clients before the allotted time. The organizers at any point of time will not be responsible for any internet network/ connectivity issues during the competition. Scouting or any other unethical/unprofessional conduct is strictly prohibited, and may lead to disqualification.   Rules and Regulations The event will be conducted in four Rounds namely, Preliminary Round, Quarter Finals, Semi Final Round and Final Round. Preliminary Round will be conducted in two slots; each team will get only one chance to appear in the round. Top 25 teams will go to quarter finals; top 4 teams will go to the semi-final round and top 2 teams will go to Finals. In case of a tie for the 4th place, all the tied teams will be eligible to go to semi-finals. Top two teams from the semi-final rounds will go to the final round on the basis of team scores. The problems for the competition will be set from the area of Criminal Law, Constitutional Law, Civil Law, Corporate Law, Family Law and Contemporary Issues of Law. The organizers will select the clients to play the role as required by the problems.   Competition Procedure The teams will have a maximum of 30 minutes of which first 5 minutes will be allotted for settling the rooms for the clients, Teams can make use of all kinds of material befitting the legal profession for the competition while doing the same. 15 minutes will be for client interviewing and counselling. The remaining 10 minutes shall be for discussion between the participants and the judge. During the post interview period of 10 minutes when the client will not be there, the students will have to summarize the interview, analyze the problem and indicate the course of action to be undertaken to the judge. During this time the judges may also seek clarifications from the teams regarding their approach and analysis of the issues. During this period of 25 minutes, if necessary, the competing students can consult any books or laptop, which they may bring with them. Teams shall not exceed the allotted time but Judges can extend the same for another 2 minutes only after which there will be an automatic negative marking and 1 mark will be deducted for each extra minute. In the interviewing and Counselling stage as well as post interviewing and counselling stage, one member of the team will take the lead role and the other a supplementary role. There should be good coordination between the two team members throughout the 30 minutes period.   Judging Criteria The competition shall be judged on the basis of the following criteria: Establishing the working atmosphere and professional approach. Eliciting the problem of the client and the tools used in so doing. Clients’ goals, expectations and needs. Analysis and formulation of the problem with precision. Suggesting alternatives.
